Justice ANTONY DOMINIC\n\n Dated :05\/10\/2010\n\n O R D E R\n                    ANTONY DOMINIC, J.\n                     -----------------------------\n                  W.P.(C) No.22984 of 2009\n                  -----------------------------------\n          Dated this the 5th day of October 2010\n\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioner is a company incorporated under the provisions<\/p>\n<p>of Companies Act,1956. Ext.P1 is the certificate of Incorporation<\/p>\n<p>and Exts.P2 and P3 are the Memorandum and Articles of<\/p>\n<p>Association of the Company.\n<\/p>\n<p>      2.    The company purchased a property having an extent<\/p>\n<p>of 50 cents situated in Re-Sy.No.609\/9 and 609\/9A of Edava<\/p>\n<p>Village in Chirayinkeezhu Taluk in Thiruvananthapuram District.<\/p>\n<p>When applications were made for mutating the property into the<\/p>\n<p>name of the Company, orders were not passed. Although the<\/p>\n<p>petitioner approached the Kerala Lok Ayuktha by filing<\/p>\n<p>Complaint No.130\/2009, for orders directing to effect mutation,<\/p>\n<p>the attempt was not successful. It is in these circumstances, this<\/p>\n<p>writ petition has filed for directing the respondents to make<\/p>\n<p>necessary entries and to effect mutation in the name of the<\/p>\n<p>W.P.(C) No.22984 of 2009<\/p>\n<p><span class=\"hidden_text\">                               -: 2 :-<\/span><\/p>\n<p>petitioner Company.\n<\/p>\n<p>      3.   The learned Government Pleader reports that the<\/p>\n<p>District Collector vide his letter dated 1.7.2010 has issued<\/p>\n<p>directions to the Additional Tahasildar, Chirayinkeezhu to effect<\/p>\n<p>the mutation of the aforesaid property into the name of the<\/p>\n<p>petitioner company after observing the formalities provided in<\/p>\n<p>the Transfer of Registry Rules.\n<\/p>\n<p>           Now that a direction as above has been issued by the<\/p>\n<p>District Collector, without examining the merits of the<\/p>\n<p>contention raised, this writ petition is disposed of recording the<\/p>\n<p>submission made by the learned Government Pleader and<\/p>\n<p>directing that if mutation is not already effected, the 4th<\/p>\n<p>respondent shall effect mutation of the property as sought for by<\/p>\n<p>the petitioner as expeditiously as possible at any rate, within four<\/p>\n<p>weeks from the date of production of a copy of this judgment.<\/p>\n<p>                                ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>Jvt<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Anabas School Of Yoga Pvt.Ltd vs The State Of Kerala on 5 October, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 22984 of 2009(P) 1.
