SIRI JAGAN, J.\n                    ------------------------------\n                    W.P.(C) No.19750 OF 2010\n                    -------------------------------\n              Dated this the 24th day of JUNE, 2010\n\n\n                          J U D G M E N T\n<\/pre>\n<p>      The petitioner&#8217;s rice has been seized on allegations of<\/p>\n<p>violation of the Essential Commodities Act.               The petitioner<\/p>\n<p>submits that the allegation that the rice in question was intended<\/p>\n<p>for public distribution is not correct and the petitioner&#8217;s rice is<\/p>\n<p>branded rice supported by appropriate sale bills.          The petitioner<\/p>\n<p>relies on Ext.P3 sale bill in this respect. The petitioner, therefore,<\/p>\n<p>seeks the following reliefs:\n<\/p>\n<blockquote><p>         &#8220;i.    Issue a writ of Mandamus directing the 3rd<br \/>\n         Respondent\/or 1st Respondent to release the seized 63<br \/>\n         sacks of rice which are the branded articles viz. Adam<br \/>\n         Brand AB No.1 best quality rice, Andhra(APPLICANT)<br \/>\n         Gundur, Net weight 50KG, to the petitioner.<br \/>\n         ii.    Issue a writ of Mandamus directing the 1st<br \/>\n         REspondent, District Collector, Malappuram to consider<br \/>\n         Exhibit P4 petition without any further delay, by affording<br \/>\n         a reasonable opportunity of being heard to the Petitioner<br \/>\n         or his authorised representative&#8221;<\/p><\/blockquote>\n<p>      2.    I am afraid that I cannot consider these matters in this<\/p>\n<p>writ petition, in so far as the same requires appreciation of<\/p>\n<p>evidence.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.19750\/10                2<\/span><\/p>\n<p>     In the above circumstances, this writ petition is disposed<\/p>\n<p>of with a direction to the first respondent to pass final orders<\/p>\n<p>pursuant to the seizure of the petitioner&#8217;s rice as expeditiously<\/p>\n<p>as possible, at any rate, within a period of one month from the<\/p>\n<p>date of receipt of a copy of this judgment. Needless to say,<\/p>\n<p>the petitioner shall be afforded an opportunity of being heard<\/p>\n<p>before passing final orders.\n<\/p>\n<\/p>\n<p>                                  S.
