Learned<br \/>\ncounsel Mr. Motiramani referred to the papers and also order passed<br \/>\nby this Court in Civil Application No. 9676 of 2008 (for bringing the<br \/>\nheirs on record) dated 23.03.2010 and submitted that the heirs of<br \/>\ndeceased respondent No.3 had made an application without any<br \/>\napplication for delay condonation which was withdrawn with a liberty<br \/>\nto file fresh application and therefore he did not move and wait for<br \/>\nnecessary application being made. Learned Advocate Mr. Motiramani,<br \/>\ntherefore, submitted that the present application may be allowed.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr. Shah has resisted the application. However, he stated<br \/>\nthat Civil Application No. 9676 of 2008 was withdrawn with a liberty<br \/>\nto file fresh application for bringing heirs on record along with<br \/>\napplication for condonation of delay.\n<\/p>\n<p>3.\tThe<br \/>\nprovisions of Rule 4 of Order 22 of Code of Civil Procedure provide<br \/>\nfor bringing the heirs on record. It is for the petitioner to make<br \/>\nnecessary application for bringing the heirs as per law within the<br \/>\nperiod. At the same time, even if the application is made by the<br \/>\nheirs of deceased respondent at their own, it is obligatory for the<br \/>\npetitioner to take necessary steps, which have admittedly not been<br \/>\ntaken. However, the heirs of deceased respondent have also filed<br \/>\nearlier Civil Application No. 9676 of 2008 for bringing them on<br \/>\nrecord which was withdrawn as per order dated 23.03.2010 with a<br \/>\nliberty to file fresh application. Though it was obligatory for the<br \/>\npetitioner to take necessary steps, he has conveniently not taken the<br \/>\nsteps. Even when the order was passed in Civil Application No. 9676<br \/>\nof 2008, the petitioner could have fairly conceded for condonation of<br \/>\ndelay.\n<\/p>\n<p>4.\tThe<br \/>\nCourt has also come across an order of this Court dated 17.04.2008 in<br \/>\nthe present revision application where the steps have not been taken<br \/>\nwhich has been noted. This also reflects the attitude of the present<br \/>\npetitioner. However, considering the settled principle regarding<br \/>\ncondonation of delay which was required to be considered liberally as<br \/>\nlaid down by the Hon&#8217;ble Apex Court in catena of judicial<br \/>\npronouncements including, (i) <a href=\"\/doc\/1117226\/\">Collector,<br \/>\nLand Acquisition, Anantnag v. Mst. Katiji, AIR<\/a> 1987 Supreme Court<br \/>\n1353 (ii)<br \/>\n<a href=\"\/doc\/644440\/\">State<br \/>\nof Bihar &amp; others v. Kamleshwar Prasad Singh &amp;<\/a> another, AIR<br \/>\n2000 SC 2306<br \/>\nand (iii) <a href=\"\/doc\/1264971\/\">Oriental<br \/>\nAroma Chemical Industries Ltd., v. Gujarat Industrial Development<br \/>\nCorporation &amp; Anr.,<\/a> (2010)5 SCC 459,<br \/>\n this Court is of the opinion that the present application deserves<br \/>\nto be allowed subject to petitioner&#8217;s depositing the cost of Rs.<br \/>\n2,000\/- in this Court which will be transmitted to the Gujarat High<br \/>\nCourt Legal Services Committee.\n<\/p>\n<p>5.\tHence,<br \/>\nthe present application deserves to be allowed and accordingly stands<br \/>\nallowed. Prayer in terms of para 5(A) is granted and delay of  2647<br \/>\ndays in filing the application for bringing the heirs of deceased<br \/>\nrespondent is hereby condoned subject to petitioner&#8217;s depositing the<br \/>\ncost of Rs. 2,000\/- (Rupees Two Thousand only) as stated above.\n<\/p>\n<p>(RAJESH<br \/>\nH.
