RESPONDENTS\n\n(By Sri M.P.Srikanth, Advocate for R1, R2--served and\n\nunrepresented)\n\n\n\nThis M.F.A. is \ufb01led under Section 173(1) ofdt-he MV\nAct against the judgment and award dated\n\npassed in MVC No.3786\/2008 on the \nAdditional Judge and Member, ll\/lotor   g \nTribunal, Bangalore (SCCH- '\n\nclaim petition for compensation  '~ s'-eeliilng\n\nenhancement of compensVati;on.g\nThis M.F.A. coming  day, the\ncourt delivered the fo'llo_*_oVing,:.\u00a77'V::'   T'\n  \ngs  it before the Motor\nAccident    being aggrieved by the\n\njudgmentnand awards' dated 29.06.2009 made in\n\n  filed this appeal, seeking\n\nV' I =en?o.ai1vcem'crit' -of compensation.\n\n 'ilhev 'tirief facts of the case are as follows:\n\nThe claimant along with his minor son were\n\nTA\"-fplroceeding slowly and cautiously on Bangalore to\n\nit \"'\"l\\\/Iysore Road on a bicycle on 17.04.2008, at about 7.00\n\np.m., to collect money from the customers regarding\n\nvending of milk, near Rama Temple Arch, Ramanagara\n\n\/2?\n\n\n\nTown. At that time, goods tempo bearing registration\n\nNo. KA--01-C--1089 came from Mysore by overt.a}:ing a\n\nlorry in a rash and negligent \n\nagainst the petitioner's bicycle- ~Due to ' ~ \n\nthe petitioner and his minor   \n\nsustained grievous injurie_s:~~._% lrnmedia'tely,llV\"'he was\n\nshifted to Government Rar'nan'agara for\ntreatment. The son'   to the same\nhospital for,  \"accident, he has\nsustainedllirij'u.'ries._ and he has spent\nhuge lutrleatrnent and sought for\n\ncompensaecn  5', oo;-ooa\/-.\n\n   pursuanlclellto the notice issued by the Motor\n\n  Tribunal, the List respor1dent--Insurer\n\n\ufb01led  statement of objections. However, the 2nd\n\n prespondient remained expaxte. The 1st respondent in the\n\n -,,vob._jeAction statement denied the averrnent made in the\n\n V.._..staten1ent. However, admitted that the said goods\n\nvehicle was covered by Insurance. The 13' respondent\n\nalleged that due to the rash and negligent riding of the\n\nA\n\n\n\nbicycle, accident has taken place while snddenly\n\ncrossing the road. It is also contended;'~tlfi'at*\u00ab_the\n\ncompensation claimed by the claimant is_.AexcessiVe \n\nthe petitioner has to prove the.;disa4bili:ty\"an*d;  ' in \"\n\ndismissal of the appeal as against :7'\n\n4. On the basis of the pleadingsllof parties, the\nMotor Accident  'i7'_rib-f.Jnal_'\u00bbt\"r'amed the following\n\nissues.   '\nI.     proves that he has\n ....  _T\"s_t1stained_':injt,rrie~s....i;i a MVA that was taken\nVplaeevf'on\"-._l7._\u00a2i.2008, at about 7.00 p.m.,\n\" ypBangalore'%'-My*s'ore Road, near Rama Temple\n Ranianagara Town due to user of\n Goodst....Carrier Tempo bearing No.KA--Ol--C--\n being driven by its driver in an\n\n '5s\"Q't'ionab1e negligence?\n\n a ll,  Whether the petitioner is entitled for the\nit compensation as prayed for? If so, against\n\nwhom'?\n\nHI. What order and award?\n\nA\"\n\n\n\n5. The petitioner in order to prove his case examined\n\nhimself as P.W.l and got marked documents,\n\nto Ex.P.16. The Doctor who has \n\nexamined as PW.2. However, the._respondents liave not ' . \n\nexamined any witnesses. The  of\"-the_ins\u00a7j'ran*c.e\n\nPolicy marked as Ex.R.1   ofl'th'e'parties;\" V\n\n6. On the basis of  parties and\nalso documents:-_ produced by the\nciainiarlt;  tillairns Tribunal is of the\n'the\"~r:ashllafldfnegligent driving of the\n has taken place. The police\n\nhave_regis'tered_a case\" against driver of the said vehicle\n\n  voffences punishable under Sections 279 and 337\n\n   Section 187 of MV Act. The report of\n\ntl1\u00a7 1\\\/I;otr'):r:'..\"\\fll.ehicle Inspector and sketch clearly shows\n\n that accident has taken place due to the rash and\n\nT'  negligent driving.\n\n7. With regard to quantum of compensation is\n\nconcerned, though the claimant contend that he was\n\n\/$\u00ab\n\n\n\n6\n\nearning \u20ac12,000\/-- per month by milk vending\nbusiness. In support of the same, no document has\n\nbeen produced. In the absence of the .'