However,<br \/>\nby general circulars\/communications dated 03.10.2009, 01.08.2009,<br \/>\n19\/23.09.2009, 21.08.2009 &amp; 28.07.2009, the petitioners were<br \/>\ninformed to vacate the stalls.  Being aggrieved by the said<br \/>\ncirculars\/communications, the present petitions have been preferred.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocates appearing for the petitioners have submitted that the<br \/>\nlicences of the petitioners were renewed from time to time and the<br \/>\npetitioners were also regularly making payment of the licence fee.<br \/>\nThe general circulars\/communications called for discontinuation of<br \/>\nthese stalls on the ground that general cleanliness and hygiene was<br \/>\nnot being maintained by them.\n<\/p>\n<p>3.1\tLearned<br \/>\nadvocates for the petitioners have submitted that the petitioners are<br \/>\nwilling to abide by the terms and conditions imposed by the<br \/>\nrespondent corporation so as to ensure smooth functioning of their<br \/>\nstalls and their livelihood in turn.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has heard learned advocates for the parties and perused the<br \/>\npapers on record.  This court while granting ad-interim relief had<br \/>\nreserved liberty in favour of the respondent corporation to take<br \/>\nnecessary action in the event it finds that the person concerned is<br \/>\nnot maintaining hygienic standards or required cleanliness around his<br \/>\nplace of business.  Keeping in mind the renewal clause which is<br \/>\nbinding upon the parties, this court is of the view that the<br \/>\npetitioners&#8217; case may be considered by the respondent corporation on<br \/>\ntheir each filing an undertaking as regards to the abiding of rules<br \/>\nand regulations as laid down by the respondent corporation.  In such<br \/>\nan event, the following order is passed:\n<\/p>\n<p>The<br \/>\n\tpetitioners shall file an undertaking alongwith the renewal<br \/>\n\tapplication within a period of fifteen days from today stating<br \/>\n\ttherein that they shall abide by the rules of the corporation.\n<\/p>\n<p>The<br \/>\n\trespondent corporation being a State shall accept the renewal<br \/>\n\tapplication and the undertaking and consider the application as per<br \/>\n\tthe renewal terms of the agreement.\n<\/p>\n<p>It<br \/>\n\tis made clear that in case of any default by the petitioners, it<br \/>\n\tshall be open to the respondent corporation to refuse the renewal by<br \/>\n\tway of passing a reasoned order.\n<\/p>\n<p>If<br \/>\n\tany new policy of the respondent corporation comes into operation,<br \/>\n\tthe same shall be made applicable on the subsequent renewals which<br \/>\n\tis after the expiry of the present renewal.\n<\/p>\n<p>It<br \/>\n\tis also clarified that if the renewal application alongwith the<br \/>\n\tundertaking is not filed within 15 days, no rights shall be created<br \/>\n\tin favour of the petitioners.\n<\/p>\n<p>Needless<br \/>\n\tto say, the petitioners shall maintain hygienic standards and<br \/>\n\trequired cleanliness around their places of business in public<br \/>\n\tinterest.\n<\/p>\n<p>It<br \/>\n\tis hoped that the respondent corporation being a State shall not<br \/>\n\tcompel other contractors to approach this court and shall accept<br \/>\n\tthis order as a policy for other similarly situated parties.\n<\/p>\n<p>5.\tWith<br \/>\nthe above directions, these petitions are disposed of.  Rule is made<br \/>\nabsolute to the aforesaid extent.
