No.5610 of 2011 has been filed for substituting<\/p>\n<p>                  the   sole     petitioner   Birendra    Kumar      Singh,    who    died<\/p>\n<p>                  on14.12.2010. The heirs of Birendra Kumar Singh are<\/p>\n<p>                  mentioned at paragraph 2 of the interlocutory application.<\/p>\n<p>                               I. A. No. 5610 of 2011 is allowed and the Office is<\/p>\n<p>                  directed to substitute the name of the deceased petitioner by his<\/p>\n<p>                  heir and legal representative as described in paragraph 2 of the<\/p>\n<p>                  interlocutory application.\n<\/p>\n<p>                               Heard Counsel for the petitioners and the State.<br \/>\n<span class=\"hidden_text\"> 2   Patna High Court CWJC No.7910 of 2008 (3) dt.20-10-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                         2\/3<\/span><\/p>\n<p>                          The petitioner is aggrieved by Annexure 1 and 5<\/p>\n<p>              passed in a land encroachment proceedings, by which the<\/p>\n<p>              original petitioner has been asked to remove the encroachment<\/p>\n<p>              on Khesra No. 451 measuring 93 x 56 feet.\n<\/p>\n<p>                          Learned Counsel for the petitioners submits that on the<\/p>\n<p>              land in question, there is a hotel which has been running for the<\/p>\n<p>              past 30 years. It is on the Falgu river.\n<\/p>\n<p>                          Counsel for the State, on the basis of the counter<\/p>\n<p>              affidavit, has stated that several persons have encroached upon<\/p>\n<p>              the said river, which causes great difficulties during the period<\/p>\n<p>              when Pind Dan is performed.\n<\/p>\n<p>                          Annexure 5 is the final order supposedly passed in the<\/p>\n<p>              encroachment proceeding. Virtually, this is a non-speaking order<\/p>\n<p>              as it does not take into account the show cause filed on behalf of<\/p>\n<p>              the original petitioner which supposedly indicates that the<\/p>\n<p>              original petitioner was a bonafide purchaser of the said lands.<\/p>\n<p>                          While considering the question as to whether the<\/p>\n<p>              original petitioner was a bonafide title over the lands in question,<\/p>\n<p>              obviously, the State have to consider whether the vendors of the<\/p>\n<p>              original petitioner had the title over the lands in question.<\/p>\n<p>                          All these aspects would be highlighted in the order<\/p>\n<p>              passed in Encroachment Case No. 10 of 2007-08.<br \/>\n<span class=\"hidden_text\"> 3           Patna High Court CWJC No.7910 of 2008 (3) dt.20-10-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                 3\/3<\/span><\/p>\n<p>                                  In the result, Annexures 1 and 5 are quashed and the<\/p>\n<p>                      matter is remanded back to the Circle Officer, Town, Gaya to<\/p>\n<p>                      hear the petitioners and pass a speaking order.<\/p>\n<p>                                  The petitioners are directed to produce a copy of this<\/p>\n<p>                      order before the Circle Officer, Town, Gaya within a period of<\/p>\n<p>                      one month from the date of receipt of a copy of this order, who<\/p>\n<p>                      will dispose of the proceedings expeditiously within a period of<\/p>\n<p>                      three months thereafter.\n<\/p>\n<p>                                  This writ application is disposed of with the aforesaid<\/p>\n<p>                      observations and directions.\n<\/p>\n<\/p>\n<p>                                                                      (Sheema Ali Khan, J)<br \/>\nPrabhakar Anand\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Birendra Kumar Singh vs The State Of Bihar &amp; Ors on 20 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Civil Writ Jurisdiction Case No.7910 of 2008 ====================================================== 1.
