SHAH\n\t\t\n\t\n\n \n\nDate\n: 17\/09\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\npetitioner has prayed for an appropriate writ, direction or order<br \/>\nquashing and setting aside the impugned judgment and award dated<br \/>\n04.12.2009 passed by the Presiding Officer, Labour Court No.3, Rajkot<br \/>\nin Reference (LCR) No.112\/2007, by which the Labour Court has partly<br \/>\nallowed the said reference by quashing and setting aside the order<br \/>\npassed by the petitioner dated 27.11.2003 in superannuating the<br \/>\nrespondent with retrospective date i.e. 31.01.2000 and further<br \/>\ndirecting the petitioner to reinstate the respondent to his original<br \/>\npost with 40% back wages only.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate appearing on behalf of the petitioner has vehemently<br \/>\nsubmitted that as the order superannuating the respondent was passed<br \/>\non 27.11.2003 and the dispute was raised after the period of four<br \/>\nyears, the Labour Court ought not to have passed the order of<br \/>\nreinstatement.  It is further submitted that even the respondent was<br \/>\naware about his date of birth mentioned as 24.01.1942 in the service<br \/>\nbook, still no objection was raised by him.  Therefore, it is<br \/>\nrequested to allow the present petition.\n<\/p>\n<p>3.\tHaving<br \/>\nheard learned advocates appearing on behalf of the petitioner and<br \/>\nconsidering the impugned judgment and award passed by the Labour<br \/>\nCourt, it appears that no illegality has been committed by the Labour<br \/>\nCourt in partly allowing the said reference and quashing and setting<br \/>\naside the action of the petitioner in superannuating the respondent<br \/>\nvide order dated 27.11.2003 with retrospective dated i.e. 31.01.2000.<br \/>\n On appreciation of evidence, it has been specifically found that<br \/>\ndate of birth of the respondent was 05.06.1952 and while<br \/>\nsuperannuating the respondent, petitioner considered the service book<br \/>\nof some other employee and the particulars of the birth date of one<br \/>\nanother employee and thereby the learned Labour Court on appreciation<br \/>\nof evidence found that considering his oral date of birth dated<br \/>\n05.06.1952, he would be retiring on 05.06.2010 and therefore, no<br \/>\nillegality has been committed by the Labour Court in quashing and<br \/>\nsetting aside action of the petitioner dated 27.11.2003<br \/>\nsuperannuating the respondent with retrospective dated i.e.<br \/>\n31.01.2000.\n<\/p>\n<p>\tIt<br \/>\nis also required to be noted that as such respondent was already<br \/>\ndismissed from service on misconduct for which industrial dispute was<br \/>\nraised being Reference (LCR) No.136\/2000 and by judgment and award<br \/>\ndated 15.05.2002, the Labour Court, Rajkot set aside the action of<br \/>\ntermination of the respondent and the Labour Court directed the<br \/>\npetitioner to reinstate the respondent workman in service with<br \/>\ncontinuity of service with 50% back wages for the intervening period.<br \/>\n It appears that the said judgment and award passed by the Labour<br \/>\nCourt, Rajkot was challenged by the petitioner before this Court by<br \/>\nway of Special Civil Application No.10787\/2002 and by judgment and<br \/>\norder dated 08.04.2003, the learned Single Judge remanded the matter<br \/>\nto the Labour Court and it appears that on remand, Labour Court<br \/>\npassed a judgment and award dated 29.09.2003 directing the petitioner<br \/>\nto reinstate the respondent workman and only thereafter the<br \/>\npetitioner passed the order dated 27.11.2003 superannuate the<br \/>\nrespondent with retrospective dated i.e. 31.01.2000.  At no point of<br \/>\ntime earlier, either before this Court in Special Civil Application<br \/>\nNo.136\/2000, it was pointed out by the petitioner that he has<br \/>\nattained the age of superannuation in the year 2000.  As stated<br \/>\nabove, only after the aforesaid decision of remand by the Labour<br \/>\nCourt, when the petitioner was directed to reinstate the respondent,<br \/>\nthe aforesaid action was taken.  In any case, no illegality has been<br \/>\ncommitted by the Labour Court in passing the impugned judgment and<br \/>\naward.\n<\/p>\n<p>4.\tNow,<br \/>\nso far as contention on behalf of the petitioner that the dispute was<br \/>\nraised after four years and therefore, Labour Court ought not to have<br \/>\npassed the impugned judgment and award is concerned, it is to be<br \/>\nnoted that for delay in approaching the Labour Court and\/or delay in<br \/>\nraising the industrial dispute, respondent is already punished as the<br \/>\nLabour Court has denied 60% of the back wages and only awarded 40% of<br \/>\nthe back wages.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and for the reasons stated above, the present<br \/>\npetition deserves to be dismissed and is, accordingly, dismissed.\n<\/p>\n<p>(M.R.\n<\/p>\n<p>Shah, J.)<\/p>\n<p>*menon<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Managing vs Mangabhai on 17 September, 2010 Author: M.R.
