SIRI JAGAN, J.\n                  ------------------------------------\n                       O.P.No.19441 OF 2002\n               ----------------------------------------\n                 Dated this the 31st day of March, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>     The petitioners are the President and Secretary of<\/p>\n<p>Kulathupuzha Service C-operative Bank Ltd. No.1867.                   A<\/p>\n<p>complaint    was    filed  before     the   Public   Men&#8217;s    Corruption<\/p>\n<p>(Investigation and Enquiries) Commission, in respect of certain<\/p>\n<p>allegations of financial impropriety by the petitioners. After that<\/p>\n<p>Commission was abolished, the complaint was made over to the<\/p>\n<p>Kerala Lok Ayukta.        The Kerala Lok Ayukta considered the<\/p>\n<p>application along with other complaints and passed Ext.P9 order.<\/p>\n<p>The findings in Ext.P9 order in relation to the complaint against<\/p>\n<p>the petitioners and the recommendations thereon are as follows:<\/p>\n<blockquote><p>               &#8220;Complaint No.28\/99.\n<\/p><\/blockquote>\n<blockquote><p>               This complaint is practically similar to Complaint<br \/>\n         No.27\/99, but is directed against the Secretary of the<br \/>\n         Bank Sri.M. Thajudeen. It is unnecessary to repeat the<br \/>\n         allegations except to state that the gravamen of charges<br \/>\n         was that the Secretary did not discharge his duty when<br \/>\n         he allowed the President to retain huge amounts with him<br \/>\n         for a continuously long period that he did not take steps<br \/>\n         to inform the Registrar that construction was being done<br \/>\n         without the sanction of the Registrar and that he did not<\/p>\n<p><span class=\"hidden_text\">O.P.No.19441\/02                      2<\/span><\/p>\n<p>         take the necessary steps to ensure that loan accounts<br \/>\n         were correctly maintained etc. It is also stressed that<br \/>\n         the charges of Printing of Calendars should not have<br \/>\n         been enhanced in favour of a particular company<br \/>\n         without calling for fresh quotations.         As these<br \/>\n         allegations  have   considered    while  disposing   off<br \/>\n         Complaint No.27\/99 it is not proposed to repeat the<br \/>\n         same. It is sufficient if it is held that the allegations<br \/>\n         are partly substantiated as already held in Complaint<br \/>\n         No.27\/99.\n<\/p><\/blockquote>\n<blockquote><p>         Recommendations<br \/>\n                After having considered the contentions of both<br \/>\n         parties with reference to the pleadings and the<br \/>\n         documentary evidence made allegations made by the<br \/>\n         petitioner are atleast partly substantiated therefore<br \/>\n         made the following recommendations under Section 12<br \/>\n         (3) of the Kerala Lok Ayukta Act.\n<\/p><\/blockquote>\n<blockquote><p>                The Principal Secretary to the Government, Co-<br \/>\n         operation,  will   conduct  a   comprehensive    enquiry<br \/>\n         through any independent authority including any officer<br \/>\n         not below the rank of an Additional Secretary to the<br \/>\n         Finance department, regarding the allegations made in<br \/>\n         complaints 27 and 28 of 1999 with special reference to<br \/>\n         the financial dealings of the Bank for the period 1.6.94<br \/>\n         and (a) the amounts retained by the President and<br \/>\n         Secretary and the duration of the retention of those<br \/>\n         amounts in their hands (b) the particulars of the<br \/>\n         amounts spent, together with the corresponding dates<br \/>\n         and the purposes for which they were utilised. (c) the<br \/>\n         legality and propriety of election expenses incurred in<br \/>\n         respect of the election of the President Sri. Abdul<br \/>\n         Gafoor being met by the bank (d) the legality of<br \/>\n         enhancing the price of calendars without notice to<br \/>\n         other bidders and without following the correct legal<br \/>\n         procedure and the loss caused thereby in the printing<br \/>\n         of the calendars of the year 1996 and (e) the grant of<br \/>\n         loans by the Board during the year when the 1st<br \/>\n         respondents were President and Secretaries till<br \/>\n         31.12.1994.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">O.P.No.19441\/02                       3<\/span><\/p>\n<blockquote><p>                The Principal Secretary will constitute the<br \/>\n          enquiry authority within three months from the date of<br \/>\n          receipt of this order and report the fact to this court<br \/>\n          under Section 12(3) of the Act&#8221;.\n<\/p><\/blockquote>\n<p>Although the petitioners challenge Ext.P9 order itself, now the<\/p>\n<p>petitioners would submit that the petitioners are prepared to<\/p>\n<p>face an enquiry. But the Lok Ayukta has already entered a<\/p>\n<p>finding that the part of the charges have been proved, which<\/p>\n<p>may be held against the petitioners by the enquiring authoirty<\/p>\n<p>and therefore, even if this Court permits an enquiry as directed<\/p>\n<p>by the Kerala Lok Ayukta that shall be untrammelled with the<\/p>\n<p>earlier findings of the Lok Ayukta is their present submission.<\/p>\n<p>      2.    I have heard the learned counsel for the petitioners,<\/p>\n<p>the learned Government Pleader and the learned counsel for<\/p>\n<p>the 1st respondent.\n<\/p>\n<p>      3.    I    am      of    opinion    that    from      the   very<\/p>\n<p>recommendations of the Lok Ayukta, it is abundantly clear that<\/p>\n<p>what the Lok Ayukta directed is only an independent enquiry<\/p>\n<p>as directed by the Lok Ayukta. The Lok Ayukta itself had not<\/p>\n<p>intended the enquiring authority to be influenced by its earlier<\/p>\n<p>findings, which was only for the purpose of directing an<\/p>\n<p>enquiry and therefore, it is only a prima facie finding. The Lok<\/p>\n<p><span class=\"hidden_text\">O.P.No.19441\/02                   4<\/span><\/p>\n<p>Ayukta itself wanted the enquiring authority to decide whether<\/p>\n<p>the petitioners are guilty of the allegations against them on the<\/p>\n<p>basis of the evidence to be collected in the enquiry.<\/p>\n<p>     In the above circumstances, this original petition is<\/p>\n<p>disposed of with a direction that the enquiring authority shall<\/p>\n<p>conduct the enquiry and enter a finding based on evidence<\/p>\n<p>collected by it and not based on the prima facie finding entered<\/p>\n<p>by the Lok Ayukta.\n<\/p>\n<\/p>\n<p>                                       S.
