He was<br \/>\nalso tried for offence punishable under Section 135 of the Bombay<br \/>\nPolice Act. However, the trial Court found that the offences of<br \/>\nmurder and causing hurt punishable under Sections 302 and 323 of IPC<br \/>\nwere proved against him and the offence punishable under Section 135<br \/>\nof the Bombay Police Act was not proved by the prosecution. The trial<br \/>\nCourt, therefore, convicted the appellant of the offences punishable<br \/>\nunder Section 302 and 323 of IPC and sentenced him to undergo<br \/>\nimprisonment for life with a fine of Rs.1,000\/-, in default, RI for<br \/>\ntwo months, and for the offence of causing hurt with RI for 6 months<br \/>\nrespectively. The trial Court acquitted the appellant for the offence<br \/>\npunishable under Section 135 of the Bombay Police Act. Hence, this<br \/>\nappeal.\n<\/p>\n<p>2.\tAs<br \/>\nper the prosecution case, the incident occurred around 4-00 PM on<br \/>\n1.6.2002 in the osri of house of the victim Chhaganbhai located at<br \/>\nvillage Guda Tal. Chhota Udepur. The appellant was allegedly<br \/>\nquarrelling  with his sister and at that time Jiniabhai as well as<br \/>\nvictim Chhaganbhai intervened and, therefore, the appellant assaulted<br \/>\nthem with wooden pestle. Jiniabhai suffered multiple injuries whereas<br \/>\nChhaganbhai was dealt with a blow on his head and another on his<br \/>\nmandible. The head injury ultimately resulted into death of<br \/>\nChhaganbhai and, therefore, an FIR was lodged by PW-4  Chimanbhai. On<br \/>\nthe basis of that FIR the police investigated the case and filed<br \/>\nchargesheet in the Court of JMFC, Chhota Udepur, who in turn<br \/>\ncommitted the case to the Court of Sessions and Sessions Case No.79<br \/>\nof 2002 came to be registered.\n<\/p>\n<p>2.1\t\tCharge<br \/>\nwas framed against the accused at Exh.6 for the offences punishable<br \/>\nunder Sections 302 and 326 of IPC and 135 of the Bombay Police Act<br \/>\nto which the accused pleaded not guilty and came to be tried.\n<\/p>\n<p>2.2.\t\tAt<br \/>\nthe end of trial, the Sessions Court found that the charge<br \/>\npunishable under Sections 302 of IPC and 323 of IPC were proved<br \/>\nagainst the appellant and, therefore, recorded his conviction for the<br \/>\nsaid offences and awarded sentences as stated in the earlier part of<br \/>\nthis judgment. The Sessions Court acquitted the appellant of charge<br \/>\nof offence punishable under Section 135 of the Bombay Police Act. The<br \/>\nsentences were ordered to run concurrently. The benefit of set off<br \/>\nwas also given to the appellant.\n<\/p>\n<p>3.\tThe<br \/>\nappellant&#8217;s prayer for suspension of sentence and grant of bail was<br \/>\nrejected. The appellant absconded from 12.1.2008 till 8.10.2009 for a<br \/>\nperiod of 636 days and at present he is in jail since 8.10.2009.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Ms Banker appearing for the appellant submitted that the<br \/>\nincident was witnessed by PW 4, 5 and 6 namely Chimanbhai, Velkiben<br \/>\nand Jiniabhai. They have deposed at Exhs. 22, 23 and 24 respectively<br \/>\nand clearly implicated the appellant. She is, therefore, not in a<br \/>\nposition to assail the judgment so far as the involvement of the<br \/>\nappellant is concerned.\n<\/p>\n<p>4.1\t\tMs<br \/>\nBanker submitted that the appellant would only challenge the<br \/>\nconviction under Section 302 of IPC. Admittedly, the incident<br \/>\noccurred all of a sudden, there was no premeditation alleged. The<br \/>\ndeceased intervened in a quarrel between the appellant and his sister<br \/>\nand was dealt with a single blow on his head, which proved to be<br \/>\nfatal. There could not have been  any intention on the part of the<br \/>\nappellant to cause death of the victim  Chhaganbhai and, therefore,<br \/>\nthe trial Court erred in convicting the appellant for the offence of<br \/>\nmurder. Ms Banker, therefore, submitted that the conviction may be<br \/>\naltered accordingly.\n<\/p>\n<p>5.\tLearned<br \/>\nAPP Mr Mengdey has opposed the appeal. According to him, the<br \/>\nintention may creep in any moment. It is the mental status and has to<br \/>\nbe inferred from the conduct of the accused. The accused has turned<br \/>\non the victim Chhaganbhai the moment Chhaganbhai intervened in the<br \/>\nquarrel between the accused &#8211; appellant and his sister. It has come<br \/>\nin evidence during cross-examination that Chhaganbhai did not offer<br \/>\nany provocation to the appellant and, therefore, none of the<br \/>\nexception to Section 300 would be attracted. The conviction is,<br \/>\ntherefore, rightly recorded and the appeal may be dismissed.\n<\/p>\n<p>6.\tWe<br \/>\nhave examined the record and proceedings in context of rival side<br \/>\nsubmissions.\n<\/p>\n<p>7.