Balachandran, J.\n            ---------------------------\n            C.M.Appl.No.384 of 2008 in\n               R.S.A.No.458 of 2008\n            ---------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    This is an application for condonation of delay<\/p>\n<p>of 636 days in filing the appeal. The judgment<\/p>\n<p>assailed was pronounced on 16.11.2005. Copy thereof<\/p>\n<p>was applied for only on 29.9.2007 and though the<\/p>\n<p>copy of the judgment was taken delivery of on<\/p>\n<p>23.10.2007,  this  appeal  is  presented  only   on<\/p>\n<p>4.12.2007.\n<\/p>\n<p>    2.  In  the   affidavit  filed  by  the   third<\/p>\n<p>appellant  in  support   of  the  application   for<\/p>\n<p>condonation of delay, the averments are that the<\/p>\n<p>first  appellant  was  looking  after  the  affairs<\/p>\n<p>regarding  the  appeal   on  behalf   of  all  the<\/p>\n<p>appellants; that he instructed their Advocate to<\/p>\n<p>apply for and obtain certified copies of judgment<\/p>\n<p>and decree for the purpose of filing appeal and he<\/p>\n<p>promised to do so; that thereafter also the first<\/p>\n<p>appellant kept on going to the office of the<\/p>\n<p><span class=\"hidden_text\">RSA 458\/08               2<\/span><\/p>\n<p>counsel to ascertain whether copies are obtained;<\/p>\n<p>that then he was told that he need not keep on<\/p>\n<p>coming and asking for the copies; that he was<\/p>\n<p>assured that he would inform them when copies are<\/p>\n<p>ready;     that  accordingly   they   waited   for<\/p>\n<p>communication from the Lawyer; that in September<\/p>\n<p>2007, they came to know that all other parties in<\/p>\n<p>the     appeal had  received  copies   from   their<\/p>\n<p>respective counsel; that therefore she went to the<\/p>\n<p>office of the counsel again and made enquiries and<\/p>\n<p>then the counsel informed her that copies are not<\/p>\n<p>received; that thereupon she made enquiry in the<\/p>\n<p>office of the court personally on 29.9.2007 and<\/p>\n<p>came to know that no copy application had been<\/p>\n<p>filed; that when asked, counsel told her that it<\/p>\n<p>appears that his Clerk has omitted to file copy<\/p>\n<p>application; that immediately on her insistence a<\/p>\n<p>copy application was made; that on 25.10.2007 they<\/p>\n<p>were informed that copies have been received from<\/p>\n<p>court; that she went over to the office of the<\/p>\n<p>counsel and received copies on 27.10.2005; that she<\/p>\n<p><span class=\"hidden_text\">RSA 458\/08               3<\/span><\/p>\n<p>was told that ninety days&#8217; time will be available<\/p>\n<p>to file an appeal to the High Court of Kerala; that<\/p>\n<p>in the meanwhile, she fell ill with viral fever and<\/p>\n<p>was unable to move from the house due to illness<\/p>\n<p>that appellants 1 and 2 did not attend to the<\/p>\n<p>matter in her absence and waited for her to get<\/p>\n<p>better under the impression that they have got<\/p>\n<p>ninety days&#8217; time to file appeal; that they went to<\/p>\n<p>the office of the present counsel on 25.11.2007 and<\/p>\n<p>only when he informed that they realised that they<\/p>\n<p>will not get ninety days&#8217; time to file appeal, as<\/p>\n<p>no copy application was made in time and that thus<\/p>\n<p>there occurred a delay of 636 days in filing the<\/p>\n<p>appeal.\n<\/p>\n<p>     3.    No notice is being ordered on this C.M.<\/p>\n<p>Application, as it is felt unnecessary to order<\/p>\n<p>notice. It appears that the party and the counsel<\/p>\n<p>are under the impression that any amount of delay<\/p>\n<p>can be got condoned by filing an application making<\/p>\n<p>some bald averments and that too behind the back of<\/p>\n<p>the Lawyer, who was appearing in the court below<\/p>\n<p><span class=\"hidden_text\">RSA 458\/08                4<\/span><\/p>\n<p>and his Clerk.   There is no affidavit filed by the<\/p>\n<p>Clerk or the Lawyer in support of the application<\/p>\n<p>for condonation of delay.      As regards what the<\/p>\n<p>first appellant told her, he has got only hearsay<\/p>\n<p>knowledge. The first appellant who is stated to be<\/p>\n<p>one who was looking after the case also has not<\/p>\n<p>filed any affidavit swearing to facts within his<\/p>\n<p>knowledge to support the petition for condonation<\/p>\n<p>of delay. It has to be remembered that there must<\/p>\n<p>be an end to litigation and the successful party,<\/p>\n<p>to whom rights have accrued by reason of non filing<\/p>\n<p>of any appeal assailing the decree in their favour,<\/p>\n<p>cannot be called upon to answer the appeal after<\/p>\n<p>such a length of time and the rights so accrued to<\/p>\n<p>the successful party cannot lightly be interfered<\/p>\n<p>with. I see no just and sufficient cause to condone<\/p>\n<p>the delay of as much as 636 days in filing the<\/p>\n<p>Regular Second Appeal.\n<\/p>\n<p>     In the result, refusing to condone the delay of<\/p>\n<p>as much as 636 days in filing the appeal, I dismiss<\/p>\n<p>this C.M. Application.
