BASANT, J.\n\n             ````````````````````````````````````````````````````\n\n                       B.A. No. 452 OF 2008 D\n\n             ````````````````````````````````````````````````````\n\n            Dated this the 25th day of January, 2008\n\n\n                                 O R D E R\n<\/pre>\n<p>             Second   application   for   regular   bail.     Petitioners<\/p>\n<p>face allegations in a crime registered for offences punishable,<\/p>\n<p>inter alia, under Sections 489A, B and C and 468 read with 34<\/p>\n<p>IPC.     The   petitioners   were   arrested   on   18.11.07.     They<\/p>\n<p>continue   in   custody   from   that   date.     The   CBCID   has   taken<\/p>\n<p>over investigation from 3.1.08.  Final report has not been filed<\/p>\n<p>yet.     An   earlier   application   for   regular   bail     filed   by   the<\/p>\n<p>petitioners   was   dismissed   as   per   order   dated   7.1.08   in<\/p>\n<p>BA.8117\/07.\n<\/p>\n<\/p>\n<p>      2.     I   have   adverted   to   the   facts   in   detail   in   the   said<\/p>\n<p>order dated 7.1.08.  This order must be read in continuation of<\/p>\n<p>the said  order and I am  not, hence,  adverting to the  facts  in<\/p>\n<p>any greater detail in this order.\n<\/p>\n<\/p>\n<p>      3.     The   learned   Public   Prosecutor   submits   that   the<\/p>\n<p>investigation   is   not   complete.     A   co-accused   has   been<\/p>\n<p>arrested subsequently.  In a serious crime like this, where the<\/p>\n<p>BA.452\/08<\/p>\n<p><span class=\"hidden_text\">                                       : 2 :<\/span><\/p>\n<p>petitioners   are   foreign   nationals,   the   investigators   may   be<\/p>\n<p>granted reasonable further time to complete the investigation.<\/p>\n<p>Some passports are to be traced.  Those vital documents are<\/p>\n<p>said   to   be   available   in   Bombay   with   some   persons   as<\/p>\n<p>entrusted by the petitioners.   If the petitioners were released<\/p>\n<p>on bail, it will seriously harm to the course of the investigation,<\/p>\n<p>submits the learned Public Prosecutor.<\/p>\n<p>       4.     I  find   merit   in   the  opposition   of  the   learned   Public<\/p>\n<p>Prosecutor.     I   am   satisfied   that   in   a   crime   like   this,<\/p>\n<p>investigators must be given some further time to complete the<\/p>\n<p>investigation.\n<\/p>\n<\/p>\n<p>       5.     In the result, this petition is dismissed.   However, I<\/p>\n<p>may hasten to observe that the petitioners shall be at liberty to<\/p>\n<p>move   this   court   or   the   Sessions   court   for   bail   again   at   later<\/p>\n<p>stages   of   the   investigation   not,   at   any   rate,   prior   to<\/p>\n<p>08\/02\/2008.
