Justice KURIAN JOSEPH\n\n Dated :24\/09\/2008\n\n O R D E R\n                          KURIAN JOSEPH, J.\n               ---------------------------------------\n                   W.P.(C) No.25087 OF 2006\n               ---------------------------------------\n         Dated this the 24th day of September, 2008.\n\n\n                           J U D G M E N T\n<\/pre>\n<p>      This writ petition is filed with the following prayers:<\/p>\n<p>      i)   To issue a Writ of Mandamus or other appropriate writ,<\/p>\n<p>           order or direction directing the 1st respondent to count<\/p>\n<p>           the provisional service rendered by the petitioner in the<\/p>\n<p>           Corporation from 24.12.1979 to 20.07.1987 for the<\/p>\n<p>           purpose of increments and disburse all monetary<\/p>\n<p>           benefits from due dates with arrears.<\/p>\n<p>      ii)  To issue a Writ of Mandamus or other appropriate writ,<\/p>\n<p>           order or direction declaring that the petitioner is entitled<\/p>\n<p>           to count the provisional service rendered by the<\/p>\n<p>           petitioner in the Corporation before 01.10.1994 for the<\/p>\n<p>           purpose of increments, fixation of pay, pensionary<\/p>\n<p>           benefits and other service benefits.<\/p>\n<p>      It appears, apparently, the issue is covered in favour of the<\/p>\n<p>petitioner by the decisions of this Court in <a href=\"\/doc\/1768075\/\">State of Kerala vs.<\/p>\n<p>Ponnamma<\/a> (2005(4)KLT 987(FB)) and Idicula Abraham<\/p>\n<p>vs. K.S.R.T.C and others (2005(2)KLJ 602).<\/p>\n<p>      2. There will be a direction to the first respondent to take<\/p>\n<p>appropriate action in the case of the petitioner on Exhibits P7 and<\/p>\n<p>P8 representations, in the light of the decisions referred to above,<\/p>\n<p>with notice to the petitioner, within a period of three months<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25087\/06                2<\/span><\/p>\n<p>from the date of production of a copy of this judgment along with<\/p>\n<p>copy of the judgments referred to above.
