Srivastava\nRespondent:          President's Secretariat\n                                                     Appeal heard 12.8.2010\n                                               Decision announced 13.8.2010\nFACTS<\/pre>\n<p>      By an application of 27-1-2009 received in the President&#8217;s Secretariat<br \/>\non 2-2-2009 Shri A.K. Srivastava of Press Trust of India applied to the CPIO,<br \/>\nShri Faiz Ahmad Kidwai, President&#8217;s Secretariat seeking the following<br \/>\ninformation:\n<\/p>\n<blockquote><p>      1.       Please provide me the date in detail about the health or<br \/>\n               medical problems of all the Presidents (present and<br \/>\n               former) of the county before, during or after assuming the<br \/>\n               office.\n<\/p><\/blockquote>\n<blockquote><p>      2.       The data should be given for all the 12 Presidents<br \/>\n               separately, that is President wise.\n<\/p><\/blockquote>\n<blockquote><p>      3.       it should be in the tabular form, comprising following<br \/>\n               heads:\n<\/p><\/blockquote>\n<blockquote><p>               \uf0a7 Name of the President.\n<\/p><\/blockquote>\n<blockquote><p>               \uf0a7 Medical problem diagnosed before, during and after<br \/>\n                    assuming the office.\n<\/p><\/blockquote>\n<blockquote><p>               \uf0a7 Number of times he\/she was hospitalized with the<br \/>\n                    health problems, name of the hospital along with<br \/>\n                    doctor who attended to him\/her.\n<\/p><\/blockquote>\n<blockquote><p>               \uf0a7 Number of days spent in the hospital; bifurcate the<br \/>\n                    details department or ward wise. (that is ICU, other).<br \/>\n               \uf0a7 Doctor&#8217;s observation.\n<\/p><\/blockquote>\n<blockquote><p>               \uf0a7 Expenditure incurred by the government during the<br \/>\n                    treatment (President wise).<\/p><\/blockquote>\n<p>      Shri A.K. Srivastava also sought information separately for present<br \/>\nPresident Ms. Pratibha Devisingh Patil.\n<\/p>\n<p>      To this he received a response from CPIO, Shri Faiz Ahmad Kidwai<br \/>\ndated 3-3-09 refusing the information as follows:\n<\/p>\n<blockquote><p>      &#8220;It is to inform you that the desired information is personal<br \/>\n      information, the disclosure of which has no relationship to any<br \/>\n      public activity or interest and, therefore, is hereby rejected under<br \/>\n      section 8(1)(j) of the RTI Act, 2005.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                        1<\/span><\/p>\n<p>        Aggrieved Shri A.K. Srivastava moved an appeal before 1st Appellate<br \/>\nAuthority, President&#8217;s Secretariat placing the following direct question:\n<\/p>\n<blockquote><p>       &#8220;I will request the Appellate Authority to say where the desired<br \/>\n       information by the applicant can be denied to the Parliament or<br \/>\n       a State Legislature. If yes, then under what laws and sections.<br \/>\n       If not, then why it should not be provided to the applicant (As<br \/>\n       mentioned on the said Section, i.e. 8(1)(j).&#8221;<\/p><\/blockquote>\n<p>       He further agreed to curtail the information sought by stating that he<br \/>\nwould wish to have information only with regard to present President Ms.<br \/>\nPratibha Devisingh Patil. In response to this 1st Appellate Authority in her<br \/>\norder of 5-5-09 has held as follows:\n<\/p>\n<blockquote><p>       &#8220;In his appeal, the appellant has stated that since the medical<br \/>\n       expenditure is paid by the Government, the citizens have a right<br \/>\n       to know. On going through the case I find that the stand taken<br \/>\n       by the CPIO is in order. Apart from this, collection of this data<br \/>\n       would     also     derail   the     administrative    machinery<br \/>\n       disproportionately. The appeal stands dismissed.&#8221;<\/p><\/blockquote>\n<p>       The appeal was heard through video-conferencing on 12-8-2010. The<br \/>\nfollowing are present.\n<\/p>\n<p>       Respondents (at NIC Studio, President&#8217;s Sectt.)<br \/>\n       Ms. Rasika Chaube, Internal Financial Advisor<br \/>\n       Mr. Faiz Ahmad Kidwai, CPIO<\/p>\n<p>       Although informed of the date of hearing through our notice dated 29-7-<br \/>\n2010 appellant Shri A.K. Srivastava opted not to be present. Respondent<br \/>\nCPIO Shri. Faiz Ahmed Kidwai was asked specifically whether there was<br \/>\nconstitutional privilege enjoyed by the President with regard to disclosure of<br \/>\nmedical expenses in Parliament. Upon this Shri Kidwai submitted a letter<br \/>\nstating that as per Kaul &amp; Shakhder&#8217;s &#8216;Practice and Procedure of Parliament&#8217;,<br \/>\nno question relating to the Head of State is answered in the House<\/p>\n<p>                                 DECISION NOTICE<\/p>\n<p>       In this case other than the name of the President, which is already<br \/>\nknown to appellant, it is quite clear that the remaining four questions are<br \/>\nquestions to which an attempted answer would amount to invasion of the<br \/>\nPresident&#8217;s privacy.     Besides, in a judgment in WP(C) 228\/2009, CPO<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><br \/>\n Supreme Court of India vs. SC Agrawal &amp; Anr. the Delhi High Court has<br \/>\ndiscussed the concept of fiduciary relationship in some detail. A doctor&#8217;s<br \/>\nobservation with regard to a patient is a doctor\/patient relationship that lies at<br \/>\nthe heart of fiduciary and therefore, exempt u\/s 8 (1) (e) in addition to Section<br \/>\n8 (1) (j). The only question which could arguably allow for disclosure, given<br \/>\nthe fact that public money is involved, could be the final question on<br \/>\nexpenditure incurred by the government on treatment of the President. On<br \/>\nthis issue although the budgetary position could be provided, the physical or<br \/>\nmental health or condition of an individual would qualify as &#8216;sensitive personal<br \/>\ndata&#8217; even by the norms of UK&#8217;s Data Protection Act, 1998, Sec 2, any<br \/>\ndisclosure of which would hence be deemed invasion of privacy. In the<br \/>\npresent case, appellant Shri A.K. Srivastava has in fact asked not for the<br \/>\nbudgetary provision, but a question specific to the President. For this reason,<br \/>\nwe uphold the decision of CPI in refusing the information sought, which as<br \/>\nhas been clarified in the hearing cannot also be sought by Parliament<\/p>\n<p>       Reserved in the hearing to verify the constitutional provisions with<br \/>\nregard to disclosure of medical expenses, this decision notice is issued in<br \/>\nopen chamber on this thirteenth day of August 2010.
