Justice K.P.BALACHANDRAN\n\n Dated :16\/01\/2007\n\n O R D E R\n                     J.B.KOSHY &amp; K.P.BALACHANDRAN,JJ.\n\n                      ------------------------------\n\n                         Crl.Appeal No.442 OF 2004\n\n                      ------------------------------\n\n                          Dated 16th January, 2007\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>Koshy,J<br \/>\n         .\n<\/p>\n<p>               Appellant   was   convicted   and   sentenced   to   under   go<\/p>\n<p>imprisonment  for life and to pay a fine of Rs.25,000\/= for an<\/p>\n<p>offence  punishable under section  302 of  the  Indian Penal Code<\/p>\n<p>for   causing   death   of   one   Shareefa   Beevi.     Shareefa   Beevi   was<\/p>\n<p>the   wife   of   PW15.     About   20   years   before   the   incident,   her<\/p>\n<p>marriage   was   broken   down   and   she  started   residing   separately.\n<\/p>\n<p>The accused was brought and brought up by one Jalal, uncle of<\/p>\n<p>deceased Shareefa Beevi and he resided in the family house of<\/p>\n<p>the deceased.  It is the allegation of the prosecution that he<\/p>\n<p>had   some   sexual   relationship   with   the   deceased.     Later,   the<\/p>\n<p>accused   married   the   daughter   of   the   aforesaid   Jalal   and<\/p>\n<p>resided   near   the   house   of   the   deceased   Shareefa   Beevi.     The<\/p>\n<p>accused   was   doing   business   of   fish   vending   and   the   deceased<\/p>\n<p>was   doing   the   business   of   sale   of   vegetables.     While   so,<\/p>\n<p>deceased   Shareefa   Beevi   extracted   money   from   the   accused<\/p>\n<p>stating   about   her   prior   sexual   relationship   with   him   and   the<\/p>\n<p>accused     therefore   resided   at   a   place   called   Kurakode   in   a<\/p>\n<p>rented   house.     Even   then,   at   the   market,   she   used   to   demand<\/p>\n<p>money.   In   view   of   that   motive,   the   accused   on   28.02.1997   at<\/p>\n<p>about   5.45   a.m.   waited   in   the   pathway   on   the   way   of   deceased<\/p>\n<p>Shareefa   Beevi   to   Chalai   Market   and   when   she   reached     the<\/p>\n<p>pathway   leading   to   Nedumangadu   market   from   International<\/p>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                        2<\/span><\/p>\n<p>market,   the   accused   with   the   intention   of   causing   death<\/p>\n<p>caught hold the tuft of her hair and caused her to lean and<\/p>\n<p>then   cut   her   with   MO1   dangerous   knife   3-4   times   on   her<\/p>\n<p>neck,   thereby   fatal   and   severe   injuries   were   sustained   on<\/p>\n<p>the  left  side  of  her  neck,  left  shoulder,  back  of  neck  and<\/p>\n<p>left cheek and deceased Shareefa Beevi fell down.  Then the<\/p>\n<p>accused  stood   on   her   right   thigh   and   asked   her   whether   she<\/p>\n<p>did   not   die   and   when   found   that   she   did   not   die,   chopped<\/p>\n<p>her   wound   on   her   neck   resulting   her   instantaneous   death   at<\/p>\n<p>the spot itself and thereby committed an offence punishable<\/p>\n<p>under   section   302   IPC.     Without   any   delay,   her   son   (PW1)<\/p>\n<p>gave   information   to   the   police   station   and   Ext.P1   F.I.\n<\/p>\n<p>Statement   was   given   before   PW17,   the   then   Sub   Inspector   of<\/p>\n<p>police.   While PW17 was recording the F.I.Statement of PW1,<\/p>\n<p>the   accused   approached   PW14,   who   was   doing   centry   duty   in<\/p>\n<p>the   Police   Station,   with   MO1   knife   in   his   hand   and   PW14<\/p>\n<p>informed the matter to PW17, thereby the knife was received<\/p>\n<p>and it was handed over to PW17 Sub Inspector.   PW14 deposed<\/p>\n<p>that  on   28.2.1997   he   was   on   centry   duty   in   the   Nedumangadu<\/p>\n<p>Police Station and while so, at about 6.30 a.m. the accused<\/p>\n<p>approached   him   with   a   knife   in   his   hand   stating   that   he<\/p>\n<p>murdered  a  lady  and  he  informed  the  matter  to  PW13  who  was<\/p>\n<p>in   G.D.   charge.     