No.29828 of 2010\n       RANJAN KUMAR SINGH @ RANJAN KUMAR @ CHUNNA SINGH\n                             Versus\n                         STATE OF BIHAR\n                          -----------\n<\/pre>\n<p>3   07.10.2010         Heard learned counsel appearing on behalf<\/p>\n<p>                 of    the   petitioner        and      the    learned     counsel<\/p>\n<p>                 appearing on behalf of the State.<\/p>\n<p>                       Petitioner       is    in     custody     in    connection<\/p>\n<p>                 with Bikram P.S. Case No.217 of 2009 for the<\/p>\n<p>                 offence punishable under Sections 304B, 201,<\/p>\n<p>                 341, 241, 323\/34 of the Indian Penal Code.<\/p>\n<p>                         The   petitioner          is    the   husband     of   the<\/p>\n<p>                 deceased.\n<\/p>\n<p>                         Learned        counsel         for    the     petitioner<\/p>\n<p>                 submits that during the course of investigation<\/p>\n<p>                 the    evidence       of     some      of     the    independent<\/p>\n<p>                 witnesses     shows        that     even      on     an   earlier<\/p>\n<p>                 occasion the deceased had tried to set herself<\/p>\n<p>                 on    fire.       He        further      submits      that     the<\/p>\n<p>                 institution of the case is an after thought<\/p>\n<p>                 inasmuch as the informant after receiving the<\/p>\n<p>                 ornaments of the deceased and having taken the<\/p>\n<p>                 custody of the son, has chosen to institute the<\/p>\n<p>                 present case.      He further submits that although<\/p>\n<p>                 the son of the deceased is in custody of the<\/p>\n<p>                 maternal      grand        father       but    it     has      been<br \/>\n<span class=\"hidden_text\">                    -2-<\/span><\/p>\n<p>incorrectly      stated      in   the     F.I.R.        that    the<\/p>\n<p>petitioner and his family members have cause<\/p>\n<p>the disappearance of the son.\n<\/p>\n<p>         Learned      counsel       for       the     petitioner<\/p>\n<p>further submits that at no place in the F.I.R<\/p>\n<p>the    informant    alleges       any    dowry       demands.    He<\/p>\n<p>thus submits that it is only by reason of the<\/p>\n<p>petitioner      being     husband       that     he     has    been<\/p>\n<p>involved in the present case and the petitioner<\/p>\n<p>on his own surrendered on 16.1.2010.<\/p>\n<p>       Taking         into          consideration               the<\/p>\n<p>circumstances and considering the submissions<\/p>\n<p>of    the   learned      counsel,       let    the    petitioner<\/p>\n<p>namely, Ranjan Kumar Singh @ Ranjan Kumar @<\/p>\n<p>Chunna Singh be released on bail on furnishing<\/p>\n<p>bail bonds of Rs.10,000\/- (ten thousand) with<\/p>\n<p>two sureties of the like amount each to the<\/p>\n<p>satisfaction of the Additional Chief Judicial<\/p>\n<p>Magistrate, Danapur in connection with Bikram<\/p>\n<p>P.S.    Case    No.217       of   2009        subject    to     the<\/p>\n<p>following conditions:\n<\/p>\n<blockquote><p>       (a) that the petitioner would accept the<\/p>\n<p>            police       papers     without         causing     any<\/p>\n<p>            unnecessary       delay      and    co-operate       in<\/p>\n<p>            the trial.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                    -3-<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>          (b) The petitioner would present himself<\/p>\n<p>              on each and every date fixed in the<\/p>\n<p>              case before the Court below and the<\/p>\n<p>              failure on the part of the petitioner<\/p>\n<p>              to   attend   the   Court    below    on   two<\/p>\n<p>              consecutive     dates       fixed     without<\/p>\n<p>              reasonable      explanation          to    the<\/p>\n<p>              satisfaction of the Court below would<\/p>\n<p>              confer liberty on the Court concerned<\/p>\n<p>              to     initiate         proceeding         for<\/p>\n<p>              cancellation of his bail bond and to<\/p>\n<p>              take him into custody.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<pre>Bibhash                               (Jyoti Saran, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ranjan Kumar Singh @ Ranjan Kumar vs State Of Bihar on 7 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
