Justice M.SASIDHARAN NAMBIAR\n\n Dated :26\/11\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.4655 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner, the husband and second respondent,<\/p>\n<p>the  wife,  are   the  accused   and  the   defacto<\/p>\n<p>complainant respectively in C.C.No.4057\/2010 on the<\/p>\n<p>file of Judicial First Class Magistrate&#8217;s Court,<\/p>\n<p>Irinjalakuda,  taken  cognizance  for  the  offence<\/p>\n<p>under  Section  498A   of  Indian  Penal   Code  on<\/p>\n<p>Annexure-III final report. This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure to<\/p>\n<p>quash  the  proceedings   contending  that   entire<\/p>\n<p>matrimonial  disputes  were  settled  amicably  and<\/p>\n<p>consequent to the settlement, it is not in the<\/p>\n<p>interest of justice to continue the prosecution.<\/p>\n<p>    2. Second respondent appeared through a counsel<\/p>\n<p>and  filed   an  affidavit   stating  that   entire<\/p>\n<p>matrimonial disputes were settled amicably, along<\/p>\n<p>with the other cases pending and consequent to the<\/p>\n<p>settlement, it is not in the interest of justice to<\/p>\n<p><span class=\"hidden_text\">CRMC 4655\/10               2<\/span><\/p>\n<p>continue the prosecution.\n<\/p>\n<p>     3.     Learned   counsel   appearing  for   the<\/p>\n<p>petitioner, second respondent and learned Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>     4. As held by the Apex Court in B.S.Joshi v.<\/p>\n<p>State of Haryana ((2003) 4 SCC 675), when the<\/p>\n<p>matrimonial disputes are settled amicably, it is<\/p>\n<p>not   in    the  interest  of  justice  to stand   on<\/p>\n<p>technicalities and continue the prosecution. The<\/p>\n<p>affidavit    filed  by  the  second  respondent  wife<\/p>\n<p>establishes     that   she   has  settled   all   the<\/p>\n<p>matrimonial disputes with the petitioner. In such<\/p>\n<p>circumstances, it is not in the interest of justice<\/p>\n<p>to continue the prosecution.\n<\/p>\n<p>     Petition is allowed.