\tAt<br \/>\nthe outset, we may record that after going through the evidence of<br \/>\nfirst informant Chimanbhai PW -4, Velkiben PW-5 and Jiniabhai PW-6,<br \/>\nwho are all eye-witnesses to the incident, Ms Banker was justified in<br \/>\nnot pressing for a clean acquittal on the ground of non-involvement<br \/>\nof the appellant. These witnesses clearly indicated how the incident<br \/>\noccurred and how the appellant reacted to intervention by Jiniabhai<br \/>\nand Chhaganbhai.\n<\/p>\n<p>8.\tThe<br \/>\nonly question, therefore, that requires to be considered is whether<br \/>\nthe case would call for the punishment under Section 302 of IPC or<br \/>\n304 of IPC.\n<\/p>\n<p>9.\tUpon<br \/>\nreading the evidence of the eye-witnesses, it is clear that the<br \/>\nappellant was quarrelling with his sister and when the deceased<br \/>\nintervened, he inflicted blows with wooden pestle. One blow landed on<br \/>\nthe head whereas the other blow landed near the mandible on the neck<br \/>\nof the deceased. This would show that he inflicted  at least two<br \/>\nblows on the vital part of the body. It is true that he could not<br \/>\nhave anticipated intervention by deceased Chhaganbhai, but when<br \/>\nChhaganbhai intervened he has given blow on head of Chhaganbhai with<br \/>\nwooden pestle with force, which damaged the skull of Chhaganbhai so<br \/>\nalso the brain resulting into his death. The picture, therefore, that<br \/>\nemerges is that when the incident started the appellant did not have<br \/>\nany intention of causing death of Chhaganbhai, but when Chhaganbhai<br \/>\nintervened the appellant inflicted two blows on vital part of the<br \/>\nvictim namely, head and mandible, which ultimately resulted into<br \/>\ndeath of victim Chhaganbhai. The injuries were sufficient in the<br \/>\nordinary course of nature to cause death as testified by Dr. R.R.<br \/>\nUpadhyay Exh.16. In our opinion, therefore, the case would attract<br \/>\nthe provisions contained in Section 304 Part-I and not 302 IPC. The<br \/>\ntrial Court was, therefore, in error in convicting the appellant for<br \/>\nthe offence of murder of Chhaganbhai. The appellant may not have<br \/>\nintended to cause death of Chhaganbhai, but he certainly had<br \/>\nintention of causing such bodily injury which was likely to cause his<br \/>\ndeath and, therefore, the conviction of the appellant has to be<br \/>\naltered from one punishable under Section 302 of IPC to 304 Part-I of<br \/>\nIPC so far as the involvement of the appellant in the incident<br \/>\nresulting into death of Chhaganbhai is concerned.\n<\/p>\n<p>10.\tSo<br \/>\nfar as conviction of the appellant under Section 323 of IPC is<br \/>\nconcerned, we find from the medical evidence of Dr Avniben Prathmesh<br \/>\nExh.12  and Dr. Pravinaben Pravinchandra Exh.20 that there were<br \/>\nmultiple injuries in the form of CLWs found on person of Jiniabhai.<br \/>\nThe injuries were simple in nature and the trial Court was,<br \/>\ntherefore, justified in convicting the appellant under Section 323 of<br \/>\nIPC. No appeal against acquittal under Section 326 is preferred by<br \/>\nthe State and, therefore, no interference is called for in that part<br \/>\nof the finding of the trial Court. Having found that the conviction<br \/>\nof the appellant under Section 323 is well founded, we do not deem it<br \/>\nproper to interfere with the quantum of sentence.\n<\/p>\n<p>11.\tSo<br \/>\nfar as the other offence is concerned, as discussed earlier, the<br \/>\nconviction of the appellant under Section 302 of IPC would stand<br \/>\naltered to conviction under Section 304 Part-I of IPC.\n<\/p>\n<p>12.\tWe<br \/>\nhave heard learned advocate Ms Banker on the question of quantum so<br \/>\nalso learned APP.\n<\/p>\n<p>13.\tMs<br \/>\nBanker submitted that the appellant is a victim of circumstances<br \/>\nwhere his act has resulted into death of his own brother. There were<br \/>\nno disputes between the brothers earlier. The appellant hails from a<br \/>\nless educated strata of Society, has three children to take care of<br \/>\nand, therefore, minimum sentence may be awarded.\n<\/p>\n<p>14.\tMr<br \/>\nMengdey has submitted that the appellant absconded for 636 days and<br \/>\nhas actually undergone sentence of 5 years 10 months and 24 days. He<br \/>\nmay be appropriately punished.\n<\/p>\n<p>15.\tHaving<br \/>\nregard to the circumstances of the case, we are of the view that the<br \/>\nends of justice would be met if the appellant is awarded RI for 8<br \/>\n(eight) years  with no change in fine.\n<\/p>\n<p>16.\tFor<br \/>\nthe foregoing reasons, the appeal is partly allowed. The conviction<br \/>\nof the appellant under Section 323 of IPC is confirmed. So far as the<br \/>\nconviction of the appellant under Section 302 of IPC is concerned,<br \/>\nthe same is altered to conviction under Section 304 Part-I of IPC and<br \/>\ntherefore, the sentence awarded by the trial Court is altered and the<br \/>\nappellant is awarded RI for 8 years with no change in fine. Both the<br \/>\nsentences would run concurrently and the appellant would also be<br \/>\nentitled for the benefit of set off.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.L.\n<\/p>\n<p>DAVE, J.)<\/p>\n<p>\t\t\t\t\t\t\t(BANKIM<br \/>\nN.
