The learned Judge has appreciated the<br \/>\nevidence of the complainant &#8211; Sumaben Fakrubhai Meda &#8211;<br \/>\nExh.9.  The learned Judge has appreciated the evidence of Badliben<br \/>\nNarubhai Meda &#8211; Exh.12 in para-10.  The learned Judge has also<br \/>\nappreciated the evidence of Thavriben Fatiyabhai Meda &#8211; Exh.15<br \/>\nin para-11.  While appreciating evidence of all these witnesses, the<br \/>\nlearned Judge has given cogent reasons for not believing the<br \/>\nevidences of all these witnesses.  The learned Judge has rightly<br \/>\nnoted that after having stated that the witnesses had seen the<br \/>\naccused putting house on fire, have admitted that from the hand-pump<br \/>\nor from the place they are stating that they have seen the incident,<br \/>\nonly top of the house was visible.  That being so, they could not<br \/>\nhave witnessed the person putting the house on fire.  The witnesses<br \/>\nhave also admitted that distance at which they are at the time of<br \/>\nincident is about 1 km.\n<\/p>\n<p>5.\t\tTaking into<br \/>\nconsideration the totality of the facts of the case and the reasoning<br \/>\ngiven by the learned Judge, this Court is of the opinion that that<br \/>\nthe learned Judge has rightly recorded acquittal for the offences<br \/>\nalleged against the accused.
