GOVERNMENT\nPLEADER for\nRespondents. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\n HONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 07\/05\/2010 \n\n \n\n \n ORAL\nJUDGMENT<\/pre>\n<p>\t\tBy<br \/>\nfiling this writ petition under Article 227 of the Constitution of<br \/>\nIndia, the detenu has challenged the order of detention No.<br \/>\nPCB\/DTN\/PASA\/659\/2009 dated 22.10.2009 passed by the Commissioner of<br \/>\nPolice, Ahmedabad City, respondent No.1, in exercise of powers under<br \/>\nsub-section (1) of section 3 of the Gujarat Prevention of Anti Social<br \/>\nActivities Act, 1985 [hereinafter referred to as the PASA Act]<br \/>\ndetaining the detenu as a bootlegger, as being illegal, invalid,<br \/>\narbitrary, void ab-initio and suffers from total non-application of<br \/>\nmind and also in violation of the provisions of the Constitution of<br \/>\nIndia.\n<\/p>\n<p>\t\tLearned<br \/>\nadvocate for the detenu, Ms. Banna Datta submitted that the grounds<br \/>\nof detention do not indicate any satisfaction recorded by the<br \/>\ndetaining authority that the activities of the detenu are detrimental<br \/>\nto  public order , and, therefore, the detention order is bad and<br \/>\nillegal. She submitted that the detaining authority has placed<br \/>\nreliance on four cases under the Prohibition Act but the same do not<br \/>\nindicate anything to support disturbance to  public order . She<br \/>\nsubmitted that the last offence was registered on 27.09.2009, the<br \/>\ndetenu was arrested on 27.09.2009, and the detenu was released on<br \/>\nbail 28.09.2009 but the detention order is passed on 22.10.2009.<br \/>\nLearned advocate therefore submitted that there is a delay in passing<br \/>\nthe order of detention and on this ground also, the detention order<br \/>\nrequires to be quashed and set aside.\n<\/p>\n<p>\tMs.\n<\/p>\n<p>Mini Nair, learned AGP submitted that the detention order is just and<br \/>\nproper and detaining authority has passed the order after considering<br \/>\nall relevant aspects of the matter, and the same needs no<br \/>\ninterference.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel appearing for both the sides. I have also perused the<br \/>\nrecords available in the compilation.\n<\/p>\n<p>\tIt<br \/>\nappears that on the basis of four cases,  all  registered at<br \/>\nNaranpura Police Station, viz. Prohibition CR No. 5179 of 2008 dated<br \/>\n16.10.2008 for 3 Ltrs. of country liquor, Prohibition CR No. 5079 of<br \/>\n2009 dated 31.03.2009 for 5 Ltrs. of country liquor, Prohibition CR<br \/>\nNo. 5171 of 2009 dated 12.06.2009 for 7 Ltrs. of country liquor and<br \/>\nProhibition CR No. 5236 of 2009 dated 27.09.2009 for 32 Ltrs. of<br \/>\ncountry liquor registered against the detenu, the detaining authority<br \/>\nheld that the said activities of selling liquor of the present detenu<br \/>\nwere harmful to the health of the public, and to restrain from<br \/>\ncarrying further illegal activities, the detenu has been detained. It<br \/>\nappears from the order that the activities of the detenu cannot be<br \/>\nsaid to be disturbing the  public order .  It also appears from<br \/>\nthe order passed by the detaining authority that  grounds which are<br \/>\nmentioned in the order are in reference to the situation of  law<br \/>\nand order  and not  public order .\n<\/p>\n<p>\tIt is<br \/>\nthe contention of learned advocate for the detenu that the detaining<br \/>\nauthority has placed reliance on four cases registered against the<br \/>\ndetenu and the last offence was registered on 27.09.2009, the detenu<br \/>\nwas arrested on 27.09.2009, and the detenu was released on bail<br \/>\n28.09.2009 but the detention order is passed on 22.10.2009. Hence<br \/>\nthere is delay of almost 24 days in passing the order of detention.<br \/>\nThe delay caused in passing and execution of the order of detention<br \/>\nis not satisfactorily explained.  Hence, I am of the view that on the<br \/>\nground of delay caused in passing the order of detention itself, this<br \/>\npetition requires to be allowed.\n<\/p>\n<p>\tThat<br \/>\napart, except the statements of some anonymous witnesses, there is no<br \/>\nmaterial on record which shows that the detenu is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic.  In the case of Collector and  DIST. MAGISTRATE V\/S. SULTAN<br \/>\n reported in AIR 2008 SC 2096 the Apex Court has distinguished<br \/>\nbetween  public order  and  law and order  and held that the<br \/>\ndistinction between the areas of &#8216;law and order&#8217; and &#8216;public order&#8217;<br \/>\nis one of the degree and extent of the reach of the act in question<br \/>\non society which would disturb the even tempo of life of the<br \/>\ncommunity and if the effect is confined only to a few individuals<br \/>\ndirectly involved as distinct from a wide spectrum of public, it<br \/>\ncould raise problem of law and order only.\n<\/p>\n<p>\tApplying<br \/>\nthe ratio of the above decision, it is clear that before passing an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the  public order  and<br \/>\nit is very clear that the present case would not fall within the<br \/>\ncategory of threat to  public order . Even the quantity involved<br \/>\nis small. In that view of the matter, when the order of detention has<br \/>\nbeen passed by the detaining authority without having adequate<br \/>\ngrounds for passing the said order, it cannot be sustained and,<br \/>\ntherefore, it deserves to be quashed and set aside.\n<\/p>\n<p>\tFor<br \/>\nthe foregoing reasons, the petition is allowed. The impugned order of<br \/>\ndetention dated 22.10.2009 passed by the Commissioner of Police,<br \/>\nAhmedabad City, respondent No.1 against  the detenu is hereby quashed<br \/>\nand set  aside.   The detenu is ordered to be set at liberty<br \/>\nforthwith,  if  not  required  in  any other case.    Rule is made<br \/>\nabsolute accordingly.