Evidence   of   PW17   shows   that   on   28.2.1997<\/p>\n<p>at  6.15   a.m.   he   was   recording   Ext.P1   F.I.   Statement   of   PW1<\/p>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                        3<\/span><\/p>\n<p>and   while   so,   at   about   6.30   a.m.,   the   accused   reached<\/p>\n<p>before   PW14   with   a   knife   in   his   hand   after   wrapping   the<\/p>\n<p>same   in   a   paper,   thereby   the   matter   was   informed   to   PW13<\/p>\n<p>and they brought the accused before him.   He questioned the<\/p>\n<p>accused   and   recorded   his   statement.   Then   the   matter   was<\/p>\n<p>informed   to   the   Circle   Inspector   and   thereafter   arrested<\/p>\n<p>him.     The   evidence   of   PW17   would   also   show   that   blood   was<\/p>\n<p>found   on   the   shirt   and   dhothi   worn   by   the   accused   and   on<\/p>\n<p>questioning   him,   he   stated   that   blood   was   sustained   in   his<\/p>\n<p>shirt   and   dhothi   while   committing   the   offence   and,<\/p>\n<p>therefore, he seized the same under Ext.P7 seizure mahazar.\n<\/p>\n<p>Evidence   of   Pws13,   14   and   17   clearly   prove   that   accused<\/p>\n<p>wearing   blood   stained   dress   appeared   in   Nedumangadu   Police<\/p>\n<p>Station   with   MO1   knife   immediately   after   the   incident.\n<\/p>\n<p>PW13  was  holding  G.D.  Charge  in  the  police  station.    It  is<\/p>\n<p>true   that   the   confession   statement   before   the   police<\/p>\n<p>officer   is   not   admissible   in   evidence   in   view   of   Sections<\/p>\n<p>25   &amp;   26   of   the   Evidence   Act.     The   accused   came   to   the<\/p>\n<p>police   station   with   the   blood   stained   knife   wearing   blood<\/p>\n<p>stained   dress.     The   above   conduct   and   what   is   seen   by   the<\/p>\n<p>police   officers   are   admissible   in   evidence   in   view   of<\/p>\n<p>Section   8   of   the   Evidence   Act.     MO1   knife,   MO1(a)   paper<\/p>\n<p>using which MO1 is wrapped and MOs 3 and 5 shirt and dhothi<\/p>\n<p>worn   by   the   accused   at   the   time   of   occurrence   were<\/p>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                                   4<\/span><\/p>\n<p>forwarded              to         the         Forensic         Science         Laboratory,<\/p>\n<p>Thiruvananthapuram for examination and Ext.P9 is the report<\/p>\n<p>obtained   from   the   Director,   FSL,   Thiruvananthapuram.\n<\/p>\n<p>Ext.P9 shows that MO1 contained human blood even though   it<\/p>\n<p>is insufficient to determine the group.   It also shows that<\/p>\n<p>MO1(a),   MO4   and   MO5   contained   human   blood   belonging   to   `B&#8217;<\/p>\n<p>group.     PWs   8   and   9   are   attestors   of   seizure   mahazar   of<\/p>\n<p>MO1, MO4 and MO5.  They supported the prosecution case.\n<\/p>\n<p>             2.   PWs   2   and   3   are   eye   witnesses.     According   to<\/p>\n<p>PW2,   deceased   Shareefa   Beevi   was   residing   adjacent   to   her<\/p>\n<p>house.  She   was   doing   the   business   of   sale   of   plastic   cover<\/p>\n<p>and   paper,   whereas   the   deceased   Shareefa   Beevi   was   doing<\/p>\n<p>the   business   of   sale   of   vegetables.                       On   the   date   of<\/p>\n<p>occurrence,   herself,   deceased   Shareefa   Beevi   and   PW3<\/p>\n<p>together   were   coming   to   the   Nedumangadu   market   through   the<\/p>\n<p>drain   of   the   International   market   for   the   purpose   of   going<\/p>\n<p>to   Chalai   market   and,   at   that   time,   the   accused   reached<\/p>\n<p>ahead   of   them   and   caught   hold   of   the   tuft   of   the   hair   of<\/p>\n<p>deceased Shareefa Beevi, caused her to lean and cut her 4-5<\/p>\n<p>times   on   her   neck   with   a   knife   used   for   cutting   fishes,<\/p>\n<p>thereby   Shareefa   Beevi   fell   down   by   her   face   downwards.