PRADHAN<br \/>\n              NAGAR, DISTRICT DARZILLING (WEST BENGAL)<br \/>\n                                     Versus<br \/>\n                               The State Of Bihar\n<\/p>\n<p>                                      &#8212;&#8212;-\n<\/p>\n<p>03.   28.07.2011              Heard learned counsel for the petitioner and the<\/p>\n<p>                    State.\n<\/p>\n<p>                              The petitioner prays for quashing of the part of<\/p>\n<p>                    the impugned order dated 05.02.2011 passed by Additional<\/p>\n<p>                    Chief Judicial Magistrate, Jhanjharpur in Phulparas P.S.<\/p>\n<p>                    Case No. 43 of 2010 (G.R. No. 209 of 2010).<\/p>\n<p>                              By the impugned order,      the court below has<\/p>\n<p>                    ordered release of the two trucks in question out of seven<\/p>\n<p>                    involved in the case on execution of bond and other<\/p>\n<p>                    undertakings.\n<\/p>\n<p>                              Learned counsel appearing for the petitioners<\/p>\n<p>                    submits that previously also for release      of trucks the<\/p>\n<p>                    concerned had approached        this court.   In the same<\/p>\n<p>                    sequence two of the trucks in question involved have been<\/p>\n<p>                    released merely on furnishing bonds of the value of the<\/p>\n<p>                    trucks by the court below, however in the present case the<\/p>\n<p>                    court below directed for release   on furnishing   bond   for<\/p>\n<p>                    much higher     value    and other undertakings. Learned<\/p>\n<p>                    counsel submits that the trucks     directed to be released<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>           under the order may also        be released on furnishing     the<\/p>\n<p>           bond of the value        of trucks in    question. In this regular<\/p>\n<p>           reference is made to the order dated 19.08.2010 passed in<\/p>\n<p>           Cr. Misc. No. 30434 of 2010 (Annexure-2)           and the order<\/p>\n<p>           dated 11.05.2011 passed in Cr. Misc. No. 16392 of 2011.<\/p>\n<p>                        Learned counsel for the State is not in a position<\/p>\n<p>           to refute the submissions made on behalf of the petitioners.<\/p>\n<p>                        Considering the facts and circumstance of the<\/p>\n<p>           case and the submissions of the parties, in case other two<\/p>\n<p>           trucks also involved in the lot of seized vehicles in the above<\/p>\n<p>           police case, as submitted, have been released on furnishing<\/p>\n<p>           bonds of the value        of the truck, the impugned order is<\/p>\n<p>           modified     only   to the extent       that the same terms and<\/p>\n<p>           conditions     shall be applicable for release of the vehicles<\/p>\n<p>           under the impugned order subject to the final result of the<\/p>\n<p>           above case\/confiscation proceeding, if any.<\/p>\n<p>                        This criminal miscellaneous application stands<\/p>\n<p>           disposed as indicated above.\n<\/p>\n<p>                        This order may be communicated to the court<\/p>\n<p>           below through FAX on the cost being deposited by              the<\/p>\n<p>           petitioners.\n<\/p>\n<p>Jagdish\/                            ( Shailesh Kumar Sinha, J.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Parmeshwar Singh &amp; Anr. vs The State Of Bihar on 28 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellanious No.5902 of 2011 ============================================= 1.
