Justice M.SASIDHARAN NAMBIAR\n\n Dated :14\/12\/2009\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ------------------------------------------\n           Crl.M.C.NO.4039 OF 2009\n           ------------------------------------------\n            Dated 14th December 2009\n\n\n                         O R D E R\n<\/pre>\n<p>            Petitioner               was        convicted   and<\/p>\n<p>sentenced for the offence under Section 138<\/p>\n<p>of     Negotiable                 Instruments              Act.<\/p>\n<p>Crl.A.383\/2009 was filed challenging the<\/p>\n<p>conviction and sentence.                  Crl.M.P.3185\/2009<\/p>\n<p>was filed to suspend the sentence.                           By<\/p>\n<p>Annexure-A1 order learned Sessions Judge<\/p>\n<p>directed the petitioner to deposit                      half of<\/p>\n<p>the cheque amount within one month for<\/p>\n<p>suspending the sentence. This petition is<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure   to          quash             said        condition<\/p>\n<p>contending  that         learned             Sessions     Judge<\/p>\n<p>should not have directed the petitioner to<\/p>\n<p>deposit fifty percentage of the                      amount for<\/p>\n<p>Crmc 4039\/09<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>suspending the sentence.\n<\/p>\n<p>            2. Learned   counsel  appearing   for<\/p>\n<p>petitioner relying on the decision of the<\/p>\n<p>Supreme court in         <a href=\"\/doc\/559864\/\">Stanny Felix Pinto v.<\/p>\n<p>Jangid Builders Pvt. Ltd and<\/a> another (AIR<\/p>\n<p>2001 SC 659)       argued that when fine amount<\/p>\n<p>was Rs.20,00,000\/-      their Lordships directed<\/p>\n<p>to deposit only Rs.4,00,000\/-      which would be<\/p>\n<p>only 1\/5th of the     amount and when the cheque<\/p>\n<p>is for Rs.1,50,000\/- direction to deposit 50%<\/p>\n<p>of    the    amount  is  harsh.  Relying  on  the<\/p>\n<p>decision of      Andhra Pradesh High Court in AMI<\/p>\n<p>Sanag Micromation v. State of A.P (2001 (1)<\/p>\n<p>KLJ     409)      learned  counsel  argued   that<\/p>\n<p>condition to deposit Rs.25,000\/- itself was<\/p>\n<p>found to be unreasonable.\n<\/p>\n<p>            3. Learned counsel submitted that if<\/p>\n<p>petitioner      is  directed   to  deposit   huge<\/p>\n<p>Crmc 4039\/09<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>amount,      he  cannot  avail  the  benefit  of<\/p>\n<p>suspension of the sentence.     I find no reason<\/p>\n<p>whatsoever,      to  interfere  with  the  order<\/p>\n<p>passed      by   the  learned  Sessions   Judge.<\/p>\n<p>Learned      Sessions  Judge  was  justified  in<\/p>\n<p>directing     to deposit a portion of the amount<\/p>\n<p>covered by the cheque, for suspending the<\/p>\n<p>sentence.      Direction to deposit  50% of the<\/p>\n<p>cheque amount is         the discretion of the<\/p>\n<p>appellate court. Supreme court has not held<\/p>\n<p>that only 1\/5th of the amount     covered by the<\/p>\n<p>cheque could be directed to be deposited. On<\/p>\n<p>the other hand, it is stated that if the<\/p>\n<p>amount      to  be  deposited is   huge,    such<\/p>\n<p>portion      shall   not  be   directed  to   be<\/p>\n<p>deposited. Even Rs.4,00,000\/- was found to be<\/p>\n<p>not a huge amount, by the Apex court. In such<\/p>\n<p>circumstances, if the petitioner       wants to<\/p>\n<p>Crmc 4039\/09<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>suspend the sentence, portion of the amount<\/p>\n<p>as directed by the learned Sessions Judge is<\/p>\n<p>to    be    deposited.  If  the   case  of  the<\/p>\n<p>petitioner is that he is      not in a position<\/p>\n<p>to         deposit the amount, because of his<\/p>\n<p>financial condition, he is at liberty to<\/p>\n<p>approach      the  learned  Sessions  Judge  to<\/p>\n<p>dispose the appeal at the earliest without<\/p>\n<p>suspending the sentence.