\n<\/p>\n<p>Then   the   accused   after   sitting   on   her   thigh   asked   her<\/p>\n<p>whether   she   did   not   die   and     then   chopped   her   neck.   Then<\/p>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                          5<\/span><\/p>\n<p>PW2  informed   the   matter   to   PW1,   the   son   of   Shareefa   Beevi,<\/p>\n<p>who was found present in the market.  According to her, the<\/p>\n<p>accused ran towards Kurakode after the incident.   PW3 fully<\/p>\n<p>supported the version of PW2.  Version of PWs 13, 14 and 17<\/p>\n<p>was corroborated with version of eye witnesses.   Similarly,<\/p>\n<p>the   version   given   by   PWs   13,   14   and   17   regarding   the<\/p>\n<p>surrender   of   MO1   knife   etc.   was   also   not   seriously<\/p>\n<p>disputed.     PWs   5   and   6   mahazar   witnesses   also   support   the<\/p>\n<p>above version.\n<\/p>\n<p>             3.  Ext.P3   postmortem  certificate   shows  that   there<\/p>\n<p>were four incised wounds which are as follows:\n<\/p>\n<blockquote><p>           1.   Incised   wound   10.5   x   2.5   x   5.5   cm<\/p>\n<p>                  obliquely   placed   on   the   back   of   head<\/p>\n<p>                  and   neck,   its   right   lower   end   6   cm<\/p>\n<p>                  behind and 4 cm below the ear and the<\/p>\n<p>                  left upper end 2.5 cm behind the lower<\/p>\n<p>                  end   of   ear.     The   muscles   on   the   back<\/p>\n<p>                  of   head,   the   tissues   connecting   the<\/p>\n<p>                  under   surface   of   head   to   first<\/p>\n<p>                  cervical   vertebra,   and   the   upper   part<\/p>\n<p>                  of spinal cord (1&#215;0.4&#215;0.3cm) were seen<\/p>\n<p>                  cleanly cut.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           2.   Incised   wound   20x6x5.5cm   obliquely<\/p>\n<p>                  placed  on the left  side of  neck,  with<\/p>\n<p>                  a side cut 1.5&#215;1.5 cm in the middle of<\/p>\n<p>                  upper  margin.   Its  back upper  end  2cm<\/p>\n<p>                  behind and 2 cm below the left mastoid<\/p>\n<p>                  process.     The   wound   terminated   at  the<\/p>\n<p>                  level   of   the   inter   vertebral   disc   of<\/p>\n<p>                  6th  and   7th  cervical   vertebrae   after<\/p>\n<p>                  cutting   the   muscles,   vessels,   nerves<\/p>\n<p>                  and   soft   tissues   on   the   left   side.<\/p><\/blockquote>\n<blockquote>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                                 6<\/span><\/p>\n<p>                  Trachea   showed   an   incised   wound   1.5  x<\/p>\n<p>                  1.3   cm   involving   its   whole   thickness<\/p>\n<p>                  on  front wall.    Inner aspect  of  right<\/p>\n<p>                  sterno   mastoid   sternohyoid,   sterno<\/p>\n<p>                  thyroid   and   lower   third   of   thyroid<\/p>\n<p>                  gland   showed   a   clean   cut.     It   was<\/p>\n<p>                  directed downwards and to the right.<\/p>\n<p>                  Brain   showed   bilateral   subarachnoid<\/p>\n<p>                  haemorrhages.                 The   sulci   of   brain<\/p>\n<p>                  narrowed and gyri flattered.<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           3.   Incised   wound   7.5   x   1.5   x   1.5   cm<\/p>\n<p>                  vertical on the left side of neck, its<\/p>\n<p>                  lower   end   3.5   cm   outer   to   and   2   cm<\/p>\n<p>                  below         the         left              sterno-clavicular<\/p>\n<p>                  joint.           A   flap   of   collar   bone<\/p>\n<p>                  1.5&#215;0.5&#215;1.5   cm   was   found   cleanly   cut<\/p>\n<p>                  and reflected to right 3.5 cm outer to<\/p>\n<p>                  the sterno clavicular joint.