Justice M.SASIDHARAN NAMBIAR\n\n Dated :18\/08\/2009\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.2489 of 2009\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    Petitioners are the accused in C.C.No.705\/2008 on<\/p>\n<p>the file of Judicial First Class Magistrate&#8217;s Court,<\/p>\n<p>North Paravur. Prosecution case is that petitioners<\/p>\n<p>formed themselves into unlawful assembly on 1.6.2008 at<\/p>\n<p>about 7 p.m. and in furtherance of their common object,<\/p>\n<p>attacked second respondent Hari and inflicted injury on<\/p>\n<p>him and when third accused intervened, he was also<\/p>\n<p>beaten  and  hurt  was   caused  to  him   and  thereby<\/p>\n<p>petitioners committed offences under Sections 143, 147,<\/p>\n<p>148, 323 and 324 read with Section 149 of Indian Penal<\/p>\n<p>Code. This petition is filed under Section 482 of Code<\/p>\n<p>of Criminal Procedure to quash the case contending that<\/p>\n<p>the entire disputes with respondents 2 and 3 were<\/p>\n<p>amicably settled and in such circumstances, it is not,<\/p>\n<p>in the interest of justice, to proceed with the case.<\/p>\n<p>    2. Respondents 2 and 3 appeared through a counsel<\/p>\n<p>and filed separate affidavits stating that all the<\/p>\n<p>disputes with the petitioners were amicably settled and<\/p>\n<p>in such circumstances, they have no objection for<\/p>\n<p><span class=\"hidden_text\">CRMC 2489\/09               2<\/span><\/p>\n<p>quashing the proceedings.\n<\/p>\n<p>     3. Learned counsel appearing for the petitioners,<\/p>\n<p>respondents 2 and 3 and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>     4.    Annexure-1 final   report  shows   that  the<\/p>\n<p>allegation against the petitioners is that they formed<\/p>\n<p>themselves into unlawful assembly and caused hurt to<\/p>\n<p>third respondent by beating with hands and kicking with<\/p>\n<p>legs and caused hurt to second respondent by hitting<\/p>\n<p>with   a   stone  and  thereby  committed  the  alleged<\/p>\n<p>offences. When injuries are minor and the disputes with<\/p>\n<p>the petitioner and respondents 2 and 3 were amicably<\/p>\n<p>settled, as held by the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot<\/p>\n<p>v. State of Punjab<\/a> (2008 (3) KLT 19), it is not in the<\/p>\n<p>interest of justice to proceed with the case further,<\/p>\n<p>when,  consequent   to the  settlement,  chances  of  a<\/p>\n<p>successful prosecution is very bleak.<\/p>\n<p>     Petition is allowed.
