No.29210 of 2010\n                  JITENDRA YADAV SON OF LATE RAM PRABESH YADAV\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>3.   11.10.2010             Heard learned Counsel for the petitioner and the<\/p>\n<p>                   State.\n<\/p>\n<p>                            The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence u\/ss.302 and 201 of the Indian Penal Code.<\/p>\n<p>                            It has been submitted that apart from the material<\/p>\n<p>                   that the petitioner was last seen in the company of the<\/p>\n<p>                   deceased and there is no motive on behalf of the petitioner<\/p>\n<p>                   to have committed this occurrence.\n<\/p>\n<p>                             Considering the same, let the petitioner above<\/p>\n<p>                   named, who is in custody since 13.4.2010, be released on<\/p>\n<p>                   bail on furnishing bail bond of Rs.5,000\/- (Five thousand)<\/p>\n<p>                   with two sureties of the like amount each or any other surety<\/p>\n<p>                   to be fixed by the court concerned to the satisfaction of<\/p>\n<p>                   A.D.J., F.T.C.II, Saran at Chapra in S.Tr.No.269 of 2010<\/p>\n<p>                   arising out of Manjhi P.S.case No.28 of 2004, subject to the<\/p>\n<p>                   conditions (i) That one of the bailor will be a close relative of<\/p>\n<p>                   the petitioner who will give an affidavit giving genealogy as<\/p>\n<p>                   to how he is related with the petitioner. The bailor will<\/p>\n<p>                   undertake to furnish information to the Court about any<\/p>\n<p>                   change in address of the petitioner. (ii) That the affidavit<\/p>\n<p>                   shall clearly state that the petitioner is not an accused in any<\/p>\n<p>                   other case and if he is he shall not be released on bail, (iii)<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>            That the bailor shall also state on affidavit that he will inform<\/p>\n<p>            the court concerned if the petitioner is implicated in any<\/p>\n<p>            other case of similar nature after his release in the present<\/p>\n<p>            case and thereafter the court below will be at liberty to<\/p>\n<p>            initiate the proceeding for cancellation of bail on ground of<\/p>\n<p>            misuse, (iv) That the petitioner will give an undertaking that<\/p>\n<p>            he will receive the police papers on the given date and be<\/p>\n<p>            present on date fixed for charge and if he fails to do so on<\/p>\n<p>            two given dates and delays the trial in any manner, his bail<\/p>\n<p>            will be liable to be cancelled for reasons of misuse, (v) That<\/p>\n<p>            the petitioner will be well represented on each date if he fails<\/p>\n<p>            to do so on two consecutive dates, his bail will be liable to<\/p>\n<p>            be cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                          ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Jitendra Yadav vs State Of Bihar on 11 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
