Commissioner,<br \/>\nCommercial Taxes, Jaipur.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     This appeal  by special leave arises from the order and<br \/>\njudgment dated\tApril 18,  1991 made  in Sales\tTax Revision<br \/>\nNo.110 of 1987 by the High Court of Rajasthan, Jaipur Bench.<br \/>\nThe respondent-State exercising the power under Section 4(2)<br \/>\nof the Rajasthan Sales Tax Act, 1954, (for short, the &#8216;Act&#8217;)<br \/>\nby a  notification dated  March 9, 1970 had exempted I Papad<br \/>\nand Badi,  i.e. Mangori\t from sales  tax. When the appellant<br \/>\nmade an application for exemption of Gole Papad manufactured<br \/>\nout of\tMaida, Salt Starch, Papad Soda, Alum and Food colour<br \/>\nfrom sales  tax under  the  above  notification,  the  Addl.<br \/>\nCommissioner by\t proceedings dated  27.8.82 held  that\tGole<br \/>\nPapad was  no covered  by the  notification. When the appeal<br \/>\ncame to\t be filed, the Sales Tax Tribunal by its order dated<br \/>\n17.3.86 allowed\t the appeal  and held  that the notification<br \/>\nwould govern all variety of Papad. whether they are circular<br \/>\nor flat\t in shape  consisting of all the ingredients whether<br \/>\nit is  pulses, rice,  maida, etc. When the State carried the<br \/>\nmatter in  revision, it came to be allowed by the High Court<br \/>\nand it\theld that  the appellant  is  not  entitled  to\t the<br \/>\nexemption. Thus this appeal by special leave.\n<\/p>\n<p>     It is  seen that the notification clearly mentions that<br \/>\nthe word  &#8216;Papad&#8217; has  been used a genus and its species are<br \/>\nmade from  pulses, rice,  maida, potato,  sago etc.  In\t the<br \/>\nnotification the  words &#8220;Papad\tand Badi&#8221;, i.e. Mangori have<br \/>\nbeen used  while in entry No.3 of the notification after the<br \/>\nwords  &#8220;letter\t head  pads&#8221;  the  words  &#8220;other  stationery<br \/>\narticles made  of handmade  paper&#8221; have\t been  used  meaning<br \/>\nthereby that entry No.3 is not restricted to only invitation<br \/>\ncards, envelopes,  file covers,\t letter head  pads but\talso<br \/>\nincludes other\tstationery articles  made of handmade paper.<br \/>\nThe question  is:  whether  the\t ingredients  of  papad\t are<br \/>\nexclusively composed  of the  pulses or\t maida or rice, etc?<br \/>\nWhen the  notification mentions papad and Badi, i.e. Mangori<br \/>\nit would  appear that  they did\t not intend to differentiate<br \/>\nbetween gole or flat papad made of any ingredient.\n<\/p>\n<p>     Under  those   circumstances  it\tappears\t  that\t the<br \/>\ninterpretation given  by the  High Court  is not correct and<br \/>\nthat of Tribunal is correct.\n<\/p>\n<p>     The appeal is allowed and if there is any difficulty it<br \/>\nwould be  open to the Govt. to make necessary declaration in<br \/>\nexemption notification itself by way of amendment.
