SASARAM\n                      (TOWN), DISTRICT-ROHTAS.\n                                               --PETITIONER\n\n                                           Versus\n\n                      THE STATE OF BIHAR               --OPP.PARTY\n\n\n3   28.09.2010<\/pre>\n<p>                Since both these applications arise out of one<\/p>\n<p>                 case, with the consent it is being disposed of by one common<\/p>\n<p>                 order.\n<\/p>\n<p>                              Heard learned counsel for the petitioner and<\/p>\n<p>                 learned Additional Public Prosecutor for the State.<\/p>\n<p>                              Petitioners are named accused in this case<\/p>\n<p>                 carrying allegation of committing defalcation of a sum of<\/p>\n<p>                 Rs.2,58, 600\/- provided for distribution of bicycle to the girl<\/p>\n<p>                 students of the School wherein they are serving as teachers.<\/p>\n<p>                 During the course of argument, the petitioners undertake to<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>         deposit the amount subject to final decision of the case.<\/p>\n<p>                      Considering the facts and circumstances, the<\/p>\n<p>         petitioners, in the event of each of them depositing<\/p>\n<p>         Rs.1,30,000\/- (Rupees one lac thirty thousand) within six<\/p>\n<p>         weeks from today and in the event of their surrender or arrest<\/p>\n<p>         within the same period, are directed to be enlarged on bail<\/p>\n<p>         on each of them furnishing bonds of Rs.10,000\/- (Rupees ten<\/p>\n<p>         thousand) with two sureties of the like amount each to the<\/p>\n<p>         satisfaction of the Chief Judicial Magistrate, Rohtas, in<\/p>\n<p>         Sasaram (Town) P.S. Case no. 505 of 2010, subject to the<\/p>\n<p>         conditions laid down in Section 438(2) of the Code of<\/p>\n<p>         Criminal Procedure with additional condition that the<\/p>\n<p>         petitioners shall remain present before the court below till<\/p>\n<p>         disposal of the case.
