Maheshwari for\nMr. Sunil Mehta, for the complainant.\n                                ...\n\nBY THE COURT:<\/pre>\n<p>      The petitioner Gulla Ram @ Gulab Singh, having been<\/p>\n<p>challaned for the offences under Sections 147, 148, 149, 341,<\/p>\n<p>323, 324, 307 and 302 IPC along with co-accused persons, earlier<\/p>\n<p>moved a bail application bearing No. 2733\/2009 to this Court but<\/p>\n<p>on 19.05.2009, withdrew with liberty to move afresh at appropriate<\/p>\n<p>stage; and the said bail application was dismissed with the<\/p>\n<p>following order:-\n<\/p>\n<blockquote><p>             &#8220;Learned counsel for the petitioner submits<br \/>\n      that the petitioner shall stand advised not to proceed<br \/>\n      with this bail application at this stage but to move for<br \/>\n      bail at appropriate stage particularly after complete<br \/>\n      reports are filed, more particularly in relation to the<br \/>\n      co-accused Shanker Dan; and, therefore, seeks<br \/>\n      permission to withdraw with liberty to move afresh at<br \/>\n      appropriate stage. Permission granted.\n<\/p><\/blockquote>\n<blockquote><p>             Having regard to the circumstances, the bail<br \/>\n      application filed by the petitioner Gula Ram alias<br \/>\n      Gulab Singh under Section 439 Cr.P.C. is dismissed<br \/>\n      as withdrawn with liberty as prayed.&#8221;<\/p><\/blockquote>\n<p>      It was noticed at the stage of consideration of the said first<\/p>\n<p>bail application that though challan had been filed against the<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>petitoner Gulla Ram with the co-accused Kalu Ram @ Nanda<\/p>\n<p>Ram son of Shankar Ram Jat and Chhotu Ram son of Gena Ram<\/p>\n<p>and was being separately filed against three juveniles; but further<\/p>\n<p>investigation was kept pending under Section 173 (8) Cr.P.C. in<\/p>\n<p>relation to the other accused persons Bhanwar Lal son of Bhagu<\/p>\n<p>Ram, Bhura Ram son of Shanker Ram, Rakesh son of Chhotu<\/p>\n<p>Ram, Bhika Ram son of Gaina Ram and Shanker Ram son of<\/p>\n<p>Pancha Ram.\n<\/p>\n<p>      On   26.05.2009,     however,    the   Investigating   Agency<\/p>\n<p>submitted its final report to the effect that the aforesaid remaining<\/p>\n<p>accused persons were not involved in the crime; and thereafter,<\/p>\n<p>the petitioner moved a fresh bail application to the learned<\/p>\n<p>Sessions Judge that was rejected on 20.06.2009. Hence, this<\/p>\n<p>second bail application.\n<\/p>\n<p>      The relevant back ground aspects of the matter are that the<\/p>\n<p>petitioner has been challaned for the offences aforesaid after<\/p>\n<p>investigation in FIR No. 217\/2008, Police Station Degana, District<\/p>\n<p>Nagaur that was lodged on 04.12.2008 at about 11.10 a.m. by<\/p>\n<p>Budha Ram son of Manga Ram Jat with the submissions that his<\/p>\n<p>son Misa Ram, one Moti Ram son of Chimna Ram, and another<\/p>\n<p>Hema Ram son of Chimna Ram, while returning to their houses at<\/p>\n<p>about 09.00 a.m. after casting their votes, were assaulted by<\/p>\n<p>Shanker Ram son of Pancha Ram, Bhanwar Lal, Gulla Ram son<\/p>\n<p>of Bhagu Ram (the present petitioner) and a few other named<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>persons with sharp weapons, cricket bat, pistols etc. According to<\/p>\n<p>the complainant, the petitioner Gulla Ram hit Misa Ram and Moti<\/p>\n<p>Ram on their head with a cricket bat causing them grievous<\/p>\n<p>injuries and the assailants caused injuries to other persons too.<\/p>\n<p>According to the complainant, the cause of dispute had been the<\/p>\n<p>intention of the accused persons to indulge into bogus voting.<\/p>\n<p>      After lodging of the aforesaid FIR, the injured Moti Ram son<\/p>\n<p>of Chimna Ram expired, while undergoing treatment at MDM<\/p>\n<p>Hospital, Jodhpur, on 06.12.2008. After investigation, the police<\/p>\n<p>found six persons, including the present petitioner, involved in the<\/p>\n<p>commission of crime but kept further        investigation pending in<\/p>\n<p>relation to some of the accused as referred hereinabove; and, as<\/p>\n<p>noticed, such other accused were not found involved in the crime<\/p>\n<p>as per the final report dated 26.05.2009.\n<\/p>\n<p>      While seeking bail for the petitioner Gulla Ram, the learned<\/p>\n<p>counsel submitted that as per the prosecution story, the deceased<\/p>\n<p>Moti Ram had been assaulted by several persons including the<\/p>\n<p>petitioner with blunt and sharp weapons but then, as disclosed by<\/p>\n<p>the initial Injury Report dated 04.12.2008, there was one incised<\/p>\n<p>injury on the head of the deceased that was, in the opinion of the<\/p>\n<p>Medical Officer, caused by a sharp weapon; and apart from this<\/p>\n<p>injury, he had a bruise on the nose. However, learned counsel<\/p>\n<p>pointed out, both these injuries were found to be simple in nature<\/p>\n<p>on the X-ray examination dated 04.12.2008. The learned counsel<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>further pointed out that Moti Ram expired on 06.12.2008 and the<\/p>\n<p>postmortem report though states head injury to be the cause of<\/p>\n<p>death but shows that he had one stitched surgical wound of<\/p>\n<p>craniotomy and the other one had been a stitched wound on the<\/p>\n<p>parietal region. Learned counsel then referred to some of the<\/p>\n<p>statements of the prosecution witnesses to the effect that the<\/p>\n<p>petitioner inflicted injury on the head of the deceased with a<\/p>\n<p>cricket bat whereas Shanker Ram gave him a blow from an axe.