Heard learned counsel for the petitioner<\/p>\n<p>                        and learned Additional Public Prosecutor for<\/p>\n<p>                        the State.\n<\/p>\n<p>                                 2.      Supplementary         affidavit   has    been<\/p>\n<p>                        filed on behalf of the petitioner.<\/p>\n<p>                                 3.     This is an application under Section<\/p>\n<p>                        482   of   the       Criminal    Procedure   Code     seeking<\/p>\n<p>                        quashing of order dated 18.12.2002 passed by<\/p>\n<p>                        learned Chief Judicial Magistrate, Bhagalpur in<\/p>\n<p>                        Tilakmanjhi Bhagalpur P.S. Case No. 113\/2002,<\/p>\n<p>                        non-First Information Report Case no. 02\/2002,<\/p>\n<p>                        taking     cognizance        for   the     offences      under<\/p>\n<p>                        Section       182,    211   of   the   Indian   Penal    Code<\/p>\n<p>                        against the petitioner.\n<\/p>\n<p>                                 4.      Admittedly, at the instance of the<br \/>\n<span class=\"hidden_text\">                -2-<\/span><\/p>\n<p>petitioner Kotwali P.S.Case No. 446\/2001 under<\/p>\n<p>section     341,   342,     323,   379,    504\/34    of   the<\/p>\n<p>Indian Penal Code was instituted wherein police<\/p>\n<p>after investigation not only submitted final<\/p>\n<p>form but also recommended action to be taken<\/p>\n<p>against informant under section 182,211 of the<\/p>\n<p>Indian Penal Code for which separate prayer was<\/p>\n<p>to be made.\n<\/p>\n<p>       5.          The     Petitioner      filed     protest<\/p>\n<p>petition against such submission on final form<\/p>\n<p>but after hearing not only the final form was<\/p>\n<p>accepted but by same order dated 16.11.2001,<\/p>\n<p>the protest complaint was also refused giving<\/p>\n<p>rise to criminal revision no. 542\/2002 before<\/p>\n<p>learned     Sessions        Judge,   Bhagalpur,        which<\/p>\n<p>ultimately appears allowed, vide order dated<\/p>\n<p>07.05.2003,        passed     by     the     learned      4th<\/p>\n<p>Additional Sessions Judge, Bhagalpur, to the<\/p>\n<p>extent that court below was directed to record<\/p>\n<p>statement of the complainant and witnesses and<\/p>\n<p>thereafter pass appropriate order treating the<\/p>\n<p>protest petition as a complaint case.<\/p>\n<p>       6.     In view of the above Complaint Case<\/p>\n<p>No.   C677\/2003      was    instituted     wherein     after<\/p>\n<p>examining    the     witnesses     and    other    materials<br \/>\n<span class=\"hidden_text\">                   -3-<\/span><\/p>\n<p>vide     order    dated     08.08.2003         cognizance           was<\/p>\n<p>taken for the offences alleged.<\/p>\n<p>         7.       Against       the      above       order        dated<\/p>\n<p>08.08.2003,       accused       persons       there      preferred<\/p>\n<p>Criminal      Miscellaneous        No.       27523\/2003        before<\/p>\n<p>this court seeking quashing of the order with a<\/p>\n<p>liberty to raise their points at appropriate<\/p>\n<p>stage     before        appropriate          forum,      the       same<\/p>\n<p>appears dismissed as withdrawn vide order dated<\/p>\n<p>12.05.2004.\n<\/p>\n<p>         8.      No doubt, before taking cognizance<\/p>\n<p>for the offences against the accused persons<\/p>\n<p>named in Kotwali P.S. Case No. 466\/2001, was<\/p>\n<p>taken,     in     pursuance        of       protest      complaint<\/p>\n<p>petition, the court blow took cognizance for<\/p>\n<p>the    offence     under    section          182,     211    of    the<\/p>\n<p>Indian    Penal     Code    which       is     under     challenge<\/p>\n<p>here.\n<\/p>\n<p>         9.        Once     the       court         of   competent<\/p>\n<p>jurisdiction finding prima facie case against<\/p>\n<p>the accused persons for the offences, the case<\/p>\n<p>was    instituted        earlier      but     police     submitted<\/p>\n<p>final     form.     It     cannot       be     said      that       the<\/p>\n<p>informant petitioner had no reason to get the<\/p>\n<p>case     instituted       and   he      is    liable        for    the<br \/>\n<span class=\"hidden_text\">                                 -4-<\/span><\/p>\n<p>                prosecution as recommended under section 182,<\/p>\n<p>                211 of the Indian Penal Code.\n<\/p>\n<pre>                         10.   In     view   of     the   above,    if     the\n\n                impugned       order     and      the      proceeding      of\n\n<\/pre>\n<p>                Tilakmanjhi Bhagalpur P.S. Case No. 113\/2002<\/p>\n<p>                non-F.I.R.     Case    No.   02\/2002      is   permitted    to<\/p>\n<p>                continue, it shall be nothing but abuse of the<\/p>\n<p>                process of law and sheer wastage of precious<\/p>\n<p>                judicial time.\n<\/p>\n<p>                         11.
