DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/09\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Advocates for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition under Article 226 of the Constitution of India is filed by<br \/>\n\tthe petitioner, son of the deceased employee who expired on duty on<br \/>\n\t12.02.1997.  It is the case of the petitioner that he had passed<br \/>\n\tStandard X examination and is eligible by acquiring such<br \/>\n\tqualifications prescribed under the Government Resolution dated<br \/>\n\t10.03.2000 to seek claim on compassionate appointment.  It is<br \/>\n\tfurther submitted that in view of inter-se dispute in the family<br \/>\n\tabout the claim of dues of the deceased employee for which a Civil<br \/>\n\tSuit was filed and finally it was decreed in the year 1999 and<br \/>\n\ttherefore, the claim for compassionate appointment is not delayed<br \/>\n\tand besides, all family members have given their no objection if the<br \/>\n\tpetitioner is appointed on compassionate grounds.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tDipak R. Dave learned Counsel for the Gujarat Electricity Board has<br \/>\n\trelied on the affidavit filed by the respondent, regulation of the<br \/>\n\tElectricity Board and earlier communication by which the petitioner<br \/>\n\twas denied the appointment on compassionate ground and submitted<br \/>\n\tthat the challenge to such communication is even belated by about 11<br \/>\n\tyears. It is further submitted that in case of an employee who died<br \/>\n\tin harness, if the family has survived for about 13 years, it cannot<br \/>\n\tbe said that a case is made out for compassionate appointment.<br \/>\n\tBesides, learned Counsel for the respondent has relied on General<br \/>\n\tCondition of Service No.92 which specifically prohibited contracting<br \/>\n\tof second marriage by an employee during his service and such<br \/>\n\tservice is to be terminated.  It is further submitted that even<br \/>\n\tconsidering the overall merits, no case is made out for issuance of<br \/>\n\tdirections as prayed for.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and considering overall facts<br \/>\n\tand circumstances, it is not in dispute that the deceased employee<br \/>\n\thad contracted second marriage during his service and dispute was<br \/>\n\tbetween his two wives and Civil Suit was filed and later on<br \/>\n\tsettlement was arrived at; at the same time claim of compassionate<br \/>\n\tappointment is grossly belated. Not only that but considering the<br \/>\n\tregulation of the Electricity Board, the claim of compassionate<br \/>\n\tappointment and belated challenge after 11 years to the decision<br \/>\n\tdated 15.11.2000 passed by the then Gujarat Electricity Board, I am<br \/>\n\tnot inclined to exercise powers under Article 226 of the<br \/>\n\tConstitution of India.
