RAMACHANDRA MENON, J.\n                   .........................................\n                    WP (C) No. 18813 of 2010\n                   .........................................\n                Dated this the 17th day of June, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>                          &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>\n      The petitioner is stated as aggrieved of the recovery<\/p>\n<p> proceedings being pursued by the respondents on the<\/p>\n<p> strength of Exhibit P3 and P4 notices issued in the name<\/p>\n<p> of the &#8216;Son&#8217; of the petitioner under the Revenue Recovery<\/p>\n<p> Act, for realization of the amounts stated as due from the<\/p>\n<p> latter. Petitioner&#8217;s case is that the property is belonging<\/p>\n<p> to the petitioner who is in no way liable or responsible<\/p>\n<p> for the liability of the &#8216;Son&#8217; if any.\n<\/p>\n<\/p>\n<p>     2. The &#8216;Son&#8217; of the petitioner by name Sajad, was<\/p>\n<p>running a metal crusher and there was some liability from<\/p>\n<p>him towards alleged sales tax arrears, to be satisfied.<\/p>\n<p>Since the unit was not running on profit, the &#8216;Son&#8217; of the<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><br \/>\n WP (C) No. 18813 of 2010<\/p>\n<p>petitioner subsequently sold the same. On the basis of the<\/p>\n<p>requisition made by the concerned authority, Exhibit P3 and<\/p>\n<p>Exhibit P4 notices have been issued under the Revenue<\/p>\n<p>Recovery Act against the &#8216;Son&#8217; of the petitioner . But the<\/p>\n<p>respondents are stated as trying to implement the said<\/p>\n<p>proceedings, as against the property of the petitioner, in<\/p>\n<p>spite of the fact that the defaulter has no property of his<\/p>\n<p>own.\n<\/p>\n<\/p>\n<p>     3. The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is enjoying the property involved by virtue of<\/p>\n<p>Exhibit P1 and P2 title deeds with absolute ownership and<\/p>\n<p>the Son\/defaulter has absolutely no right or interest over<\/p>\n<p>the same in any manner.\n<\/p>\n<\/p>\n<p>     4. Heard the learned Government Pleader as well.<\/p>\n<p>     5. Considering the fact that, the petitioner has already<\/p>\n<p>exposed his grievances by filing Exhibit P5 representation<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><br \/>\n WP (C) No. 18813 of 2010<\/p>\n<p>before the fourth respondent, this Court finds it fit and<\/p>\n<p>proper to direct the said respondent to consider Exhibit P5<\/p>\n<p>as sought for vide prayer No.3 in the Writ Petition.<\/p>\n<p>     6. Accordingly, the fourth respondent is directed to<\/p>\n<p>consider Exhibit P5 representation and pass appropriate<\/p>\n<p>orders thereon, in accordance with law, after giving an<\/p>\n<p>opportunity of hearing to the petitioner, as expeditiously as<\/p>\n<p>possible, at any rate, within two months from the date of<\/p>\n<p>receipt of a copy of this judgment. It is made clear that, till<\/p>\n<p>final orders are passed on above, no coercive steps shall be<\/p>\n<p>persuade against the petitioner under any circumstances.<\/p>\n<p>        The writ petition is disposed of, as above.<\/p>\n<p>                              P.R.
