No.1882 of 2006\n              ----------------------------------------------------\n\n               Dated this the 16th day of October, 2006\n\n\n                               JUDGMENT\n<\/pre>\n<p>Abdul Gafoor,  J<\/p>\n<p>      The   education   agency   is   aggrieved   by<\/p>\n<p>the   judgment   of   the   learned   Single   Judge<\/p>\n<p>impugned   in   this   appeal.   The   judgment<\/p>\n<p>directs approval of the appointment of the<\/p>\n<p>writ   petitioner\/first   respondent.   She   has<\/p>\n<p>been appointed, according to the appellant<\/p>\n<p>by   the   erstwhile   Manager   whose   term   had<\/p>\n<p>expired   on   27.04.05.   As   is   revealed   by<\/p>\n<p>Annexure-A,   the   appointment   of   the   first<\/p>\n<p>respondent   was   effected   on   24.07.05.\n<\/p>\n<p>Therefore,   the   Manager   did   not   have   any<\/p>\n<p>right   to   make   effect   such   appointment   on<\/p>\n<p><span class=\"hidden_text\">W.A. No.1882 of 2006          -2-<\/span><\/p>\n<p>      such date. So such appointment ought not to<\/p>\n<p>      have been directed to be approved.\n<\/p>\n<p>             2.  In  answer  to  the  contention,  it is<\/p>\n<p>      submitted   by   the   Counsel   for   the   first<\/p>\n<p>      respondent   that   going   by   clause-6   of   the<\/p>\n<p>      bye-laws   by   which   the   education   agency   is<\/p>\n<p>      constituted   and   appointment   of   Manager   is<\/p>\n<p>      permitted,   though   the   term   of   Manager<\/p>\n<p>      appointed is for two years, he is entitled<\/p>\n<p>      to   continue   until   his   successor   is<\/p>\n<p>      appointed and approved. Therefore, there is<\/p>\n<p>      nothing   illegal   in   the   direction   of   the<\/p>\n<p>      learned Single Judge as, as on the date of<\/p>\n<p>      her   appointment,   no   successor   to   the<\/p>\n<p>      erstwhile Manager had been elected. He also<\/p>\n<p>      points out the impact of Rule 9(1) Chapter<\/p>\n<p><span class=\"hidden_text\">W.A. No.1882 of 2006           -3-<\/span><\/p>\n<p>      XIV A KER to the effect that the change in<\/p>\n<p>      Manager   shall   not   affect   the   appointment<\/p>\n<p>      order.\n<\/p>\n<p>             3.   It   is   true   that   Annexure-A   order<\/p>\n<p>      whereby   the   appointment   of   the   erstwhile<\/p>\n<p>      Manager   had   been   approved   contains   a<\/p>\n<p>      stipulation   that   his   appointment   was<\/p>\n<p>      approved   for   two   years   or   until   the<\/p>\n<p>      successor   is   appointed   whichever   is<\/p>\n<p>      earlier.   But   Clause-6   of   the   bye-laws<\/p>\n<p>      enables his continuance until the election<\/p>\n<p>      and approval of his successor.\n<\/p>\n<p>             4.   In   such   circumstances,   we   dispose<\/p>\n<p>      of the appeal directing the DEO to consider<\/p>\n<p>      the approval of appointment of the Teacher\/<\/p>\n<p>      first respondent as directed by the learned<\/p>\n<p><span class=\"hidden_text\">W.A. No.1882 of 2006            -4-<\/span><\/p>\n<p>      Single Judge taking into account Annexure-A<\/p>\n<p>      order   and   its   impact   with   reference   to<\/p>\n<p>      Clause 6 of the bye-laws and also Rule 9(1)<\/p>\n<p>      Chapter   XIV   A   KER.   Order   shall   be   passed<\/p>\n<p>      within   one   month   from   the   date   of   receipt<\/p>\n<p>      of a copy of this judgment.\n<\/p>\n<p>               5.
