         The vehicle belonging to the petitioner bearing<\/p>\n
registration     No.KL-10\/U-1327,                was       seized   on<\/p>\n
04.12.2008.      Thereafter, proceedings were initiated<\/p>\n
under Section 17 of the Kerala Anti Social Activities<\/p>\n
(Prevention) Act, 2007, alleging that the vehicle was<\/p>\n
used for illicit transportation of river sand. Petitioner’s<\/p>\n
explanation was not accepted and Ext.P1 order was<\/p>\n
passed directing that the vehicle be released on interim<\/p>\n
custody subject to certain conditions.                   This has been<\/p>\n
challenged in this writ petition. Petitioner has mounted<\/p>\n
a challenge against the validity of Section 17 of the<\/p>\n
Kerala Anti Social Activities (Prevention) Act, 2007.<\/p>\n
         2. A Division Bench of this Court in Writ<\/p>\n
Petition  No.9925\/2009            and      connected       cases,  has<\/p>\n
declared that the vehicles cannot be seized for<\/p>\n
transportation of river sand relying on the vague<\/p>\n
provisions of Section 17 of the Act. In such cases, they<\/p>\n
have to be dealt with under Section 23 of the Kerala<\/p>\n

\n                          :: 2 ::\n<\/p>\n
\nProtection of River Banks and Regulation of Removal of<\/p>\n
Sand Act, 2001. The Division Bench has issued        the<\/p>\n
following directions.\n<\/p>\n
           “The confiscation order, if any, passed<\/p>\n
     in any of the cases will stand quashed. In<\/p>\n
     all cases, irrespective of whether there was<\/p>\n
     a confiscation order or not, the District<\/p>\n
     Collector shall decide whether proceedings<\/p>\n
     under the Kerala Protection of River Banks<\/p>\n
     and Regulation of Removal of Sand Act and<\/p>\n
     the Rules thereunder should be initiated<\/p>\n
     against the vehicle concerned, within one<\/p>\n
     month from the date of receipt\/production<\/p>\n
     of a copy of this judgment. If proceedings<\/p>\n
     are initiated, the same shall be finalised<\/p>\n
     within one month. If the petitioners desire<\/p>\n
     release of their vehicles, which are not so<\/p>\n
     far released, pending final decision, the<\/p>\n
     same shall be released to them forthwith by<\/p>\n
     the District Collector, subject to the<\/p>\n
     conditions imposed by this Court for<\/p>\n
     releasing the vehicle in W.P.(C).9925 of<\/p>\n
     2009.<\/p><\/blockquote>\n
         3.     Accordingly, Ext.P1 shall stand set aside<\/p>\n
and the writ petition is disposed of in the following<\/p>\n
terms.\n<\/p>\n

\n                            :: 3 ::\n<\/p>\n<\/p>\n
      (i).   Petitioner shall deposit an amount of<\/p>\n
             Rs.25,000\/-, with the District Collector<\/p>\n
             and there upon, the vehicle in question<\/p>\n
             bearing    registration  No.KL-10\/U-1327<\/p>\n
             shall  be   forthwith   released   to   the<\/p>\n
             petitioner.\n<\/p>\n
      (ii). But such release of the vehicle shall not<\/p>\n
             prevent the District Collector or the<\/p>\n
             Revenue Officials taking proceedings<\/p>\n
             against the vehicle under the provisions<\/p>\n
             of Section 23 of the Kerala Protection of<\/p>\n
             River Banks and Regulation of Removal<\/p>\n
             of Sand Act, 2001. District Collector<\/p>\n
             shall, within one month from the date of<\/p>\n
             receipt of a copy of this judgment, take a<\/p>\n
             decision whether proceedings will have to<\/p>\n
             be initiated, in the instant case, in<\/p>\n
             relation    to    the    vehicle   bearing<\/p>\n
             registration   No.KL-10\/U-1327,      under<\/p>\n
             Section 23 of the Act.\n<\/p>\n
      (iii). Such proceedings, if initiated, shall be<\/p>\n
             done within one month from the date on<\/p>\n
             which the vehicle is released and if it is<\/p>\n
             not so initiated within one month, then, it<\/p>\n
             will not be open to the respondents to<\/p>\n
             thereafter initiate proceedings under the<\/p>\n
             Act, in relation to the seizure effected on<\/p>\n
             04.12.2008.\n<\/p>\n
      (iv). Vehicle, if released on interim custody,<\/p>\n
             shall not be used for transportation of<\/p>\n
             sand for a period of one month. If within<\/p>\n
             the aforementioned period of one month<\/p>\n
             from the date on which the vehicle is<\/p>\n

\n                            :: 4 ::\n<\/p>\n
\n            released, proceedings under the Act are<\/p>\n
            not initiated as permitted herein above,<\/p>\n
            then it will be open to the petitioner to<\/p>\n
            use it in accordance with law.<\/p>\n
      (v). If such proceedings are not initiated,<\/p>\n
            Rs.25,000\/- deposited by the petitioner<\/p>\n
            shall be refunded to him. Initiation of<\/p>\n
            proceedings under the Act,        shall be<\/p>\n
            done by the issuance of a notice from the<\/p>\n
            office of the District Collector.<\/p>\n
      (vi). Vehicle    shall   not  be   alienated  or<\/p>\n
            encumbered for a period of one month<\/p>\n
            from the date of release of the vehicle on<\/p>\n
            interim custody as permitted and such<\/p>\n
            condition shall continue to operate till<\/p>\n
            the proceedings initiated by the District<\/p>\n
            Collector   are    disposed   of, if  such<\/p>\n
            proceedings are initiated within the time<\/p>\n
            frame mentioned above.\n<\/p>\n<\/p>\n
