UDAYABHANU, JJ.\n\n\n    ==============================\n\n\n             W.A.NOS.2118 &amp; 2322 OF 2005\n\n\n    ============================\n\n\n DATED THIS THE 5TH DAY OF DECEMBER   2006\n\n\n                            JUDGMENT\n<\/pre>\n<p>Abdul Gafoor,J.\n<\/p>\n<\/p>\n<p>       These appeals are filed against the interim orders<\/p>\n<p>passed by a learned Single Judge in W.P.C.Nos.28528<\/p>\n<p>&amp;   28281\/2005   wherein   reversions   of   the     appellants<\/p>\n<p>have   been   challenged.     The   learned   Single   Judge  did<\/p>\n<p>not   grant   stay   of   reversions,     but   made   it   clear   that<\/p>\n<p>such   reversion   shall   be   subject   to   result   of   the   writ<\/p>\n<p>petitions.  The appellants\/writ petitioners have  carried<\/p>\n<p>the   matter   in     these   appeals   seeking   for   stay   of<\/p>\n<p>reversion.  When reversions are  not stayed, exercising<\/p>\n<p>the discretion vested in the learned Single Judge and in<\/p>\n<p>case   the   writ   petitions   finally   allowed,   they   can   be<\/p>\n<p><span class=\"hidden_text\">WA.2118 &amp; 2322\/2005                  -2-<\/span><\/p>\n<p>     restored   to the   status quo ante or granted adequate<\/p>\n<p>     compensation as if   they had not been reverted, such<\/p>\n<p>     discretion  cannot be  stated to be unjustified.   In this<\/p>\n<p>     regard, conclusion No.2 reached in the decision of this<\/p>\n<p>     Court   in  K.S.Das   v.   State   of   Kerala,[1992(2)KLT<\/p>\n<p>     358(F.B.)] may be noticed.  It reads:<\/p>\n<blockquote><p>           &#8220;But   this   does   not   mean   that   the   Division<\/p>\n<p>           Bench   hearing   the   appeal   against     such<\/p>\n<p>           `orders&#8217; will have   to admit the   appeal or<\/p>\n<p>           have  to   modify  the   impugned  order   or   set<\/p>\n<p>           it aside the same in every   case.   There is<\/p>\n<p>           difference   between   the   question   whether<\/p>\n<p>           an appeal lies to a Division Bench and as to<\/p>\n<p>           the   scope     of   interference.   Normally,<\/p>\n<p>           discretionary orders are not interfered with<\/p>\n<p>           unless     the   impugned   orders   are   without<\/p>\n<p>           jurisdiction,   contrary   to   law,   or   are<\/p>\n<p>           perverse,   and   they   also   cause     serious<\/p>\n<p>           prejudice   to   the   parties   in   such   a   manner<\/p>\n<p>           that   it   might   be   difficult   to   restore   the<\/p>\n<p>           status   quo     ante   or   grant   adequate<\/p>\n<p>           compensation.   The   idea   is   to   provide   an<\/p>\n<p>           internal   remedy   in   such   cases   without<\/p>\n<p><span class=\"hidden_text\">WA.2118 &amp; 2322\/2005                     -3-<\/span><\/p>\n<p>             compelling the parties to go all the way to<\/p>\n<p>             the Supreme Court under Article 136 of the<\/p>\n<p>             Constitution of India or increase the burden<\/p>\n<p>             of that court unnecessarily.&#8221;<\/p><\/blockquote>\n<p>             In   the   light   of   this   decision,   the   interim   order<\/p>\n<p>       passed     in   exercise   of   the   discretion   of   the   learned<\/p>\n<p>       single   Judge   cannot   be   interfered   as   if   the     original<\/p>\n<p>       petitions are allowed, the appellants can be restored to<\/p>\n<p>       their eligible positions with necessary benefit.   Hence,<\/p>\n<p>       the writ appeals are dismissed.
