(C) No. 34037 OF 2007\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 25th day of January, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>            The petitioner is the Manager of an aided college.<\/p>\n<p>He filed this writ petition seeking the following reliefs:-<\/p>\n<blockquote><p>     a) issue a writ of mandamus or other appropriate writ,<br \/>\n       order or direction to the respondents to permit the<br \/>\n       petitioner to fill up the vacancies in sanctioned posts<br \/>\n       excluding     those     attributable     to   new     courses<br \/>\n       sanctioned without additional financilal commitment<br \/>\n       lying vacant as shown in Ext.P3 statement and make<br \/>\n       appointment;\n<\/p><\/blockquote>\n<blockquote><p>     b)issue appropriate        writ, order      or direction     to<br \/>\n       respondents 1 and 4 to send nominee to the<br \/>\n       Selection Committee expeditiously to be constituted<br \/>\n       by the petitioner for selecting candidates for<br \/>\n       appointment;\n<\/p><\/blockquote>\n<blockquote><p>     c)issue appropriate writ, order or direction to the<br \/>\n       respondents to grant approval to the appointments<br \/>\n       and disburse salary to the teachers;\n<\/p><\/blockquote>\n<blockquote><p>     d)grant such other and further reliefs as this Hon&#8217;ble<br \/>\n       Court may deem fit to grant in the facts and<br \/>\n       circumstances of the case.<\/p><\/blockquote>\n<p>      2. Originally, pursuant to the interim orders of this court,<\/p>\n<p>the Government nominated their representative to the<\/p>\n<p>selection committee to be constituted by the petitioner for<\/p>\n<p>selection of teachers, pursuant to which teachers have been<\/p>\n<p>WPC.34037 of 2007<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>selected and appointed. Their appointments have also been<\/p>\n<p>approved by the University. The present subsisting grievance<\/p>\n<p>in this writ petition is that despite the approval granted by the<\/p>\n<p>University for the appointments, salary due to the teachers are<\/p>\n<p>not being disbursed. According to the petitioner, in view of the<\/p>\n<p>Division Bench decision of this Court in State of Kerala Vs.<\/p>\n<p>Arun George(2009(4)KLT 972), the Government cannot<\/p>\n<p>withhold the salary of the teachers whose appointments have<\/p>\n<p>been approved by the University.\n<\/p>\n<p>      3.   The learned Government Pleader on instructions<\/p>\n<p>submits that the Government does not accept that the<\/p>\n<p>approval is proper and valid.\n<\/p>\n<p>      4.  I am of the opinion that if the Government have<\/p>\n<p>objections regarding the approval, they have to take up the<\/p>\n<p>same with the University or challenge the approval granted by<\/p>\n<p>the university appropriately. But as long as the approval<\/p>\n<p>stands the Government cannot deny salary due to the<\/p>\n<p>approved teachers in view of the above said decision and other<\/p>\n<p>decisions of this court. In the above circumstances, I dispose<\/p>\n<p>WPC.34037 of 2007<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>of this writ petition with a direction to respondents 1 to 3 to<\/p>\n<p>disburse the salary due to the approved teachers of the<\/p>\n<p>petitioner&#8217;s college within one month from the date of receipt<\/p>\n<p>of a copy of this judgment, this is without prejudice to the<\/p>\n<p>right of the first respondent to take up the matter regarding<\/p>\n<p>the validity of the approval with the University or to challenge<\/p>\n<p>the approval granted by the University appropriately.<\/p>\n<p>                                     (S.
