                            Counter Affidavit and Supplementary Counter<\/p>\n
                    Affidavit has been filed on behalf of the State.<\/p>\n
                            Petitioner   was    appointed      as    Assistant<\/p>\n
                    Teacher, Primary School, Tara Nagar, Sikariya, Anchal<\/p>\n
                    – Bihta, District – Patna on 30.05.1962 and retired on<\/p>\n
                    28.02.1997. Petitioner has filed this application for a<\/p>\n
                    direction on the respondents to allow him B.A. trained<\/p>\n
                    scale as well as the scale of Headmaster, since junior<\/p>\n
                    to him has been allowed benefit of B.A. Trained Scale,<\/p>\n
                    as well as Headmaster’s pay-scale.\n<\/p>\n
                            Petitioner’s case is that he was graduate at<\/p>\n
                    the time of his appointment and he was allowed B.A.<\/p>\n
                    Scale. First time-bound-promotion was allowed vide<\/p>\n
                    Order   dated   24.11.1990.    In   the   year   1988,   a
\n                     2<\/span><\/p>\n
gradation list of Teachers had been prepared for<\/p>\n
granting graduate trained pay-scale to the Teachers,<\/p>\n
in which his name was at serial no. 39. One<\/p>\n
Dineshwar Singh, who had joined service in the year<\/p>\n
1988, much after the petitioner’s joining, as Assistant<\/p>\n
Teacher, was allowed B.A. Trained Scale, as well as<\/p>\n
Headmaster’s scale, but till date of his superannuation<\/p>\n
petitioner    was       not    allowed,     there     promotional<\/p>\n
benefits.\n<\/p>\n
         In the Counter Affidavit filed on behalf of the<\/p>\n
State, it has been admitted that in the year 1995,<\/p>\n
gradation list have been prepared in terms of 1993<\/p>\n
Promotion Rules. In the said gradation list, in the Arts<\/p>\n
Category, petitioner’s name was recorded at serial no.<\/p>\n
52. The promotion was to be given in the Graduate<\/p>\n
Trained Scale, considering the vacancies in the Arts<\/p>\n
Category.     Persons     up    to     38   serial   were   given<\/p>\n
promotion. The 1993 Promotion Rules was challenged<\/p>\n
in L. P. A. No. 985 of 1996 \/ 1137 of 1996 and on<\/p>\n
account of stay order no further action was taken.<\/p>\n
During      the   pendency        of    the    LPA,     petitioner<\/p>\n
superannuated. The LPA has been disposed of on<\/p>\n
21.04.2009. In terms of the direction in the LPA, the<\/p>\n
Directorate has issued letter no. 4, dated 04.01.2010.
\n                         3<\/span><\/p>\n
      The decision taken by the Director is that no<\/p>\n
      promotion can be granted with retrospective effect.<\/p>\n
      Since, the petitioner has superannuated as such he is<\/p>\n
      not entitled for any promotion with retrospective<\/p>\n
      effect.\n<\/p>\n
                In the Supplementary Counter Affidavit, it has<\/p>\n
      been stated, due to non-availability of connected<\/p>\n
      records, the matter relating to promotion given to<\/p>\n
      Dineshwar Singh can not be verified. However, it is<\/p>\n
      admitted that the then District Superintendent of<\/p>\n
      Education, Patna had given several illegal promotions,<\/p>\n
      which were subsequently cancelled.\n<\/p>\n
                Considering the fact that the matter is very<\/p>\n
      old, this application is being disposed of, giving liberty<\/p>\n
      to the petitioner for filing his representation before<\/p>\n
      the District Superintendent of Education, Patna now<\/p>\n
      DEO, Patna, giving full details of his of his claim. In<\/p>\n
      case petitioner is found to be entitled for BA Trained<\/p>\n
      Scale, the respondent will pass necessary order in this<\/p>\n
      regard and will allow the petitioner, benefits of B.A.<\/p>\n
      Trained Scale. In case of his entitlement, necessary<\/p>\n
      orders must be passed within eight weeks from the<\/p>\n
      date of filing of the representation by the petitioner.<\/p>\n