<\/p>\n<p>With reference to such material on record, the main plank of the<\/p>\n<p>submissions of the learned counsel for the petitioner has been<\/p>\n<p>that the solitary injury on the head of the deceased as on<\/p>\n<p>04.12.2008 was the one caused by the sharp weapon and as per<\/p>\n<p>the postmortem report too, the deceased was having stitched<\/p>\n<p>wounds and such wounds are not referable to a blunt weapon;<\/p>\n<p>and, having been assigned a blunt object, a cricket bat, the<\/p>\n<p>petitioner cannot be said to be the author of the fatal injury. The<\/p>\n<p>learned counsel submitted that the deceased had an incised<\/p>\n<p>wound from a sharp object and significantly, the person assigned<\/p>\n<p>the sharp weapon, Shanker Ram, has not been found involved in<\/p>\n<p>the incident at all. In these circumstances, according to the<\/p>\n<p>learned counsel, the credibility of the prosecution story is shaken<\/p>\n<p>at its roots and in any case, implication of the petitioner is<\/p>\n<p>shrouded in serious doubts with no likelihood of his being<\/p>\n<p>convicted for   the offence alleged.     In these circumstances,<br \/>\n<span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>learned counsel streneously contended, the petitioner deserves to<\/p>\n<p>be enlarged on bail.\n<\/p>\n<p>      The matter being considered on the application under<\/p>\n<p>Section 439 Cr.P.C., this Court would not like to make any<\/p>\n<p>comment that might have bearing on the merits of the case but<\/p>\n<p>then, contrary to what has been argued by the learned counsel for<\/p>\n<p>the petitioner, at this stage of the proceedings, exoneration of<\/p>\n<p>Shanker Ram by the Investigating Agency cannot be taken as a<\/p>\n<p>circumstance favourable or advantageous to the petitioner; this<\/p>\n<p>state of record operates, rather, against the petitioner. In the<\/p>\n<p>evidence as collected by the Investigating Agency, the witnesses<\/p>\n<p>are more or less ad idem that the petitioner Gulla Ram was<\/p>\n<p>carrying a cricket bat wherefrom did he inflict the blow on the<\/p>\n<p>head of the deceased Moti Ram; who died as a result of head<\/p>\n<p>injury. In this state of record, if the other person, Shanker Ram,<\/p>\n<p>who was alleged to have given another blow on the head of the<\/p>\n<p>deceased with a sharp weapon has not been found involved in the<\/p>\n<p>crime, the entire accusation for the fatal injury gets diverted<\/p>\n<p>towards the petitioner. When the evidence has categorically been<\/p>\n<p>collected by the police to the effect that the petitioner authored the<\/p>\n<p>injury on the head of the deceased, merely because the other<\/p>\n<p>accused Shanker Ram, said to be the person inflicting another<\/p>\n<p>injury with sharp weapon, was not found involved, in the opinion<\/p>\n<p>of this Court, cannot be taken as a circumstance at this stage<br \/>\n<span class=\"hidden_text\">                                           6<\/span><\/p>\n<p>        whereby the entire prosecution story could be branded false.<\/p>\n<p>              The    submissions     about    some     inconsistencies   and<\/p>\n<p>        incongruities in the medical reports do not make out a case of<\/p>\n<p>        grant of bail at this stage. This much is clear from the reports of<\/p>\n<p>        the MDM Hospital as drawn on the date of incident, i.e.,<\/p>\n<p>        04.12.2008, that the victim Moti Ram had received serious head<\/p>\n<p>        injuries particularly on the left temporal and parietal regions with<\/p>\n<p>        fracture of temporal bone. The value, worth, and implication of<\/p>\n<p>        the Injury Report as drawn by the Medical Officers at Degana<\/p>\n<p>        would, of course, be a matter for consideration of the learned Trial<\/p>\n<p>        Court with reference to the entire material on record but in a<\/p>\n<p>        comprehensive examination of all the medical reports pertaining<\/p>\n<p>        to the deceased and then, the comments as made in relation to<\/p>\n<p>        the cricket bat, said to have been used in the crime by the<\/p>\n<p>        petitioner in its recovery memo that its sides were hard and edge-<\/p>\n<p>        like (\u092c\u0932    \u0915   \u0938 \u0907\u0921 \u0915\u0920 \u0930 \u0927 \u0930\u0928\u092e         \u092c\u0928   \u0939\u0908 \u0939\u0964) and the other<\/p>\n<p>        evidence on record, this Court does not find it to be a fit case for<\/p>\n<p>        grant of bail to the petitioner Gulla Ram at this stage.<\/p>\n<p>              As result of the aforesaid, this second bail application under<\/p>\n<p>        Section 439 Cr.P.C. moved on behalf of the petitioner Gulla Ram<\/p>\n<p>        @ Gulab Singh son of Bhagu Ram Jat stands rejected.<\/p>\n<p>                                              (DINESH MAHESHWARI), J.\n<\/p>\n<p>\/\/Mohan\/\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Gulla Ram @ Gulab Singh vs State on 21 July, 2009 1 S.B.
