Bhatnagar for the State and Sri Nazim<br \/>\nAli Siddiqui for Zila Panchayat.\n<\/p>\n<p>This matter is pending in this Court since the year 1997. The<br \/>\nState Government has not filed any counter- affidavit despite<br \/>\nthe case being listed number of times nor has been able to<br \/>\nproduce provincialisation order in respect of Qaiserganj<br \/>\nhospital.\n<\/p>\n<p>The questions involved in this petition are, whether after the<br \/>\npermission granted by the State Government on 9.4. 1996 to<br \/>\nthe Zila Panchayat for construction of shops over an area of<br \/>\n70 x 12 ft. on two plots adjacent to the gate of the hospital<br \/>\nsaying it to be the land of the Zila Panchayat, the Chief<br \/>\nMedical Officer could have restrained the construction of<br \/>\nsuch shops on the ground that the Qaiserganj hospital was<br \/>\ntaken over by the State Government, therefore, in the<br \/>\nprovincialisation order, the said land must have been included<br \/>\nand therefore, it should be the land of the State Government<br \/>\nand not of Zila Panchayat.\n<\/p>\n<p>It was on account of this observation made in the letter of<br \/>\nC.M.O. Dated 14.5. 1997 that this Court granted time on<br \/>\n various occasion to the State Government to produce the<br \/>\nprovincialisation order, if any of the hospital in question, but<br \/>\ntill date the same has not been brought on record.<br \/>\nWe, therefore, proceed to decide the writ petition drawing<br \/>\ninference against the observation made by the C.M.O. in this<br \/>\nregard, in the absence of any provincialisation order being put<br \/>\non record.\n<\/p>\n<p>It so appears that the Qaiserganj Hospital was taken over by<br \/>\nthe State Government sometimes in the year 1956- 57 and<br \/>\nhence the Zila Panchayat, as it then was, made a request to<br \/>\nthe State Government for return of certain land (which is the<br \/>\nland in question) for construction of shops so as to provide a<br \/>\nmarket. On this request, which is evident from the letter dated<br \/>\n11.3.1958 contained as annexure no. 1 to the counter-<br \/>\naffidavit, direction was given to the Director, Medical and<br \/>\nHealth, U.P. and to Civil Surgeon, Bahraich to look into the<br \/>\nmatter and give comments.\n<\/p>\n<p>On 8.2.1958 a letter was written by the Secretary to the Govt.,<br \/>\nPublic Health Department, to the Deputy Commissioner,<br \/>\nBahraich making request to transfer the said portion of the<br \/>\nland under the control of the Board in accordance with law so<br \/>\nthat necessary action may be taken in this regard. The C.M.O.<br \/>\nVide letter dated 20.3. 1958 made several suggestions and<br \/>\ngave reasons for requirement of the land for the hospital also.<br \/>\nIt   was,    thereafter,   that   the   matter   remained   under<br \/>\nconsideration and lastly on 9.4. 1996 the State Government<br \/>\ngave permission to the Zila Panchayat for construction of the<br \/>\nshops on both the sides of the gate on a parti land having<br \/>\n dimension of 70 x 12 ft.\n<\/p>\n<p>Learned counsel for the petitioner has drawn the attention of<br \/>\nthis Court to the fact that a public interest litigation was<br \/>\nearlier filed challenging the said permission for raising of<br \/>\nconstruction of the shops aforesaid, which was dismissed and<br \/>\nthereafter C.M.O. Bahraich wrote a letter to the Deputy Chief<br \/>\nMedical Officer on 12.5. 1997 saying that reference be had to<br \/>\nthe permission granted by the State Government allowing the<br \/>\nconstruction of the shops over the land in question and that of<br \/>\na note to the effect that the public interest litigation filed<br \/>\nagainst     such      sanction   has   been    dismissed     on<br \/>\n25.4.1997,therefore, necessary cooperation be extended to the<br \/>\nZila Panchayat for construction of those shops.<br \/>\nPrior to the aforesaid letter of the C.M.O. dated 12.5. 1997,<br \/>\nsince the C.M.O. was creating some obstacle in raising<br \/>\nconstruction, therefore, the State Government issued D.O.<br \/>\nletter on 5.5. 1997 taking cognizance of the aforesaid conduct<br \/>\nof the C.M.O. directed that no hurdle should be created in the<br \/>\nconstruction of the shops and if any obstacle is created then it<br \/>\nwould result into financial loss to the Zila Panchayat, which<br \/>\nis not in its interest.\n<\/p>\n<p>However, soon thereafter on 14.5. 1997, purportedly in reply<br \/>\nto the D.O. Letter dated 5.5. 