Desai waives service of notice of Rule for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.24\/2010 with Ahwa Police Station, District Dang for the<br \/>\n\toffences punishable under Sections 379 and 114 of the Indian Penal<br \/>\n\tCode and U\/s. 26(1)(F) and 41(2) of Indian Forest Act.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tKirit J. Macwan learned Advocate for the applicant  submitted that<br \/>\n\tinvolvement of the applicant in the alleged crime is on the basis of<br \/>\n\ta statement of the co-accused recorded during course of further<br \/>\n\tinvestigation. It is further submitted that the applicant is a<br \/>\n\tfarmer and doing miscellaneous agricultural work as a labourer and<br \/>\n\tthe other co-accused are already enlarged on bail by this Court and<br \/>\n\tconsidering the above, by imposing suitable conditions, the<br \/>\n\tapplicant may be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent-State.\n<\/p>\n<p>Considering<br \/>\n\toverall aspects and likelihood of the availability of the applicant<br \/>\n\tduring course of trial and the fact that the applicant is a casual<br \/>\n\tagricultural labourer belonging to the Scheduled Tribe community, I<br \/>\n\tdeem it just and proper to grant anticipatory bail under Section 438<br \/>\n\tof the Code.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, I am<br \/>\n\tinclined to grant anticipatory bail to the applicant.  This Court<br \/>\n\thas also taken into consideration the law laid down by the Apex<br \/>\n\tCourt in the case of <a href=\"\/doc\/1108032\/\">Siddharam Stalingappa Mhetre v. State of<br \/>\n\tMaharashtra &amp; Ors.<\/a> reported in [2011]1 SCC 694,<br \/>\n\twherein the Apex Court reiterated the law laid down by the<br \/>\n\tConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\n\tSibbia &amp; Ors. reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tI-C.R. No.24\/2010 with Ahwa Police Station, District Dang, the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>(a)<br \/>\n\tshall cooperate with the investigation and make himself available<br \/>\n\tfor interrogation whenever required;\n<\/p>\n<p>(b)<br \/>\n\tshall remain present at the concerned Police Station on 27th<br \/>\n\tFebruary, 2011 between 11.00 am to 2.00 pm;\n<\/p>\n<p>(c)<br \/>\n\tshall not hamper the investigation in any manner nor shall directly<br \/>\n\tor indirectly make any inducement, threat or promise to any witness<br \/>\n\tso as to dissuade them from disclosing such facts to the Court or to<br \/>\n\tany Police Officer;\n<\/p>\n<p>(d)<br \/>\n\tshall at the time of execution of bond, furnish the address to the<br \/>\n\tInvestigating Officer and the Court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case or till further<br \/>\n\torders;\n<\/p>\n<p>(e)<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\n\tholding a Passport, shall surrender the same before the trial Court<br \/>\n\timmediately;\n<\/p>\n<p>(f)<br \/>\n\tIt would be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits.\n<\/p>\n<p>(g)<br \/>\n\tdespite this order, it would be open for the Investigating Agency to<br \/>\n\tapply to the competent Magistrate, for police remand of the<br \/>\n\tapplicant.  The applicant shall remain present before the learned<br \/>\n\tMagistrate on the first date of hearing of such an application and<br \/>\n\ton all subsequent occasions, as may be directed by the learned<br \/>\n\tMagistrate.  This would be sufficient to treat the accused in the<br \/>\n\tjudicial custody for the purpose of entertaining application of the<br \/>\n\tprosecution for police remand.  This is, however, without prejudice<br \/>\n\tto the right of the accused to seek stay against an order of remand,<br \/>\n\tif ultimately granted, and the power of the learned Magistrate to<br \/>\n\tconsider such a request in accordance with law.  It is clarified<br \/>\n\tthat the applicant, even if, remanded to the police custody, upon<br \/>\n\tcompletion of such period of police remand, shall be set free<br \/>\n\timmediately, subject to other conditions of this anticipatory bail<br \/>\n\torder.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
