\nsubmitted that  the dispute can be
\nresolved and:’therefoiTe_vltliatlthel order may be set aside and
\nthe application\u00ab(l.A.VIi}V:Qrder XXVI Rule 9 of C P C may<\/p>\n
be allowed. _<\/p>\n
 3..\u00bbVli:~is  that after the evidence of the plaintiff was<\/p>\n
 r..pAoQmpleted,l’the application for appointment of Commissioner came to<\/p>\n
Tobe ‘ filed by the ‘petitioners \/ defendants.<\/p>\n
  __   burden is on the plaintiff to prove that he is the absolute<\/p>\n
 the suit schedule property. Under such circumstances,<\/p>\n

there was no good ground for the petitioners\/ defendants toll\ufb01le an<\/p>\n
application for appointment of a Commissioner. The Ilias<\/p>\n

of the trial. However, the trial Court canlconsider  .\u00a2;pp’1i\u00a2ation} if<\/p>\n
such an occasion is warranted. ‘I’i’1er”e_i’s. no i1legal’ity? ofginfinnity in<\/p>\n
the impugned order.\n<\/p>\n