1997, the C.M.O. again<br \/>\nrestrained the Zila Panchayat from constructing the shops<br \/>\nsaying that the land in question must have been vested in the<br \/>\nState Government as a result of the provincialisation of the<br \/>\nhospital and therefore, the shops cannot be allowed to be<br \/>\nconstructed.\n<\/p>\n<p> On 17.12.1996 also the State Government wrote a letter to the<br \/>\nDistrict Magistrate, Bahraich that action be taken in<br \/>\npursuance of the permission granted on 9.4. 96 and the same<br \/>\nbe communicated to the State Government. Again on 2.1. 97<br \/>\nthe District Magistrate in response to the aforesaid letter<br \/>\naddressed a letter to the C.M.O. that he may extend<br \/>\ncooperation in the matter of construction of the shops.<br \/>\nThus, despite the permission          granted by the State<br \/>\nGovernment on 9.4. 96 and repeated directions being issued<br \/>\nin the form of Demi Official letters and circulars, the C.M.O.<br \/>\nthough on 12.5. 97 agreed when the challenge to the aforesaid<br \/>\nsanction could not succeed in the writ petition filed as public<br \/>\ninterest litigation and directed that full cooperation be given<br \/>\nin making the shops by the Zila Panchayat but within two<br \/>\ndays, he passed the order impugned.\n<\/p>\n<p>The question is, whether there is provincialisation order of<br \/>\nthe Qaiserganj dispensary now hospital and whether under<br \/>\nthe said order, land in question also stood transferred to the<br \/>\nState Government or that said land still belongs to Zila<br \/>\nPanchayat as has been observed by the State Government in<br \/>\nits permission, would be of little significance in view of the<br \/>\nfact that the State Govt. is supposed to have knowledge of all<br \/>\nthe facts and had consciously granted permission to the Zila<br \/>\nPanchayat to make shops over the land in question. This<br \/>\npermission was granted on 9.4. 96. Attention has also been<br \/>\ndrawn to the letter dated 25.6. 97, which has been written by<br \/>\nthe Director, Medical Health to the C.M.O. saying that the<br \/>\nland belonged to the Govt. and the Govt. has granted<br \/>\n permission to the Zila Panchayat for construction of the<br \/>\nshops, therefore, necessary cooperation be extended.<br \/>\nThe fact, therefore, remains that the permission granted by<br \/>\nthe State Government has never been revoked nor cancelled,<br \/>\nrather no opposition has been put forward in the writ petition<br \/>\nalso on behalf of the State Government, who has not filed any<br \/>\ncounter- affidavit . The only counter- affidavit, which has<br \/>\nbeen filed, is of C.M.O. opposing the writ petition. Zila<br \/>\nPanchayat has filed the counter- affidavit, which supports the<br \/>\nplea of the petitioner.\n<\/p>\n<p>Even accepting otherwise for the argument sake that the land<br \/>\nstood transferred to the State Government,the State Govt. was<br \/>\nstill competent to grant permission for raising such shops\/<br \/>\nconstruction and if such permission is granted by the State<br \/>\nGovt., the officers of the State Govt. may be the Chief<br \/>\nMedical Officer, cannot take a stand, which is directly in<br \/>\nopposition to the order of the State Government. It was for<br \/>\nthe State Govt. to consider as to whether permission should<br \/>\nbe granted for raising construction of shops in question or not<br \/>\nto grant permission. The State Govt. not only granted<br \/>\npermission after considering the views expressed by the<br \/>\nC.M.O. as far back on 20.3. 58 but repeatedly directed the<br \/>\nC.M.O. and required the District Magistrate to see that no<br \/>\nobstacle is created by the C.M.O. in the matter of<br \/>\nconstruction of shops but even then the C.M.O. did not allow<br \/>\nthe Zila Panchayat to undertake construction.<br \/>\nIn the absence of any resistance by the State Govt. in the<br \/>\nmatter of construction of the shops over the land in question,<br \/>\n coupled with the fact that the permission has been granted by<br \/>\nthe State Govt., itself, which has never been revocked, there<br \/>\ncannot be any authority or right vested with the C.M.O. to<br \/>\noppose such construction. The order passed by the C.M.O.<br \/>\ndated 14.5.1997 is ,therefore, liable to be quashed, rather his<br \/>\norder for not making construction of the shops, runs contrary<br \/>\nto the permission granted by the State Govt, which cannot be<br \/>\nsustained.\n<\/p>\n<p>The order passed by the Chief Medical Officer dated<br \/>\n14.5.1997 is, hereby, quashed.\n<\/p>\n<p>Writ petition is allowed with costs.\n<\/p>\n<p>Order Date :- 13.1.2010<br \/>\nSadiq\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Smt.
