JUSTICE SABINA\n\n\nPresent:   Mr.Amit Dhawan, Advocate,\n           for the petitioners.\n\n\n                 ****\n\n\nSABINA, J.\n<\/pre>\n<p>           Petitioners have filed this petition under Section 482 of<\/p>\n<p>the Code of Criminal Procedure for quashing of order dated<\/p>\n<p>17.1.2007 passed by Judicial Magistrate, Ist Class, Malerkotla<\/p>\n<p>(Annexure P-2) in the light of compromise\/affidavit (Annexure P-7).<\/p>\n<p>           Learned counsel for the petitioners has submitted that the<\/p>\n<p>petitioners were declared proclaimed offenders vide impugned order<\/p>\n<p>dated 17.1.2007 by the Judicial Magistrate, Ist Class, Malerkotla in<\/p>\n<p>the FIR lodged by respondent No.2. Now the parties have arrived at<\/p>\n<p>a compromise with the intervention of the relatives and respectables<br \/>\n Criminal Misc. No.M- 7480 of 2009 (O&amp;M)                          -2-<\/p>\n<p>of the area. As per the compromise\/affidavit (Annexure P-7),<\/p>\n<p>respondent No.2 has decided to join the matrimonial home along with<\/p>\n<p>her husband-petitioner No.3 at Holland.<\/p>\n<p>           Notice of motion.\n<\/p>\n<p>           At the asking of Court, Ms.Ravinder Kaur Nihalsinghwala,<\/p>\n<p>Sr.DAG, Punjab accepts notice on behalf of respondent no.1,<\/p>\n<p>whereas, Mr.A.P.Kaushal Advocate accepts notice on behalf of<\/p>\n<p>respondent No.2.\n<\/p>\n<p>           Learned    counsel    for   respondent    No.2    has     filed<\/p>\n<p>reply\/affidavit on behalf of respondent No.2, who is also present in<\/p>\n<p>Court, wherein the factum of compromise effected between the<\/p>\n<p>parties vide Annexure P-7 is admitted. It is also mentioned in the<\/p>\n<p>reply\/affidavit of respondent No.2, that now she will reside with her<\/p>\n<p>husband and she has no objection in case the impugned order in<\/p>\n<p>question is ordered to be quashed.\n<\/p>\n<p>           Accordingly,   the   present   petition   is   allowed.
