No.2042.11\n\n\n\n            Writ Petition No. 2042 of 2011\n07\/02\/2011<\/pre>\n<p>        Shri Kamal Singh Rajput, learned counsel<br \/>\nfor the petitioners.\n<\/p>\n<p>        Heard on admission.\n<\/p>\n<p>        This plaintiffs&#8217; writ petition under Article<br \/>\n227 of the Constitution of India is directed<br \/>\nagainst the order dated 25-11-2010 passed by<br \/>\nSecond Civil Judge Class-II, Harda, in Civil Suit<br \/>\nNo. 48-A\/2010; whereby, an application under<br \/>\nOrder 6 Rule 17 of the Code of Civil Procedure,<br \/>\n1908       filed     by    the      petitioners    seeking<br \/>\namendment in the plaint has been rejected.\n<\/p>\n<p>        The suit is for declaration and permanent<br \/>\ninjunction in respect of land bearing khasra No.<br \/>\n134\/1, area 44.312 hectares, situated in villae<br \/>\nBichhapur          Halka    No.     11\/17.    During       the<br \/>\npendency of said suit and at the stage when the<br \/>\npetitioners        have    succeeded     in   avoiding        to<br \/>\nrecord evidence on commission for almost one<br \/>\nyear, an application under Order 6 Rule 17 of<br \/>\nthe Code of Civil Procedure was filed seeking<br \/>\nleave of the Court to amend the plaint by<br \/>\nincorporating the facts of pre-trial stage. The<br \/>\ntrial    Court     rejected   the    application   by      the<br \/>\n                                                     W.P. No.2042.11<\/p>\n<p>impugned order on the ground of delay and that<br \/>\nthere   was   no    plausible       explanation     by      the<br \/>\npetitioners as to what prevented them from not<br \/>\nincorporating those facts which were well with<br \/>\nthe knowledge of the petitioners.\n<\/p>\n<p>      It is this order which is being questioned<br \/>\nin this petition.\n<\/p>\n<p>      The question is whether the trial Court was<br \/>\nwithin its jurisdiction and justified in rejecting<br \/>\nthe   application    preferred       by    the   petitioners<br \/>\nseeking amendment in the plaint.\n<\/p>\n<p>      Order   6    Rule   17   of    the   Code    of    Civil<br \/>\nProcedure provides for :-\n<\/p>\n<blockquote><p>      &#8221; 17. Amendment of pleadings.-<br \/>\n         The Court may at any stage of<br \/>\n         the  proceedings   allow  either<br \/>\n         party o alter or amend his<br \/>\n         pleadings in such manner and on<br \/>\n         such terms as may be just, and<br \/>\n         all such amendments shall be<br \/>\n         made as may be necessary for the<br \/>\n         purpose of determining the real<br \/>\n         question in controversy between<br \/>\n         the parties.\n<\/p><\/blockquote>\n<blockquote><p>         Provided that no application for<br \/>\n         amendment shall be allowed after<br \/>\n         the trial has commenced, unless<br \/>\n         the    Court   conies   to   the<br \/>\n         conclusion that in spite of due<br \/>\n         diligence, the party could not<br \/>\n                                                         W.P. No.2042.11<\/p>\n<p>             have raised the matter before the<br \/>\n             commencement of trial. &#8220;<\/p><\/blockquote>\n<p>       The         aforesaid     provision        and         more<br \/>\nparticularly          the      proviso    came          up       for<br \/>\nconsideration before the Supreme Court in the<br \/>\ncase of Vidya Bai and others V. Padmalatha and<br \/>\nanother: (2009) 2 SCC 409. In paragraph 10<br \/>\nwherein, it is observed that,                  the proviso to<br \/>\nRule 17 is         couched     in a mandatory form. The<br \/>\nCourt&#8217;s        jurisdiction         to    allow     such          an<br \/>\napplication is taken away unless the conditions<br \/>\nprecedent therefore are satisfied viz.,it must<br \/>\ncome      to   a    conclusion     that   in    spite    of    due<br \/>\ndiligence the parties could not have raised the<br \/>\nmatter before the commencement of the trial&#8221;.<br \/>\nIt is further held in paragraph 19 that &#8221; It is<br \/>\nthe primal duty of the Court to decide as to<br \/>\nwhether such an amendment is necessary to<br \/>\ndecide the real dispute between the parties.<br \/>\nOnly    if     such    a    condition     is    fulfilled,      the<br \/>\namendment is to be allowed. However, proviso<br \/>\nappended to Order 6 Rule 17 of the Code<br \/>\nrestricts the power of the Court. It puts                         an<br \/>\nembargo on exercise               of its jurisdiction. The<br \/>\ncourt&#8217;s      jurisdiction in a case of this nature                 is<br \/>\n                                                        W.P. No.2042.11<\/p>\n<p>limited. Thus, unless the jurisdictional facts, as<br \/>\nenvisaged therein, is found to be existing, the<br \/>\nCourt will have no jurisdiction at all to allow<br \/>\nthe amendment of the plaint&#8221;.\n<\/p>\n<p>      In the case at hand the petitioners have<br \/>\nfailed   to    demonstrate          that    despite    of      due<br \/>\ndiligence the facts they proposed to incorporate<br \/>\nby way of amendment, were not within their<br \/>\nknowledge when the suit was filed or even<br \/>\nwhen the issues were framed and an order was<br \/>\npassed        for     examining         the      witness         on<br \/>\ncommission.\n<\/p>\n<p>      In view whereof the trial Court in our<br \/>\nconsidered opinion was well within its right in<br \/>\nrejecting      the    application       preferred      by      the<br \/>\npetitioners seeking amendment in the plaint.\n<\/p>\n<p>      Furthermore,            since        the    scope           of<br \/>\ninterference in writ jurisdiction under Article<br \/>\n227 of the Constitution of India is confined to<br \/>\nthe   extent        that   subordinate        courts    remain<br \/>\nwithin   their       bounds    of     authority    (please see<br \/>\n<a href=\"\/doc\/1740954\/\">Waryam Singh V. Amarnath<\/a>: AIR 1954 SC 215 &amp;<br \/>\n<a href=\"\/doc\/1668065\/\">Shalini Shyam Shetty And Another V. Rajendera<br \/>\nShankar Patil<\/a> : (2010) 8 SCC 329); and in the instant<br \/>\ncase since the trial Court was within its jurisdiction in<br \/>\n                                             W.P. No.2042.11<\/p>\n<p>rejecting the application as the same being not in<br \/>\nconsonance with the provisions of Order 6 Rule 17 of<br \/>\nthe CPC, we are not inclined to interfere with the<br \/>\nimpugned order.\n<\/p>\n<p>      In the result petition fails and is hereby<br \/>\ndismissed.
