 __C\u00a7Ourt Of Small Causes, Bangalore City dated 13.7.2005<\/p>\n
passed in MVC NO,5555\/2003.\n<\/p>\n
2. The appeilants\/claimants are the legal heirs Of<\/p>\n
one Es\/IaLha’DODb Kham 21 dfi’i7fi’1′ aged abaui 45 years.<\/p>\n
\u00a33\u00bb<\/p>\n
They eontended that en l6. lat;\n<\/p>\n
when the deceased was preeeedingdrivirigvlthe\u00b0lor1*y”g<\/p>\n
from Bangalore to Kolar,  ‘Tipper
\nlorry bearing Regn.No.’K_A   driver
\nin a rash and from opposite
\ndirection   driven by the
\ndeeeasedf  he sustained multiple
\ninjuries to the injuries while
\nshifting’ ” to  Hospital, Hoskote.<\/p>\n
Aecordingto the  deceased was getting salary<\/p>\n
 \/~– p,m: — per day as bata. The Tribunal<\/p>\n
. di\u00abshelieviiig”the same, assessed his income at ?3,000\/n<\/p>\n
  into consideration the number of<\/p>\n
dependerits’; deducted one~fourth of income towards his<\/p>\n
 personal expenses and by applying the multiplier of 13,<\/p>\n
“:l”_ass.e’ssed the loss of dependency at ?3,5l,OOO\/- (323250<\/p>\n
 12 X l3). In addition to that awarded a sum of<\/p>\n

place   salary payable to a driver of
\nthe lorryueohuld  been less than ?5,000\/~– pm.<\/p>\n
Therefore, we asvses\u00e9s the income of the deceased at<\/p>\n
‘d it ‘”?5;’GOO*\/4  month and $30,000\/~ per annum. Out of<\/p>\n
  the dependents of the deceased are four<\/p>\n
in  per Saraia Vermae case{20{}9 ACJ 1298},<\/p>\n
one–fo:1rth is deducted towards his personal expenses<\/p>\n
 loss of dependency is assessed at ?-45,000\/~<\/p>\n
  ppia. Censiderirrg the age of the deceased at 45 years as<\/p>\n
on the date of accident, We apply the appropriate
\nmuitipiier of E4 and determine the toss of dependency at
