Justice V.GIRI\n\n Dated :30\/09\/2008\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                  W.P.(C).28315\/2008\n                     --------------------\n      Dated this the 30th day of September, 2008\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioners are prosecuting their B.Sc Nursing<\/p>\n<p>Course and are due to appear for the final year<\/p>\n<p>examination. Dissatisfied by the marks obtained by<\/p>\n<p>them in the third year supplementary examination for<\/p>\n<p>one paper in the case of petitioners 1, 2 and 3 and<\/p>\n<p>two papers in the case of the fourth petitioner, they<\/p>\n<p>sought for a revaluation as evidenced by Ext.P1<\/p>\n<p>series.   They have approached this Court for a<\/p>\n<p>direction to the respondents to publish the results of<\/p>\n<p>the revaluation and also to permit them to appear for<\/p>\n<p>the fourth year final year examination.<\/p>\n<p>2.    Learned Standing Counsel for the University<\/p>\n<p>Mr.M.Sasindran submits that the result of the<\/p>\n<p>revaluation will be published at the earliest, at any<\/p>\n<p>rate, within one month from today.         Submission is<\/p>\n<p>recorded. In so far as the prayer for permitting the<\/p>\n<p>petitioners to participate in the final year examination<\/p>\n<p>W.P.(C).28315\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>pending publication of the results of the revaluation, I<\/p>\n<p>am afraid that this position has been dealt with by the<\/p>\n<p>Division Bench in Writ Appeal Nos.1393\/2008 and<\/p>\n<p>1342\/2008 which has been followed by a learned Judge<\/p>\n<p>of this Court in Writ Petition No.15024\/2008. This Court<\/p>\n<p>has framed upon the practice of permission being<\/p>\n<p>granted to the final year student to participate in the<\/p>\n<p>examination, eligibility to which cannot be acquired by<\/p>\n<p>the candidates except by a pass in the examination for<\/p>\n<p>the previous year or semester as the case may be.<\/p>\n<p>3.
