Misra\n                                       ------\n2\/18.8.2009<\/pre>\n<p>          The petitioner is the defendant in a civil suit.\n<\/p>\n<p>                     In that suit, allegedly certain documents were filed by the<br \/>\n              defendant but were not proved and were therefore not exhibited.\n<\/p>\n<p>                     After closure of evidence of both sides, when the case was<br \/>\n              at the stage of final argument, the petitioner defendant moved an<br \/>\n              application for exhibiting all those documents and &#8216;marking&#8217; the<br \/>\n              documents as public documents. Whether a document is a public<br \/>\n              document or not depends upon the document and provision of the<br \/>\n              Evidence Act which defines &#8220;public document&#8221;. There is no<br \/>\n              procedure for &#8216;marking&#8217; a document as public document.\n<\/p>\n<p>                     It is obvious that unless a document has been proved or its<br \/>\n              formal proof is dispensed with, it cannot be exhibited.\n<\/p>\n<p>                     The plaintiff, therefore, contended that at this ripe and<br \/>\n              belated stage of arguments the defendant is adopting the tactics of<br \/>\n              seeking exhibiting of the documents for the purpose of leading a<br \/>\n              fresh round of evidence for proving his documents.\n<\/p>\n<p>                     The Trial Court agreed with the plaintiff.<br \/>\n                     In my opinion, this is not a fit case for interference in the<br \/>\n              extra ordinary jurisdiction of this Court at this inter-locutory stage,<br \/>\n              as entertaining this writ petition would require issuance of notice to<br \/>\n              other side and staying the proceeding in the suit.\n<\/p>\n<p>                     It is obvious that if any wrong decision is taken, every<br \/>\n              ground permissible in law will be available in the regular appeal<br \/>\n              from the decree of the Court.\n<\/p>\n<p>                     Therefore, I decline to entertain this writ petition and the<br \/>\n              same is accordingly dismissed.\n<\/p>\n<p>                                                                  (Sushil Harkauli, J.)<br \/>\nSudhir\/FA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Md.Mobin vs Bashir Ahmad &amp; Ors on 18 August, 2009 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.
