Act&#8221; for short) is to the<br \/>\ncorrectness of the judgment and award dated 27th<br \/>\nSeptember, 2000, rendered in MACP   No.864 of 1999 by the MACT<br \/>\n(Main), Kachchh at Bhuj, by which the application  filed below<br \/>\nExhibit-6  by the appellants (`claimants&#8217;  for short) under Section<br \/>\n163-A of the M.V. Act for getting  compensation on structured formula<br \/>\nbasis has been allowed and thereby  the claimants  are awarded<br \/>\ncompensation of Rs. 5,11,200\/-  with running interest at the rate of<br \/>\n12% per annum from the date of  application till the realization of<br \/>\nthe amount and accordingly the respondent No.3  &#8211; National  Assurance<br \/>\nCo. Limited  is directed to pay the said amount.\n<\/p>\n<p>2\t\tAt<br \/>\nthe time of hearing of this Appeal,  Mr. Mehul S. Shah, learned<br \/>\nAdvocate for the  claimants, upon instructions received from the<br \/>\nclaimants, submitted  that, the claimants  are withdrawing the main<br \/>\nclaim petition, being Motor Accident Claim Petition No.864 of 1999<br \/>\nfiled by them,  under Section 166 of the M.V. Act, which is pending<br \/>\nfor adjudication before the Motor Accident Claims Tribunal (Main),<br \/>\nKachchh at Bhuj, unconditionally,   treating the award passed below<br \/>\nApplication &#8211; Exhibit-6  under Section 163-A of the M.V. Act,<br \/>\nwhich is impugned in the instant Appeal, as final award.  He,<br \/>\ntherefore, seeks leave to withdraw this Appeal unconditionally  and<br \/>\nalso  the main claim petition, being Motor Accident Claim Petition<br \/>\nNo. 864 of 1999 filed by them  under Section 166 of the M.V. Act,<br \/>\nwhich is pending for adjudication before the Motor Accident Claims<br \/>\nTribunal (Main), Kachchh at Bhuj, unconditionally. He, therefore,<br \/>\nurges to pass an appropriate order in this regard.\n<\/p>\n<p>3\t\tMr.\n<\/p>\n<p>Vibhuti Nanavati, learned Advocate for the respondent No.3  &#8211;<br \/>\nNational Assurance Company Limited, has no objection, if leave as<br \/>\nprayed for is granted.\n<\/p>\n<p>4\t\tHence,<br \/>\nthe leave to withdraw the appeal is granted.\n<\/p>\n<p>5\t\tResultantly,<br \/>\nintant Appeal stands disposed of  as it is withdrawn with no order as<br \/>\nto costs.\n<\/p>\n<p>6\t\tAs<br \/>\na consequence thereof,  the Award, which is impugned in this Appeal<br \/>\nis treated as a final award  passed under Section 166 of the M.V.
