Thereafter, said Yojna came to be closed as<br \/>\n\tper Govt. Resolution dated 31.8.1981. Therefore, petitioner was<br \/>\n\tabsorbed as senior clerk and placed under TDO Viramgam. Afterwards,<br \/>\n\tall the ad.hoc employees of Sarvodaya Yojna made representation to<br \/>\n\tState Government to absorb them on regular basis in panchayat<br \/>\n\tservice which was considered favourably by State Government and<br \/>\n\tpetitioner was absorbed on regular basis from 1.4.1987 after<br \/>\n\treverting petitioner to the post of Junior Clerk. Petitioner is<br \/>\n\tclaiming that he is entitled for 1st Higher Pay Scale<br \/>\n\tfrom 14.6.1987 in pay scale of Rs.1400-2600 and 2nd<br \/>\n\thigher grae from 14.6.2002 after fifteen years in scale of<br \/>\n\tRs.5500-9000 as per GR dated 16.8.1994. In other district, this<br \/>\n\tbenefit has been granted to similarly situated employees but not<br \/>\n\tgranted to petitioner and, therefore, petitioner has filed this<br \/>\n\tpetition.\n<\/p>\n<p>In<br \/>\n\tview of these facts submitted by petitioner in memo of petition, let<br \/>\n\tpetitioner may make detailed representation to respondent authority<br \/>\n\twithin one month from date of receipt of copy of this order.\n<\/p>\n<p>As<br \/>\n\tand when such representation made by petitioner is received by<br \/>\n\trespondent authority, it is directed to respondent authority to<br \/>\n\treconsider claim of petitioner in respect to granting benefit of<br \/>\n\tfirst and second higher pay scale from date of joining  in Sarvodaya<br \/>\n\tYojna and then to pass appropriate reasoned order in accordance with<br \/>\n\tlaw within three months from date of receipt of representation from<br \/>\n\tpetitioner and then to communicate decision to petitioner<br \/>\n\timmediately thereafter.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, this petition is disposed of by<br \/>\n\tthis court without expressing any opinion on merits.
