We have also gone through the jail remarks sheet<br \/>\n\tforwarded by the jail authority along with the application.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remarks sheet, we find that the applicant has<br \/>\n\tundergone more than 4 years imprisonment as against sentence of<br \/>\n\timprisonment for life. During that period, he was enlarged on<br \/>\n\ttemporary bail on 2 occasions, one in 2007 and another in 2008.<br \/>\n\tSimilarly, he has enjoyed two furlough leave, one in 2007 and<br \/>\n\tanother in 2009. On all the occasions, he has surrendered in time.<br \/>\n\tHe has not availed any leave for last more than 1 year. Besides<br \/>\n\tthis, the grounds stated by the applicant in his application seeking<br \/>\n\trelease on temporary bail appears to be genuine. On perusal of the<br \/>\n\tprinted invitation card, wherein it stated that the &#8216;Babri&#8217; ceremony<br \/>\n\t(Chawl karma vidhi) is scheduled on 20.08.2010, in view of this,<br \/>\n\taccording to us, if the applicant is released on temporary bail for<br \/>\n\ta period of 10 days from the date of his actual release, the same<br \/>\n\twould meet the ends of justice.\n<\/p>\n<p>For<br \/>\n\tforegoing reasons, the application succeeds in part.  Accordingly,<br \/>\n\tit is partly allowed. The applicant &#8211; convict prisoner &#8211;<br \/>\n\tRAJU @<br \/>\n\tTAKO SHARVADAMAN TANK is ordered to be<br \/>\n\treleased on temporary bail for a period of 10 days from the date of<br \/>\n\this actual release on executing a personal bond of Rs.5,000\/- before<br \/>\n\tthe jail authority on usual terms and conditions. The applicant<br \/>\n\tshall surrender to the jail authority on completion of 10 days from<br \/>\n\tthe date of his actual release without fail.
