{"id":3272,"date":"2011-08-16T00:00:00","date_gmt":"2011-08-15T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/suresh-singh-and-anr-vs-the-state-of-bihar-on-16-august-2011"},"modified":"2016-10-15T00:17:45","modified_gmt":"2016-10-14T18:47:45","slug":"suresh-singh-and-anr-vs-the-state-of-bihar-on-16-august-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/suresh-singh-and-anr-vs-the-state-of-bihar-on-16-august-2011","title":{"rendered":"Suresh Singh And Anr. vs The State Of Bihar on 16 August, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Suresh Singh And Anr. vs The State Of Bihar on 16 August, 2011<\/div>\n<pre>                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Criminal Miscellaneous No.11740 of 2011\n                                    Suresh Singh And Anr.\n                                              Versus\n                                     The State Of Bihar\n                                  ----------------------------------\n<\/pre>\n<p>4   16-08-2011             Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned counsel for the state assisted by learned counsel for<\/p>\n<p>                 the informant.\n<\/p>\n<p>                           This bail petition is being pressed on behalf of<\/p>\n<p>                 petitioner No. 2, namely, Vijay Kumar @ Vijay Kumar Singh.<\/p>\n<p>                            Petitioner is in custody since 08.12.2010 in a case<\/p>\n<p>                 registered under sections-302\/34 of the of the Indian Penal<\/p>\n<p>                 Code on the allegation that he alongwith three FIR named<\/p>\n<p>                 accused persons gave several blows of Bhujali , Chhura and<\/p>\n<p>                 other weapons to the deceased.\n<\/p>\n<p>                           The contention of learned counsel for the petitioner is<\/p>\n<p>                 that there is no specific allegation of giving any weapon blows<\/p>\n<p>                 against the petitioner and in course of investigation, one<\/p>\n<p>                 witness also claimed to have seen fleeing away the petitioner<\/p>\n<p>                 from place of occurrence but the aforesaid witness has not<\/p>\n<p>                 stated this fact as to what weapon was being carried out by the<\/p>\n<p>                 petitioner at that time.\n<\/p>\n<p>                           On the otherhand, learned counsel appearing for the<\/p>\n<p>                 informant points out that altogether 9 injuries were found on the<\/p>\n<p>                 person of the deceased and out of the aforesaid injuries,<\/p>\n<p>                 several injuries were said to be caused by sharp cutting<\/p>\n<p>                 weapons and the aforesaid fact clearly corroborates the<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>        prosecution story.\n<\/p>\n<p>                    Taking into consideration the aforesaid facts and<\/p>\n<p>        circumstances as well as submission of the parties, I do not feel<\/p>\n<p>        it proper to release the petitioner on bail.<\/p>\n<p>                    Accordingly, prayer for bail of the petitioner in<\/p>\n<p>        connection with Ekma P.S. Case No. 169 of 2010 pending in<\/p>\n<p>        the court of Chief Judicial Magistrate, Saran at Chapra stands<\/p>\n<p>        rejected.\n<\/p>\n<p>                    It appears that the case of the petitioner is still pending<\/p>\n<p>        before the Chief Judicial Magistrate, Saran at Chapra.
