Gourichak, District Patna.\n                                                                             -------Petitioners\n                                                    Versus\n                The State Of Bihar\n                                                                        -----Opposite Party\n                                                ----------------\n<\/pre>\n<p>02\/-   30\/09\/2011                   Heard learned counsel for the petitioners and learned<\/p>\n<p>                      Additional Public Prosecutor for the State.<\/p>\n<p>                                    The four petitioners apprehending their arrest in<\/p>\n<p>                      connection with a case registered for the offence punishable under<\/p>\n<p>                      Sections 341, 323, 324, 325, 307, 34 of the Indian Penal Code, are<\/p>\n<p>                      named accused in this case of assault.\n<\/p>\n<p>                                    Submission is that though as per the allegation,<\/p>\n<p>                      petitioner no. 1 was there with a pistol, but it was never used and<\/p>\n<p>                      the remaining three petitioners arrived at the sc\u00e8ne, as per the<\/p>\n<p>                      allegation, subsequently, but without any specific allegation and<\/p>\n<p>                      there is general and omnibus allegation against them and the<\/p>\n<p>                      specific allegation is attributed against two non-petitioners.<\/p>\n<p>                      Further, submission is that latter part of the First Information<\/p>\n<p>                      Report relating to snatching and causing injury to Anand Kumar,<\/p>\n<p>                      there is no material to support this assertion nor said Anand<\/p>\n<p>                      Kumar sustained any injury.\n<\/p>\n<p>                                  If it is so, in the event of their arrest\/surrender before<\/p>\n<p>                      the court below within four weeks, let the above named petitioners<\/p>\n<p>                      be enlarged on bail on furnishing bail-bond of Rs. 10,000\/- (ten<br \/>\n             thousand only) each with two sureties of the like amount each to<\/p>\n<p>            the satisfaction of Additional Chief Judicial Magistrate, Patna<\/p>\n<p>            City, in connection with Gourichak P.S. Case No. 47 of 2011,<\/p>\n<p>            subject to condition laid down under Section 438(2) of the<\/p>\n<p>            Criminal Procedure Code with additional condition to remain<\/p>\n<p>            physically present before the court below on each and every date<\/p>\n<p>            at least for two years or till disposal of the case, whichever is<\/p>\n<p>            earlier, in case of failure on two consecutive dates, without giving<\/p>\n<p>            any reasonable explanation, the liberty granted shall be deemed to<\/p>\n<p>            be cancelled.\n<\/p>\n<\/p>\n<p>                                   ( Akhilesh Chandra, J.)<br \/>\nPraveen\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