\n\nAccident Claims Tribunal taking into the \n\nincome of ?.lOO\/-- per day and   7\n\n?.36,000\/- has awarded compensation.  A .' by 1\n\n8. The P.W.2  depose'd\u00ab..1;_h.,a\"t.yhe has treated the\nclaimant and i.ssuedA.wo.und Ex.P.4. As per\n\nthe wound:  at _the claimant has\nsustained  foilotyiin inj \n\nI]    'injury to the right knee\n\n it ll} Fracture, of 591 and 6\"' ribs on right side\n\nA A * -.  .,:_IlI] *,?\"Abrasion over right leg\n\nat Eibrasion over the face\n\nit   Doctor has opined that, injuries No. 1 and 2 are of\n\ngrievous in nature. The doctor has opined that there is a\n\npermanent disability of 25% in right lower limb and\npermanent disability to the whole body is 9%. The\n\nTribunal taking into consideration the opinion\n\n&amp;~\n\n\n\nexpressed by the doctor considered the permanent\n\ndisability at 5% and awarded compen_sati'on-~.Vv at\n\n?.1,05,200\/- i.e., 325,200\/W towards losisdd4'ot3j'fidit\"e.reVy\n\nincome, ?.2(),00O\/- towards,  pain   *4  ' 5 \n\n\u20ac50,000\/~ towards medical  \n\ncharges and (10,000\/--  loss \"medical V\n\nexpenses with interest at _6%-..per\"'annurn\"from the date\nof petition till the date of  aggrieved by\nthe judgmentarid  Motor Accident\n\nClaims  preferred the present\n\n9. _ _ Srid4B.If:{eshavamVtirthy, Advocate appearing for the\n\n  contendthat the judgment and award passed\n\n 'byuthe\u00bb-..ll\/iotor_1..Accident Claims Tribunal is contrary to\n\nlaw.  the doctor in his evidence has deposed\n\n that the permanent disability is at 9% to the whole\n\n  but the Tribunal has taken the disability at 5%\n\n =  awarded compensation, which is contrary to law.\n\nFurther, the claimant contended that he was a milk\n\nVendor by profession and was earning 312,000\/-- per\n\nAw\n\n\n\nmonth, but the Tribunal has taken into consideration\n\n3100\/ ~ per day and awarded compensation,vw.vif}f1:ic~h is\n\nvery meager and sought for enh_ancemen=t \n\ncompensation.   \n\n10. On the other hand;._ti}.ri M;p,si--:i;ant1\u00a7[,\"iAavocate~'\n\nappearing for the _.i\u00a7i responxcleii.t. contends} that the\ncompensation aw3.rded__'  it  Accident Claims\nTribunal is  Taking into\n of the claimant, the\nTribunal   tco\ufb01i'pvensation, which is in\naccordance'  sought for dismissal of the\n\napp6a1\u00ab \n\n   he  gone through the arguments\n\naddressed' the parties and perused the oral and\n\n Apdocutmc-intary evidence let in by the parties. The fact is\"\n\nQ' --..pn-otiin dispute that the claimant sustained injuries on\n\n V\u00bb ...----i7.0-4.2008 at about 7.00 p.m., near Rama Temple\n\nArch, Ramanagara Town. Due to the accident, he has\n\nsustained injuries as referred above. He was admitted\n\n\/5\u00bb\n\n\n\nto the Government Hospital, Ramanagara.  taken\n\ntreatment. He has stated that he had spent \n\n?.50,000\/- towards medicai expenditure. by\n\nof the charge sheet filed before they \"  ' ; \n\nmotor vehicle inspector and   \n\naccident has taken p1aceV\u00bbdt:1'e~._to  V\n\ndriving of the said goods ter\ufb02]3i3_}\" \n\n12. With     compensation is\n\nconcerned;  claims Tribunal taking\n\ninto:c'o\"Iisiderati3on  ?.100\/- per day and\"\n\npemnanent Vdisab'il1ty'\u00bb.E'3% has awarded compensation.\n\nACCO.1?dir1\u00a7\" if' ihi'mt\u00b0.th'e\" award of the Motor Accident\n\n  ,  to the report of the doctor.\n\n  iiiihie report has opined that the disability is\n\n beiiiiig Tribunal has taken the disability at only\n\n  \"which is contraiy to the opinion expressed by the\n\nVhtt-,,Vdoc.tor. Further, even a daily Wager also earns 3.100\/w\n\n e. .._..per day. in the instant case, the ciaimant is a rniik\n\nvendor by profession and he was depositing the money\n\nto the Bank. He has produced Ex.P.5---Certi\ufb01ed Copy of\n\nAb\n\n\n\n10\n\nthe Bank Challan. Hence, the income of the claimant at\n\n$100\/-- per day as considered by the Tribur1jali:.is:\"Very\n\nmeager. Hence, his income has to be takaen \"\n\nper day and monthly incoineiofi  \n\nincome of \u20ac45,000\/~.