<\/p>\n<p>                  The   side   cut   of   injury   No.(2)   and<\/p>\n<p>                  injury   No.(3)   were   in   the   same<\/p>\n<p>                  vertical line.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           4.   Incised   wound   5x1x4   cm   through   and<\/p>\n<p>                  through   horizontal   involving   the   left<\/p>\n<p>                  upper   lip   its   inner   end   1.5   cm   outer<\/p>\n<p>                  to   midline.     The   bone   underneath   was<\/p>\n<p>                  cleanly              cut                    with         fracture<\/p>\n<p>                  fragmentation around.&#8221;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>PW5   doctor   who   conducted   postmortem   and   issued   Ext.P3<\/p>\n<p>certificate   deposed   that   injury   Nos.1   to   4   could   be   caused<\/p>\n<p>by   MO1   and   injury   Nos.1   and   2   are   independently   sufficient<\/p>\n<p>in   the   ordinary   course   of   nature   to   cause   death.     She<\/p>\n<p>further stated that injury No.2 could be caused by chopping<\/p>\n<p>after   cutting   and   injury   No.4   could   be   caused   during<\/p>\n<p>cutting when the tip touches that portion of the body.  So,<\/p>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                         7<\/span><\/p>\n<p>the   medical   evidence   also   supports   the   evidence   of   eye<\/p>\n<p>witnesses.\n<\/p>\n<p>                  4.   In   313   statement,   apart   from   a   complete<\/p>\n<p>denial,   there   was   no   separate   defence     taken   up   by   the<\/p>\n<p>accused.     Two   contentions   were   raised   by   the   accused,<\/p>\n<p>mainly   that   there   was   no   motive   for   committing   the   crime.\n<\/p>\n<p>It is true that early sexual relationship as alleged by the<\/p>\n<p>prosecution   was   not   proved   by   clear   evidence,   but,   it   was<\/p>\n<p>proved   by   PWs   3   and   7   that   amounts   were   due   from   the<\/p>\n<p>deceased  and   deceased   used   to   demand   the   same.     When   there<\/p>\n<p>is  clear   ocular   evidence,   motive   is   not   so   important   as   in<\/p>\n<p>a   case   based   on   circumstantial   evidence   <a href=\"\/doc\/503037\/\">(See  Narayan   Nathu<\/p>\n<p>Naik  v.  The   State   of   Maharashtra     (AIR<\/a>  1971   SC   1656).\n<\/p>\n<p>Apart   from   the   above,     mind   set-up   of   persons   will   be<\/p>\n<p>different   and   whether   a   particular   incident   is   sufficient<\/p>\n<p>motive   or   not   depends   upon   person   to   person.     The   second<\/p>\n<p>contention is that PWs2 and 3 are relatives or friends.  It<\/p>\n<p>is   settled   law   that   mere   relationship   or   friendship   is   not<\/p>\n<p>a   ground   for   discarding   the   evidence   and,   normally,   a<\/p>\n<p>relative   or   a   friend   will   not   implicate   a   person   who   is<\/p>\n<p>innocent   so   as   to   allow   the   real   accused   to   escape.     PW2<\/p>\n<p>and PW3 are natural witnesses.  Apart from the above, there<\/p>\n<p>is   no   case   for   the   accused   that   PWs   2   and   3   are   inimical<\/p>\n<p><span class=\"hidden_text\">Crl.A.442\/2004                                   8<\/span><\/p>\n<p>towards   him   for   giving   false   evidence   against   him.     There<\/p>\n<p>is   nothing   to   disbelieve   the   evidence   of   PW2   and   PW3.\n<\/p>\n<p>Further,          other         evidence         including         medical         evidence<\/p>\n<p>corroborate the evidence of PWs 2 and 3.   Therefore, we are<\/p>\n<p>of   the   opinion   that   the   offence   alleged   against   the<\/p>\n<p>appellant   was   clearly   proved   and   the   trial   court   has<\/p>\n<p>considered   the   entire   evidence   and   came   to   the   right<\/p>\n<p>conclusion.
