1.          This appeal has been preferred against interim order granted by<\/p>\n
the learned Single Judge allowing the respondent to be shifted from the<\/p>\n
discipline of Electrical Engineering to the discipline of Information<\/p>\n
Technology against one of the available seats.<\/p>\n
2.          The respondent is student of B.Tech (Electrical Engineering)<\/p>\n
and was admitted for the academic Session 2008-09. He appeared in the<\/p>\n
first semester examination conducted by the University. In 1st Semester<\/p>\n
examination, he was awarded 8.38 Semester Grade Point Average (for<\/p>\n
short,”SGPA”) whereas      in 2nd Semester examination,      he was awarded<\/p>\n
SGPA 9.55. He applied for shifting of Branch from Electrical Engineering<\/p>\n
to Information Technology, for which minimum SGPA required was 9,<\/p>\n
whereas his SGPA was 8.98. His claim was declined by the University as he
\n LPA No. 991 of 2009                                         [2]<\/p>\n
was not having the required SGPA, which was challenged by way of writ<\/p>\n
petition on the ground that the formula of rounding up should be applied<\/p>\n
and 4 seats are available in the Information Technology Branch. The<\/p>\n
appellant-University contested his claim stating that he did not fulfil the<\/p>\n
eligibility condition for change of      Branch    given in the Rules and<\/p>\n
Procedures of University Grants Programs. Moreover, the writ petition was<\/p>\n
highly belated as sessional assessment was already over and second<\/p>\n
semester was due, as the semester ends in December 2009.<\/p>\n
3.          Learned Single Judge admitted the writ petition and interim<\/p>\n
direction was issued to the University to permit the writ petitioner for<\/p>\n
shifting from the discipline of Electrical Engineering to the discipline of<\/p>\n
Information Technology against the vacant available seats.<\/p>\n
4.          The ground for challenging the interim direction is that the<\/p>\n
respondent did not fulfil the eligibility condition for change of branch given<\/p>\n
in Rules and Procedures of University Grant Programs. Only those students<\/p>\n
whose SGPA is 9 are eligible to be considered for change of branch.<\/p>\n
Moreover, the writ petition was filed          belatedly    as the semester<\/p>\n
examination had already commenced on 31st July, 2009 and first sessional<\/p>\n
assessment had already been over and the 2nd sessional examination was<\/p>\n
due on 26th October, 2009.\n<\/p>\n
5.          We have heard learned counsel for the parties and also gone<\/p>\n
through the order passed by the learned Single Judge.<\/p>\n
6.          The writ petition was filed at a very late stage as last date for<\/p>\n
applying change of branch was 26.6.2009 for which a notice was also<\/p>\n
displayed on the University board and much of his studies had already been
\n LPA No. 991 of 2009                                        [3]<\/p>\n
completed and the examination of the 2nd Semester is likely to be<\/p>\n
commenced in December 2009.          The contention of the respondent for<\/p>\n
rounding up of marks cannot be accepted as it is different from CGPA<\/p>\n
which is based on the decision taken by the senate and that decision has not<\/p>\n
been challenged by the respondent. The said decision of the senate is<\/p>\n
reproduced as under:\n<\/p>\n<\/p>\n
            ” Minutes of 17th meeting of Senate of Punjab<\/p>\n

            p.m.   in   the   Conference    Hall   of   Punjab<\/p>\n

            17.11 Any other item.\n<\/p><\/blockquote>\n
            Calculation and Recording of Grade Point<\/p>\n
            Average(GPA) upto two decimal places.<\/p><\/blockquote>\n
            Ever since the adoption of the grading system in<\/p>\n
            2005, we have been calculating and specifying<\/p>\n
            the SGPA of students on their grade sheets upto<\/p>\n
            one decimal place only. However, in certain<\/p>\n
            situations, where a merit list of the students is to<\/p>\n
            be prepared, a need is felt to have these<\/p>\n
            calculated up to two decimal place. For<\/p>\n
            instance,to decide the relative merit of students<\/p>\n
            for change of branch at the end of first year, the<\/p>\n
            CGPA had to be calculated kupto two decimal<\/p>\n
            places to resolve a tie between students having
\n LPA No. 991 of 2009                                         [4]<\/p>\n
            same CGPA up to one decimal place. Another<\/p>\n
            situation which may require such calculation,<\/p>\n
            could arise while deciding the award of gold<\/p>\n
            medal to a student for standing first in his\/her<\/p>\n
            branch.\n<\/p>\n
                         It is, therefore, proposed that the<\/p>\n
            SGPA and CGPA may henceforth be calculated<\/p>\n
            and reported up to two decimal place.\n<\/p>\n
            17.11. Calculation and recording of grade Point<\/p>\n
            average     (GPA)       up      to   two    decimal<\/p>\n
            places….Accepted.”\n<\/p>\n<\/p>\n
7.          Keeping in view the interest of the students and the University,<\/p>\n
some time limit is to be fixed for changing from one branch to another and<\/p>\n
all the students, including the respondent, were free to exercise their option<\/p>\n
within the prescribed time limit.        The respondent did not exercise his<\/p>\n
option during that prescribed period. If he is allowed to change the branch,<\/p>\n
then other students would like to change their branches and this practice<\/p>\n
would continue and there would be no end to it. The decision taken by the<\/p>\n
Senate is the decision of the experts and is based on the interest of the<\/p>\n
students and the standard of education.\n<\/p>\n
8.          No doubt, we have sympathy and sentiment in our mind for the<\/p>\n
career of the students but that cannot be a ground for passing an order in<\/p>\n
relation thereto as the respondent has no legal right and much time has<\/p>\n
already passed. Therefore, to pass an order in contravention of a statutory
\n LPA No. 991 of 2009                                       [5]<\/p>\n
provision is not proper and justified. This view has been upheld by the<\/p>\n
Hon’ble Supreme Court in Maruti Udyog Ltd v. Ram Lal & others<\/a><\/p>\n
[2005] 2 SCC 638, wherein it was observed as under:<\/p>\n
            ” While construing a statute, sympathy has no<\/p>\n
            role to play. This Court cannot interpret the<\/p>\n
            provisions of the said Act ignoring the binding<\/p>\n
            decisions of the Constitution Bench of this Court<\/p>\n
            only by way of sympathy to the workmen<\/p>\n
            concerned.”\n<\/p><\/blockquote>\n
In Latham v. Richard Johnson and Nephew Ltd [1911-13] All England<\/p>\n
Law Reports Rep. page 117 also the following observation has been made:<\/p>\n
            “We must be very careful not to allow our<\/p>\n
            sympathy with the infant plaintiff to affect our<\/p>\n
            judgment. Sentiment is a dangerous will o’ the<\/p>\n
            wisp to take as a guide in the search for legal<\/p>\n
            principles.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
9.          Keeping in view the above discussion, the appeal is allowed<\/p>\n
and interim order passed by the learned Single Judge is vacated.<\/p>\n
