DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tHeard<br \/>\nlearned advocates appearing for the parties.\n<\/p>\n<p>2.\tBoth<br \/>\nthese matters are taken up for final disposal at the request of<br \/>\nlearned counsels appearing for the parties.\n<\/p>\n<p>3.\tThe<br \/>\napplicant of both the above applications have preferred this interim<br \/>\nbail under Section 439 read with Section 437 of the Criminal<br \/>\nProcedure Code, 1973, to release him temporarily for a period of 30<br \/>\ndays regarding C.R.No.I-476 of 2009 and 257\/2009 registered with Umra<br \/>\nPolice Station and Puna Police Station, Surat, respectively.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>J.B. Pardiwala, learned counsel appearing for the applicant submits<br \/>\nthat the applicant is advised to undergo surgery for a fairly large<br \/>\nposterocentral and a left paracentral disc extrusion at L5-S1 level,<br \/>\nas opined by Dr. Ashish Mehta, Consultant Spinal &amp; Neurological<br \/>\nSurgeon, Mumbai and it is submitted that the above opinion is<br \/>\nrendered after detailed diagnose carried out through M.R.I. study of<br \/>\nlumbio-sacral spine by the competent radiologist.\n<\/p>\n<p>4.1.\tMr.\n<\/p>\n<p>J.B.Pardiwala, learned counsel further submits that though the trial<br \/>\ncourt has verified the above aspect and has observed that the<br \/>\noperation for the ailment can be carried out at New Civil Hospital,<br \/>\nSurat but considering the risk involved while performing the<br \/>\noperation and complications that may arise, for a better treatment<br \/>\nand care, the applicant would like to be operated at Apple Hospital<br \/>\nSurat, where the Neuro Surgeon from Bombay would perform the<br \/>\noperation and the applicant can be treated accordingly.  It is<br \/>\nfurther submitted that the applicant is a permanent resident of Surat<br \/>\nand not likely to run away from the course of justice or law and<br \/>\nwould like to abide by the conditions that may be imposed by this<br \/>\nCourt.\n<\/p>\n<p>5.\tI<br \/>\nhave heard learned APP appearing for the respondent-State and a<br \/>\nstatement dated 26.12.2010 of Dr. Anriruddha Solanki is recorded and<br \/>\nthe ailment of the applicant is verified and it is not in dispute<br \/>\nthat the surgery is necessary for the ailment of L5 -S1 level.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe submissions of learned counsels appearing for the parties,<br \/>\nopinion, certificates and medical reports of the Neuro Surgeon, I am<br \/>\nof the opinion that the applicant is in need of surgery as advised by<br \/>\nthe experts in the field and for that the applicant can be granted<br \/>\ninterim\/temporary bail and he can be hospitalized for a specialized<br \/>\ntreatment for  surgery of a complicated nature at Apple Hospital,<br \/>\nSurat.  While the applicant is admitted in the Apple Hospital, Surat,<br \/>\ntwo armed guard will be deputed and expenses for which shall have to<br \/>\nbe borne by the applicant.  The applicant is ordered to be enlarged<br \/>\non a temporary bail for a period of three weeks from the date of<br \/>\nreceipt of the copy of the order of this Court and shall inform the<br \/>\ninvestigating authority about his whereabouts and permanent address.<br \/>\nThe applicant shall also furnish the bond of Rs.5,000\/- and surety of<br \/>\nlike amount to the satisfaction of the Court concerned.\n<\/p>\n<p>7.\tWith<br \/>\nthe above observations and directions, both the applications are<br \/>\nallowed accordingly.\n<\/p>\n<p>[ANANT<br \/>\nS.
