Singh, Advocate has entered appearance on behalf of<br \/>\nrespondent no. 4.\n<\/p>\n<p>By the next date fixed, counter affidavit may be filed.<br \/>\nIt has been sought to be contended on behalf of petitioner that in the<br \/>\npresent case inquiry report was submitted and on 24.11.2008 show<br \/>\ncause notice was issued and reply was submitted on 01.01.2009 and<br \/>\nthereafter without considering and dealing with said reply in its correct<br \/>\nperspective, thereafter on 22.07.2010 order has been passed ceasing<br \/>\nfinancial and administrative of the petitioner.<br \/>\nPrimafacie arguments advanced requires consideration of this Court.<br \/>\nIssue which has been sought to be raised has already been referred to<br \/>\nLarger Bench in Civil Misc. Writ Petition No. 60951 of 2009 (Madho Lal<br \/>\n(Pradhan) Vs. State of U.P. and others) and Civil Misc. Writ Petition No.<br \/>\n49305 of 2009 (Het Kishan Vs. State of U.P. and others).<br \/>\nAforesaid orders have been affirmed by Division Bench comprising<br \/>\nHon&#8217;ble Acting Chief Justice &amp; Hon&#8217;ble A.P.Sahi in Special Appeal No.<br \/>\n528 of 2010 (Smt. Sabir Vs.
