Justice S.S.SATHEESACHANDRAN\n\n Dated :04\/06\/2010\n\n O R D E R\n               THOTTATHIL B.RADHAKRISHNAN\n                                         &amp;\n                    S.S.SATHEESACHANDRAN, JJ.\n                     -------------------------------------------\n                     A.S.Nos.701 &amp; 709 OF 1993\n                     -------------------------------------------\n                 Dated this the 4th day of June, 2010\n\n\n                                JUDGMENT\n<\/pre>\n<p>Thottathil B.Radhakrishnan, J.\n<\/p>\n<\/p>\n<p>1.A.S.709\/93 arises from O.S.66\/91 and A.S.701\/93 arises from<\/p>\n<p>  O.S.67\/91 of the Sub Court, Ernakulam.<\/p>\n<p>2.Manikkanamparambil Chitties, a partnership firm, is the<\/p>\n<p>  plaintiff in O.S.66\/91 and its sister concern M.V.M. Chitty<\/p>\n<p>  Corporation, another partnership firm, is the plaintiff in<\/p>\n<p>  O.S.67\/91. The defendant is the same. These suits were tried<\/p>\n<p>  along with another suit of Manikkanamparambil Chitties<\/p>\n<p>  against the same defendant.                 While that was decreed,<\/p>\n<p>  O.S.66\/91 was decreed in part and O.S.67\/91 was dismissed.<\/p>\n<p>3.In both the suits from which these appeals arise, the pleading<\/p>\n<p>  in the plaints is only about the execution of a demand<\/p>\n<p>AS.701\/93 &amp; 709\/93<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>  promissory note each and the passing of consideration under<\/p>\n<p>  that note. Though it is pleaded that the cause of action is<\/p>\n<p>  based on original consideration also, the plaints do not contain<\/p>\n<p>  any pleading about any original cause of action independent<\/p>\n<p>  of, or collateral to, the execution of the demand promissory<\/p>\n<p>  note, on the basis of which, a decree could have been granted<\/p>\n<p>  otherwise than on the negotiable instruments on which the<\/p>\n<p>  plaintiff has sued.\n<\/p>\n<\/p>\n<p>4.In O.S.67\/91, the plaintiff M.V.M. Chitty Corporation pleaded<\/p>\n<p>  as having obtained Ext.A11 demand promissory note from the<\/p>\n<p>  defendant. A reading of that document would show that the<\/p>\n<p>  plaintiff had paid the amount covered by that note to the<\/p>\n<p>  defendant by cash. However, when PW1 who is the managing<\/p>\n<p>  partner of both the partnership firms gave evidence, he stated<\/p>\n<p>  that amounts which were due towards Manikkanamparambil<\/p>\n<p>  Chitties under different earlier transactions were taken<\/p>\n<p>  together and the amounts released from M.V.M. Chitty<\/p>\n<p>AS.701\/93 &amp; 709\/93<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>  Corporation was adjusted towards such amounts and the<\/p>\n<p>  defendant was paid the remaining amount towards the loan for<\/p>\n<p>  which he had come. But, PW2, the accountant gave evidence<\/p>\n<p>  that the payment was made in his presence and the entire<\/p>\n<p>  amount was paid by cheque. This obviously cuts at the root of<\/p>\n<p>  the contention of the plaintiff in O.S.67\/91.<\/p>\n<p>5.In so far as the appeal of the plaintiff in O.S.66\/91 is<\/p>\n<p>  concerned, the court below, after appreciating the evidence,<\/p>\n<p>  categorically found that going by the evidence of PW1 the<\/p>\n<p>  Manging partner, the entries in Ext.A9 document and Ext.A19<\/p>\n<p>  entry No.2, and other materials tendered in evidence do not<\/p>\n<p>  correlate and even PW1 had fairly conceded to such error.<\/p>\n<p>  The court below held that the amount that could be obtained if<\/p>\n<p>  the entire figures in Ext.A19 are totalled, is totally different<\/p>\n<p>  from that which is reflected in the plaint. Not only that, in our<\/p>\n<p>  view, the court below need not have laboured that much,<\/p>\n<p>  because there was no pleading in the plaint which would<\/p>\n<p>AS.701\/93 &amp; 709\/93<\/p>\n<p><span class=\"hidden_text\">                               4<\/span><\/p>\n<p>  generate an adjudication on the basis of the original cause of<\/p>\n<p>  action since the plaint in O.S.66\/91 had also contained only<\/p>\n<p>  pleadings regarding the execution of a negotiable instrument<\/p>\n<p>  on the basis of which the suit is filed. The mere statement in<\/p>\n<p>  the paragraph describing the cause of action that the suit is<\/p>\n<p>  filed on the original transaction or original cause of action<\/p>\n<p>  does not, in any manner, improve the case in favour of the<\/p>\n<p>  plaintiff.\n<\/p>\n<\/p>\n<p>6.It has also come out in evidence before the court below that<\/p>\n<p>  the brother of the defendant had taken over the liabilities of<\/p>\n<p>  the defendant and the plaintiff had obtained separate decree<\/p>\n<p>  against him.\n<\/p>\n<\/p>\n<p>7.With all the aforesaid, we do not find any illegality in the<\/p>\n<p>  appreciation of evidence by the court below and there is no<\/p>\n<p>  ground to interfere with the findings in the impugned<\/p>\n<p>  judgment. The decree, therefore, stands.<\/p>\n<p>AS.701\/93 &amp; 709\/93<\/p>\n<p><span class=\"hidden_text\">                             5<\/span><\/p>\n<p>  In the result, these appeals fail.   They are accordingly<\/p>\n<p>  dismissed.
